The City Commission of the City of Sanford, Florida, met in adjourned session at the
City Hall in Sanford, Florida, at 1 :15 O'Clock P.M. January 27, 1931.

"RESOLUTION NO. 403.
A RESOLUTION TRANSFERRING CERTAIN FUNDS OF THE CITY OF SANFORD, FLORIDA, TO THE BOARD
OF BOND TRUSTEES OF SAID CITY AND DIRECTING THE PAYMENT BY SAID BOARD OF BOND TRUSTEES OF
CERTAIN INDEBTEDNESS OF THE CITY OF SANFORD, FLORIDA.
WHEREAS, by peremptory Writ of Mandamus in that certain cause pending in the Circuit
Court of Seminole County, Florida, wherein STATE OF FLORIDA, ex rel, C T DIEHL, KENNETH
M. KEEFE, A C MITTENDORF AND NATT T. WAGNER, were relatores and H.J. LEHMAN, W.A.LEFFLER,
CLYDE A. BYRD, V.A SPEER, and T.L.DUMAS, as and comtituting the City Commission of the
City of Sanford, Florida, F.S. LAMSON as City Clerk of said City and RALPH B. WIGHT And
JOHN MEISCH, as and constituting the Board of Bond Trustees of said City,were respondents,

the above named Respondents were commanded to pay to the above named relators the sum of
TWENTY FOUR THOUSAND AND TEN AND NO /100 ( $24,010.00) DOLLARS out of the Special Assessment
fund of said City of Sanford and in that certain cause pending in the Circuit Court of
Seminole County Florida, wherein STATE OF FLORIDA, ex rel, KENNETH M KEEFE, C.T DIEHL ,
A.C. MITTENDORF AND NATT T. WAGNER, were Relators and H J LEHMAN, W. A LEFFLER, CLYDE A
BYRD, V.A SPEER AND T. L. DUMAS , as and constituting the City Commission of the City
of Sanford , Florida, F.S.LAMSON, as City Clerk of said City and RALPH B. WIGHT and JOHN
MEISCH, as and constituting the Board of Bond Trustees of said City, were respondents,
said respondents were commanded by Peremptory Writ of Mandamus to pay to the above named
Relators the sum of FITTY SIX THOUSAND NINE HUNDRED AND NINETY ( $56,990.00) DOLLARS, and
WHEREAS, in that certain proceeding pending in the Circuit Court of Seminole County
Florida, wherein STATE OF FLORIDA, ex rel, IRVIN B ALLEMAN,was Relator, and H.J. LEHMAN,
as Mayor Commissioner and VIVIAN A SPEER, W A. LEFFLER, R.A.NEWMAN and F.L. MILLER, as
City Commissioners, as and constituting the City Commission of the City cc Sanford,
Florida, and FRANK S. LAMSON, as the City Clerk of the City of Sanford, Florida, and
WALTER L. COOPER, FRANK L. WOODRUFF and RALPH B. WIGHT, as and constituting the Bond
Trustees of the Sinking Fund of the City of Sword, Florida, were respondents, the said
Respondents were commanded to pay to the said Relator IRVEN B. ALLEMAN, the sum of
TWENTY EIGHT HUNDRED AND TWENTY FIVE ($2825.00) DOLLARS, out of the Special Assessmenm
Fund of said City of Sanford, Florida, am ,

WHEREAS, the City of Sanford, Florida, has the sum of $55,973.71 in the Ordinary Fund
of said City applicable to the payment of said amount and said City of Sanford has the
sum of $26,835,00, in the Special Assessment Fund of said City,- and $1016.29 in the Gas
Plant Sinking Fund:
NOW THEREFORE BE It Resolved, that said sum or $55,973.71 be transferred to RALPH B.
WIGHT and JOHN MEISCH, as the Board of Bond Trustees of the City of Sanford, Florida, and be
it further resolved, that said Ralph B.Wight and John Meisch as said Board of Bond Trustees
of said City shall pay to the above named C.T.DIEHL, KENNETH M. KEEFE, A.C.MITTENDORF and
NATT T. WAGNER, said sum of $24,010.00 out of the Special Assessment Fund, making check
payable pursuant to the request of said Relators, to Kenneth M. Keefe, Treasurer of the
Bondholders Protective Committee of the City of Sanford., Florida, upon the surrender to said
Board of Bond Trustees of coupons described in said Peremptory writ of Mandamus..
Be.It Further Resolved that said Ralph B.Wight and John Meisch as said Board of Bond
Trustees pay to Kenneth M.Keefe, C.T.Diehl , A.C.Mittendorf and Natt T. Wagner, the sum
of $56,990.00 making check payable pursuant to request of said relators to Kenneth M.Keefe,
Treasurer of the Bondholders Protective Committee of the City of Sanford , Florida, upon;
the surrender to said Board of Bond Trustees of the coupons described in the aforesaid
Peremptory Writ of Mandamus.

Be It Further Resolved that said Ralph B. Wight and John Meisch , as said board /Bond
Trustees pay to the above named IRVEN B ALLEMAN the sum of $2525.00 upon the surrender to
them of bonds numbers 100 and 101 of Improvement Bonds, Series R.R. dated January 1, 1927
and issued under Resolution No. 339 and thirty (30) interest coupons numbers five, six and
seven each of $27.50 off of and from Bonds numbers 100 to -.109 inclusive, of said Series
R.R. dated January 1, 1927 and issued under said Resolution No. 339•
Be it further resolved that this Resolution shall become effective immediately upon:
its passage and adoption.
