032331MINUTES 342- 3 42- CITY 'COMMISSION, SANFORD, FLORIDA, March 23 at 7:30 P M The City Commission of the City,of Sanford, Florida, met in Regular Sessiom at the City Hall in Sanford, Florida, at 7:30 O'Clook P.M. March 23, 1931. Present: Commissioner T.L.Dumas, Mayor. " W.A.Leffler " H.J.Lehman " V.A.Speer " 0.A. Byrd . City Attorney Fred R.Wilson City Clerk F.S.Lamson Chief of Police R.G. Williams Meeting called to order by the Chairman. M inutes of Regular meeting of march 9th and Special Meeting of. March 16th. 1931 , read and approved. Committee from the Sanford Country Club next presented report as to revenues and expenditures of the Golf Course from April lot, 1930 to March 20, 1931, incl., and ort motion of Commissioner Lehman, seconded by Commissioner Speer and unanimously carried, said port was accepted with the gratitude of the Commission for the splendid showing made. Commissioner Lehman then moved that the Commission meet with the officials of the`Sanf ord Country Club at S O'Clock P.M. March 30, 1931 for the purpose of considering what assistance the City will be able to give during the year beginning April lot. The matter of payment of bill of Haynes & Ratliff, amounting to $119.00, for 5000 advertising folders used by the Chamber of Commerce, was neat brought up for further con- sideration, and after considerable discussion, Commissioner Lehman moved that this bill be paid by the City. Seconded by Commissioner Byrd and carried by the following vote: Commissioner Dumas Aye " Leffler Nay " Lehman Aye " Speer Nay " Byrd Aye Application neat received from the General Outdoor Advertising Company to erect a signboard on the property of J.St. Clair White at the northwest corner of West First Street and Terwilliger Lane, and on motion duly adopted permit requested was ordered granted. Application next received from Mr. R.B.Middleton for permit to erect gasoline filling station at the south east corner of Eighth St. and Pine Ave. Commissioner Speer moved that the permit be granted provided this filling stati is erected entirely on private property. Seconded by Commissioner Byrd and carried. Ordinance No. 190 entitled: " AN ORDINANCE PRESCRIBING RATES TO BE CHARGED FOR WATER FURNISHED BY THE CITY OF SANFORD , FLORIDA." was neat presented for the second reading and fead in full by the Clerk. Thereupon the roll was called upon the final passage and adoption of said Ordinance No. 190, the vote being as follows: Commissioner Dumas Aye " Leffler Aye " Lehman Aye " Speer Aye " Byrd Aye Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote , had passed and adopted said Ordinance. Commissioner Byrd next moved that said Ordinance No. 190 be POSTED. Seconded by Commissioner Lehman and carried. Ordinance No. 191 entitled: " AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, REGULATING AIRCRAFT AND AIRMEN OPERATING OVER OR WITHIN THE JURISDICTION OF THE CITY OF SANFORD , FLORIDA, AND CREATING AN AVIATION BOARD OF THE CITY OF SANFORD, FLORIDA, AND PRESCRIBING TTS POWERS AND DUTIES AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE." was next presented.for the second reading and read in full by the Clerk. " Speer Aye " Byrd Aye 343 Thereupon the Chairman announced that the City Commission of the City of Sanford Florida , by unanimous vote, had passed and adopted said Ordinance No. 191, entitled: AN ORDINANCE OF THE CITY OF SANFORD FLORIDA, REGULATING AIRCRAFT AND AIRMEN OPERATING OVER OR WITHIN THE JURISDICTION OF THE CITY OF SANFORD, FLORIDA, AND CREATING AN AVIATION BOARD OF THE CITY OF SANFORD, FLORIDA, AND PRESCRIBING ITS POWERS AND DUTIES AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. Commissioner Lehman next moved that said Ordinance No. 191 be POSTED. Seconded by Commissioner Speer and carried. In compliance with the terms of Ordinance No. 191, the following by unanimous vote of the Commission were appointed to serve on the newly created Aviation Board V.A. Speer ( Commissioner ) Volie A.William s George Deetch. Commissioner Lehman next introduced Resolution No. 408 and moved its adoption. Seconded by Commissioner Speer and carried by the following vote: Commissioner Dumas Aye If Leffler Aye If Lehman Aye " Speer Aye " Byrd Aye said Resolution No. 408 being in words and figures as follows: RESOLUTION No. 40g WHEREAS, it has been made known to this Commission that a site is to be selected in the State of Florida by the U.S.Veteran's Bureau for the establishment of a Veteran's Hospil and/or Home, and WHEREAS, in the opinion of this Commission, the many advantages of the City of Sanford, Florida, located on the Southern shore of Lake Monroe, its salubrious and moderate climate, the fact that Sanford is located in South Central Florida, and is practically the center of population of the State of Florida, its geographical location at the head of naviga- tion on the St. John's River, its easy acoesibility from all points of the State of Florida, by water, rail and highway, should be important and controlling elements in the determination of the site to be selected by the U.S.Veteran's Bureau, and WHEREAS, this Commission desires to have said contemplated Veteran's Hospital and/ or home permanently located in the City of Sanford, Florida, therefore, BE IT RESOLVED, that this Commission, for and on behalf of the City of Sanford, Florida, and each and every of the inhabitants thereof, offers to gratuitously alienate and convey unto the United States of America, a good and indefeasible title in fee simple ( subject to certain outstanding delinquent State and County tax certificates aggregating not more than. al '344 MINUTES CITY COMMISSION, SANFORD, FLORIDA, - _ March 23, 7:30 P M. 1931 $15000.00 principal, interest and penalties, provided the City is unable to procure the cancellation of said delinquent certificates) in and to Block E, First Street Extension of Sanford, Florida, according to plat thereof duly of record, together with all the tenements, appurtenances and hereditements thereunto belonging, or in anywise appertaining, upon which property is now situated a modern three story building, containing one.hundred Seventy —six (176) rooms and two ( 2 ) out,-buildings detailed description of which, together with plans and specifications, maps, aerial views, other photographs and data this Com- mission has hereinafter authorised Geo.A.DeCottes, as the Special Representative of the City of Sanford, Florida, to submit to the U.S.Voterans' Bureau in connection with this offer, provided, the property, hereby offered to be so gratuitously conveyed, be used and occupied by the Government as and for a Veterns' Home and /or Hospital, and BE IT FURTHER RESOLVED, that Geo. A. DeOot tes, of Sanford, Florida, be, and he is,hereby appointed and designated as the Special Representative of the City of Sanford, Florida, to transmit this offer, and any and all information and data necessary to be submitted therewith, to the U.S.Veterans' Bureau, or to any accredited agent or representativ of said Bureau, and to furnish and supply such other and further data and information to said bureau, its agents and representatives, as may be thereafter requested and required, hereby conferring upon the said Geo. A.DeCottes, full and complete power and authority to represent the City of Sanford, Florida for the purposes aforesaid, and BE IT FURTHER RESOLVED, that this resolution shall take effect immediately upon passage and adoption. The Commission next instructed that the offer included in Resolution No. 408 should terminate as of May 1, 1931. Communication next read from Special Counsel DeCottes and Boggs presenting bill for $2000.00 as retainer for services rendered in defending action brought in-the Florida State Courts by the Chase National Bank and same was referred to City Attorney Wilson for report.as to whether the services referred to are included in the contract between the City and Messrs DeCottes and Boggs for the handling of the Chase National Bank Suit. On motion duly adopted, the Commission next agreed that the rate of interest to be required of the Sanford Atlantic National Bank on City deposits during the second quarter of 1931, shall be the same as was in effect during the first quarter of 1931. Martin was next brought before the Commission for final action, and after considerable i Is , e, 1 11 1 a . n 1 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA, March 23 at 7230 P M .19—al discussion and upon motion duly adopted, the Clerk was instructed to notify Mr. L.P.Hagan, the presenter of the petition that it had been duly considered at two meetings of the Commission, that the action taken in relieving Mr. Martin from the force was not due to any complaint against the services rendered but due to the necessity for the Commission to work to a reduced budget, and that we feel that the action taken was right and proper and regret exceedingly that we cannot accede to the wishes of the petitioners. ;345 The Commission next issued instructions directing the Chief of Police to notify Police Officer R.L.Bennedy that unless he takes up his residence within the City limits of Sanf ord by the first of April, that his resignation will be accepted and'the Chief is here- by authorized to appoint his successor. The Committee appointed to consider the request of the Sanford Gas Company to supply gas to Sanford from the Orlando plant and close down the plant here, next reported unfavorably upon this request, and the Clerk was instructed to notify the officials of the Gas Company to that effect . On motion of Commissioner Lehman, seconded by Commissioner Byrd and carried, bill of City Attorney Fred R.Wilson for $24.801covering miscellaneous expenses incurred on City business from January 29th to March 6th, was approved and payment ordered.
