Meeting called to order by the Chairman. E.C.Harper , representing the Independent Merchants Association, appeared with the request that the City purchase an electric control clock to be used in conjunction with the electric clock to be installed by this Association at the intersection of First Street and Park Avenue, at a cost of $65.00. Commissioner Byrd moved that the control clock requested be furnished by the City. Seconded by Commissioner Lehman and carried. Commissioner Lehman next offered Resolution No. 416 and moved its passage and adoption. Seconded by Commissioner Byrd and carried by the following vote.: Commissioner Dumas Aye n Leffler Aye Lehman Aye Speer Aye Byrd Aye said resolution No. 416 being in words and figures as follows:' RESOLUTION NO. 416 A RESOLUTION CANCELLING ALL SALES OF LANDS IN THE CITY OF SANFORD, FLORIDA, FOR NON - PAYMENT OF TAXES FOR THE YEARS 1927, 1925 and 1929 BASED UPON ASSESSMENTS FOR SUCH YEARS PRIOR TO THE RE- ASSESSLIENT OF SAID LANDS bN THE 1930 TAX ROLL, and TAX CERTIFICATES BASED UPON SUCH SALES, EXCEPT SUCH OF SAID LANDS AS HAVE BEEN REDEE IED FOR NONPAYMENT OF SUCH TAXES. WHEREAS, in that certain cause lately pending in the Supreme_ Court of the State of Florida wherein the State of Florida, ex rel DOFNOS CORPORATION, was Petitioner, and H.J.LEH4AN, F.L.MILLER, W.A . LEFFLER, R.A.NEWLAN, and V.A. SPEER, as and constituting the City Commission of the City of Sanford, Florida, H.J.LEH:-AN, as Mayor of said City, anf F.S. LAMSON, as City Clerk and Tax Assessor of said City and said City of Sanford, Florida, were Respondents, said decision being reported in Volume of Florida Supreme Court Reports and Volume 131, Page 333, of the Southern Reporter, the Supreme Court of the State of Florida, held the tax assessment rolls prepared by the City Tax Assessor of the City of Sanford, Florida, for the years 1927, 1925, and 1929, to be invalid and of no force and effect there - invalidating the tax sales for each of such years based on said assessments, and the lands an( premises in said city which had not prior to said decision by the supreme Court of the State of Florida, been redeemed.f rom said tax sales and Tax Certificates, having been re- assessed by the City Tax Assessor of the City of Sanford, Florida, for said years 1927, 1925 and 1929 on the tax assessment roll of said city for the year 1930: NOW THEREFORE, Be It Resolved by the City Commissioners of the City of Sanford, Florida, that the sales of lands for nonpayment of taxes due the city of Sanford, Florida, for the years 1927, 1929 and 1929 based on said separate prior assessments for each of said years, and Tax Certificates issued thereon, be and the same are hereby cancelled and declared to be null and void as to any and all lands included therein except such hands as have been redeemed from said tax sales; Provided, that this resolution shall not affect MINUTES CITY COMMISSION, SANFORD, FLORIDA, October 1 at 7:30 P M 19_1 the sale of any of such lands which were re— assessed as aforesaid. Byrd 31 V _.A.S eer As the City Commission of the City of Sanford, Florida. 407.111 On motion duly adopted the Clerk was next instructed to notify the Sanford Atlantic National Bank that the Commission is agreeable to being paid the same rate of interest on, City balances during the fourth quarter of 1931 as has prevailed during the third quarter of this year. The Budgetfor the fiscal year 1931;1932 was next submitted and tentatively adopted and the Clerk was instructed that with the beginning of the new fiscal year all expenditures applicable to the new fiscal year shall be made on the basis of the appropriations set forth in the budget this day tentatively adopted. Commissioner Speer next offered Resolution No. 418 and moved its passage and adoption. NOW THEREFORE, Be It Resolved by the City Commissioners of the City of Sanford, Florida, that said offer of the said Virginia - Carolina Chemical Corporation to trans- fer and convey to said City of Sanford, Florida, the portion of the lands and premises described in the first paragraph of this Resolution lying north of the north line of Ful Street if extended West across said lands and premises in consideration of the release and satisfaction of the lien of the said City for bulkhead and reclamation improvements against the portion of said lands and premises lying south of the north line of Fulton Street if extended as aforesaid be, and the same,is, hereby accepted and upon the delivery by said Virginia- Carolina Chemical Corporation to said City of Sanford, Florida, of a deed of bargain and sale conveying to said City of Sanford, said portion of the said lands and premises lying north of the north line of Fulton Street if extended as aforesaid subject to all state and county taxes against said portion of the said lands and premises lying north of the north line of Fulton Street if extended as aforesaid, for the year 1931, and the proportionate part of said special assessment on said lands lying north of the north line of Fulton Street if extended as aforesaid amounting to the principal sum of $12,779.13 and hereby fixed at said amount, and subject also to all city taxes against said portion of said lands and premises for the years 1930 and 1931, and also subject to all interest on said special assessment against said portion of said lands and premises, which said interest, State and County and City taxes and said por- tion of said special assessment, said City of Sanford, shall and does hereby assume and agree to pay, all as a part of the consideration for the conveyance to it of the said parcel of land north of the north line of Fulton Street if extended as aforesaid and n C' 1 1 1 I I" 1 I� MINUTES CITY COMMISSION, SANFORD, FLORIDA, October 1 at 7:30 P Pdi9__Jl the City Clerk is authorized and directed to issue to said Virginia — Carolina Chemical Corporation, a receipt for said portion of said special assessment against the portion of said lands and premises lying south of the north line of Fulton Street if extended as aforesaid releasing absolutely said parcel from any other or further lien or charge by reason of or arising out of said bulkhead and reclamation improvements. BE IT FURTHER RESOLVED that the proportionate par4 of the said special assessment for bulkhead and reclammation improvements against the portion of the lands and premises described in the first paragraph of this resolution lying south of the north line of Fulton Street if extended as aforesaid be and the same is hereby fixed at the principal sum of $1083.92 and the City Clerk is hereby authorized and instructed to cancel upon . the records of said City of Sanford said special assessment against said portion of said 409 lands and premises lying south of the north line of Fulton Street if extended as afore- said as part of the consideration to said Virginia— Carolina Chemical Corporation for the deed conveying the parcel north of the north line of Fulton Street if extended as aforesaid to said City of Sanford. Thereupon the question recurred upon the waivure of the rules, the vote being as follows: Commissioner Dumas Aye it Leffler Aye rr Lehman Aye " Speer Aye " Byrd Aye Thereupon said Ordinance No. 199 was placed upon its first reading and read by the I ; I Clerk by title only. r 410, MINUTES CITY COMMISSION, SANFORD, FLORIDA,_ _ October 1 at 7:30 19 -31 Report next presented by City Attorney Wilson confirming the assess&bility for tax purposes of property owned by the Independent Order of Odd Fellows but no used for lodge purposes, and certain property owned by the Presbyterian Church and rented by the church to private individuals, request having been heretofore made that these properties be exempted from City taxes. Thereupon Commissioner Lehman moved that the report be accepted and that the Independent Order of Odd Fellows and Presbyterian Church be notified. Seconded by Commissioner Byrd and carried. On motion duly adopted the Clerk was instructed to transfer as of September 30, 1931 a sufficient amount from the Contingent Fund to the Charity appropriation to make up deficit in the latter appropriation. On motion duly adopted, the Clerk was instructed to transfer as of September 30th. 1931, unencumbered balance in the Contingent Fund to the Contingent Litigation. and Refinan- cing Account. The Clerk next presented list of delinquent personal taxes for the year 1930 and same was ordered delivered to Deputy Tax Collector Tarbell for collection. The meeting then adjourned.
