November 23, 1931. Present: Commissioner T.L.Dumas, Mayor. " W.A. Special Counsel DeCottes, being present, next presented to the Commission the fol- lowing pretended certificates of indebtedness and unsold negotiable bonds with appurtenant coupons of the City of Sanford, Florida, returned to the City of Sanford by the Chase National Bank of the City of New York as a result of suit instituted and won by the City against said Chase National Bank for the recovery of said certificates and bonds: Certificate of indebtedness of the City of Sanford, Florida, payable to Seminole County Bank of Sanford, Florida , or order, dated November S, 1926, payable February S, 1927 for the sum of $300,000.00, upon which said certificate of indebtedness has been credited the sum of $1000000.00 Certificate of indebtedness of the City of Sanford, Florida, payable to Seminole County Bank of Sanford, Florida, or order, dated December 27, 1926, payable March 27, 19270 for the sum of $1000000.00 Certificate of indebtedness of the City of Sanford, Florida, payable to Seminole County Bank of Sanford, Florida, or order dated December 27, 1926, payable March 27, 1927 for the sum of $200,000.00 City of Sanford, Florida , 5j% improvement bonds, Series "LL ", dated July lots 1926, maturing July lets 1956, numbered from 101 to 150, both numbers inclusive, denomination $1000 each. Denomination 1000 each. and, WHEREAS, all of said certificates of indebtedness and negotiable bonds with appurte nant coupons were duly canceled by The Chase National Bank of the City of New York at the request of Geo. A.DeCottes, Special Counsel for the City of Sanford, Florida, acting under authority duly conferred; therefore BE IT RESOLVED, that all acts and things done and performed by the said Charles A Boston and Geo. A.DeCottes in procuring possession from and cancellation by The Chase National Bank of the City of New York for the City of Sanford, Florida, of the certificates of indebtedness and bonds with appurtenant coupons above described, be, and the same are, hereby fully ratified, approved and confirmed, and receipt from Charles A . Boston and Geo. A.DeCottes of all of said pretended certificates of indebtedness and bonds with appurtenant coupons is hereby acknowledged, and BE IT FURTHER RESOLVED, that this resolution shall become effective immediately from and after its passage and adoption. Mr. S.G4.Giray, president of the Sanford Rotary Blub, next presented request that thl certificates and bonds be burned at a celebration to be conducted under the auspices of this Club on January 5th next, and same was aggeed to by the Commissiom.. Request next received from Mr. Fred Zerrenner that the City officially abandon that portion of the West Side Bulkhead District lying west of Cloud Branch, same having been never completed. In view of the fact that the City Commission has heretofore decided to abondom this uncompleted portion of the West Side Bulkhead District as soon as deeds for right -of- way for State Road No. 3 across the property affected are obtained, and as all such deeds e 1 1 1 1 1 L 1 1 [7 I_] MINUTES CITY COMMISSION, SANFORD, FLORIDA. Nov ember 23 Ad 73 0 P W-31 have been obtained with the exception of deeds from Mr. Zerrender, which latter deeds will be given as soon as the action requested is taken, Commissioner Speer moved that the City Attorney be instructed to draw up the necessary resolution abandoning that part of the West side Bulkhead District lying West of Cloud Branch. Seconded by Commissioner Byrd and carried by the following vote: Commissioner Dumas Aye " Leffler Aye " Lehman Aye " Speer Aye a Byrd Aye 43.3:, Request next received from Mr. R . J. Reel and Mr. Ralph Wight, for permit to erect private hangar on the new municipal aviation field and same was referred to the Aviation;. Committee. The matter of contract between the City and Mr. E.J. Goerringer whereby in exchange for certain exclusive privileges at the new municipal aviation field, Mr Goerringer is to erect an airplane storage hangar on said field, was next presented to the Oommission� and on motion of Commissioner Lehman, seconded by Commissioner Leffler and carried, same was referred to the Aviation- Committee for recommmendation. On motion duly adopted, the Mayor was neat authorized to execute lease on-behalf of the City with the united State Department of Agriculture covering use of the City Greenhouse for experimental purposes from November 16th, 1931, to June 30, 1932. Minutes of regular meeting of November 9th and special meeting of November 12th, 1931, read and approved. Commissioner Leffler next moved that the City Clerk be instructed to transfer $500.00 from the Contingent Fund to the Aviation Field Appropriation for use in developing the new Municipal Aviation Field on Sou. Sanford Ave.. Seconded by Commissioner Lehman and unanimously carried. On motion duly adopted, authority was next granted for placing $1000.00 Fire Insur- ance on the office building at the new Municipal Aviation Field through J.H.Colclough, Agent. On motion of Commissioner Speer, seconded by Commissioner Leffler and unanimously carried, the Clerk was next instructed to renew the fire insurance on the Hotel Mayfair for the ensuing year at the same amount and with the same companies as during the past year. On motion of Commissioner Leffler, seconded by Commissioner Lehman and unanimously carried, bill of the Title Guaranty & Mortgage Co. amounting to $146.00, covering title searches in connection with the foreclosure of delinquent tax certificates, was approved. Communication next read from.the Independent Merchants Association, presenting to the City clock erected at the intersection of First Street and Park Avenue, and on motion of Commissioner Byrd, seconded by Commissioner Lehman and carried, the Clerk was instructed to extend to this organization the thanks of the City for this clock. On motion of Commissioner Speer , seconded by Commissioner Leffler, and carried, Mr. F.R.McNeil was given permit to erect revolving sign on the unused right -of- way for Park Avenue immediately south of the intersection of Geneva St. and State Road No. 3 Commissioner Speer moved that due to the delay in opening the 1931 Tax Roll, that a 2% discount be allowed on 1931 taxes when paid by December 15th, 1931 , and 1% discount when paid between December 16th, 1931 and January 15, 1932• Seconded by Commissioner Byrd and carried. Communication neat read from Special Counsel DeCottes inclosing bill for $246.75 covering expenses incurred in completion of suit of the City of Sanford versus the Chase 434,% MINUTES.' Communication next.read from Special Counsel DeOottes advising the City that the Court had entered a judgment for costs against the Chase National Bank in favor of the. City of Sanford in the sum of $3372.24, and that , acting under instructions received from the City Commission, this amount had been paid directly to Hornblower, Miller & Garrisons to apply on account for services rendered the City by this firm in the Chase National Bank suit. Thereupon Commissioner Lehman moved that the payment of the foregoing amount to Hornblower, Miller & Garrison, be approved and confirmed. Seconded by Commissioner Speer and unanimously carried. Commissioner Speer next.moved the payment of certain expense items aggregating $390. incurred by the Sanford Golf Club, Inc. in the operation of the Municipal golf Course, said amount to be charged to the Golf Course appropriation. adoption. Seconded by Commissioner Byrd and carried unanimously. Commissioner Lehman next introduced Resolution No. 424 and moved its passage and Seconded by Commissioner Speer and carried by the following vote: Commissioner Dumas Aye " Leffler Aye " Lehman Aye " Byrd Not voting. Said resolution No. 424 being in words and figures as follows: RESOLUTION No. 424 APPROVING A PROPOSED LETTER AGREEMENT WITH FLORIDA POWER & LIGHT COMPANY PROVIDING FOR THE TEMPORARY REDUCTION IN CANDLEPOWER OF CERTAIN " WHITE WAY " STREET LIGHTS AND THE PLACING IN OPERATION OF CERTAIN ADDITIONAL " WHITE WAY" STREET LIGHTS • AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERX OF AND ON BEHALF OF THE CITY TO EXECUTE AND ENTER INTO THE SAID LETTER AGREEMENT WITH FLORIDA POWER & LIGHT COMPANY. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA: 1. That the proposed letter agreement with Florida Power & Light Company hereinaft set forth in Section 2 hereof, is hereby approved in form= and substance. 2. That the Mayor and the City Clerk of and on behalf of the City are hereby authorized and directed to execute with Florida Power & Light Company a proposed letter agreement approved in Section 1 hereof, and hereinafter set forth as follows: " November 23, 1931. City of Sanford, Florida Sanford, Florida. Gentlemen: In accordance with your recent request, we hereby agree that in additiow_to street lights heretofore discontinued and,/or reduced as to candlepower under Agreements between us, we will as of December lot, 1931, temporarily reduce as to candlepower twenty -three (23) 250 oandlepower dusk to dawn M White Way " street lights from 250 candlepower to 100 candle - power and thereafter will operate them at the rate applicable to 100 candlepower dusk to dawn �1►hite Way " street lights as provided in Schedule 2 of the Street lighting agreement now in effect between us and dated the let day of October 1926. At your request, at any time and from time to time, we will restore to their origi oandlepower any or all of the streetlights reduced as to candlepower as hereinabove provid In addition to the foregoin , at your request, we will place in operation as of December let, 1931, thirty eight (361 additional 100 candlepower dusk to midnight " Write Way " street lights ( which are now out of operation ) and will bill you for the operation thereof in accordance with the Street Lighting Agreement now in effect between us and dated the lot. day of October 1926. It is understood and agreed that the said street lighting agreement and all agreements supplementary thereto or amendatory thereof now in effect between us shall remain In full force and effect, ex6ept as provided in this letter. ( Seal) Two requests neat received to operate Sandwich stands, one at Thirteenth St. and Laurel Ave. and other at Park and Commercial St., and same were referred to Chief of Police Williams and Sanitary Inspector Paxton. Communication neat read from W.H.Tunnicliffe, Liquidator of the Seminole County Bank advising that in accordance with terms of claim filed by the City against this bank covering deposit of $500,000 derived from certain unauthorized certificates of indebtedness held by the Chase National Bank of New York, the City's account is being charged with this amount, due to the aforesaid certificates of indebtedness having been recovered from the Chase National Bank.
