Present: Commissioner T.L.Dumas. Mayor. " W.A.Leffler " H J Lehman " V.A.Spear " 0. A. Byrd,. City Attorney, Fred R.Wilson City Clerk F.S.Lamson Chief of Police R.G.Williame Meeting called to order by the Chairman. Minutes of Regular Meeting of October 12. and adjourned meeting of October 19th. 1931 read and approved, 20! Request next received that sidewalk for use of school pupils at the Seminole High School be constructed on French Avenue between Fourteenth and Seventeenth Streets, and on motion of Commissioner Lehman, seconded by Commissioner Leffler and carried, same was referred to Superintendent Moughton for investigation and report at the next regular meeting. On motion duly adopted, permit was neat granted Paul Biggers for the erection of a galvanised Iron automobile repair shop on Lot 3 Buena Vista Estates. On motion of Commissioner Lehman, seconded by Commissioner Leffler, and carried, invoice of The Real& Press for $111.25 covering priwting of brief on behalf of the City in the Chase National Bank Suit was approved and ordered paid. Communication next read from T.C.Carlson objecting to placing of sign -board advertising Sanford adjacent to his property on West First Street and same was taken under consideration-. On motion duly adopted, Commissioner W.A.Leffler was next declared thb duly qualified oandid*te for the general municipal election to be held December dth. for the election of one City Commissioner, no other candidate having qualified, thus eliminating the necessity for the holding of the Primary Election on November 3rd. 1931. On motion duly adopted the following were appointed as Clerk and Inspectors of the General Municipal Election to be held on December dth. 1931. J.Bsck Clerk. R.R.Deas Inspector E.F.Lane Inspector W M Mckinnon Inspector. On motion duly adopted , the 1931 tax roll as equalised, was nest approved and accepted. Communication next read from the local Post of the American Legion concerning qualification of disabled war veterans applying for exempt occupational licenses, and ordered filed. The Clerk was then instructed to issue such exempt licenses as are required by law, On motion of Commissioner Lehman, seconded by Commissioner Leffler and carried, the purchase of one No. B. Mueller Water Tapping Machine, for the Water Department, at a price of $75.00 was authorised. The matter of the passage or rejection of the proposed new milk ordinance No. 199, was next considered, but on motion of Commissioner Lehman, seconded by Commissioner Speer and carried, action was deferred until the neat regular meeting at which time discussion of the matter by any one member of the Commission would be limited to five minutes. 4_ MINUTES. WHEREAS, the Clerk of the Circuit Court of Seminole County Florida, was heretofore ap- pointed as Deputy City Tax Collector and has been acting in such capacity for the collection of delinquent taxes due upon real estate assessed for taxes by the City of Sanford, Florida, and, WHEREAS, the City Commissioners of the City of Sanford, Florida, are of the opinion that such collections should be made by the City Tax Collector at the City Hall of said Oity, NOW THEREFORE, Be It Resolved by the City Commissioners of the City of Sanford, Florida, that the appointment of the Clerk of the Circuit Court of Seminole County, Florida, as deputy City Tax Collector of the City of Sanford, Florida, be and the same is hereby revoked. WHERZA09 the Legislature of the State of Florida enacted House Bill #410, which was ap [I 1 1 1 1 1 1 r I MINUTES CITY COMMISSION, SANFORD, FLORIDA, proved June 5, 1931, and is entitled: October 26 at 7:30PM19 ©' " AN ACT relating to the enforcement of taxes and/or Special Assessments and Interest and Penalties thereon imposed by any incorporated City or Town in the State of Florida; Providing a supplemental, additional, optional and laternative method of enforcing such tax liens and/or special assessments and interest and penalties thereon by suit in chancery in the nature of a proceeding in rem against the lands upon which such taxes and/or special assessments constitute liens; and prescribing the practice, pleading and procedure in such suits and authorizing the allowance of reasonable Attorney's fees therein." and WHEREAS by Section eight of said House Bill #410, any municipality desiring to proceed thereunder may elect to proceed thereunder by formal action of its governing authority and by proceeding as designated therein, and WHEREAS, in the judgment of the City Commission of the City of Sanford, Florida, it is lE :.rM proper, advisable and expedient for the City of Sanford, Florida, to proceed under said House Bill #410 for the enforcement of taxes and/or special assessments and interest and penalties thereon imposed by said City of Sanford, Florida: NOW THEREFORE , Be It Resolved by the City Commissioners of the City of Sanford, Florida, on behalf of said City of Sanford, Florida, a municipal corporation, that said Otty of Sanford Florida, has elected and does hereby elect to proceed under said House Bill #410, approved June 5, 1931, for the enforcement of taxes and/or special assessments and interest and penal- ties thereon~ imposed by said City of Sanford, Florida. On motion duly adopted, payment of $131.71 to John D.Jinkins, County Tax Collector, being the 1931 taxes against that certain property being deeded to the City by the Virginia - Carolina Chemical Company covered by Resolution No. 41 11, and the payment of $10.00 court costs each in three condemnation suits being brought for right -of -way for State Road No. 3 along the south shore of Lake Monroe, were approved. On motion of Commissioner Lehman, seconded by Commissioner Speer and unanimously carried, the Clerk was instructed to comply with terms of writ of Mandamus, case No. 27115 -T, obtained by C.T.Diehl, at al., calling for payment with net profits of the Water Department of unpaid water coupons included in Judgment No. 2511 -T, to the amount of 011197.50. City Attorney Wilson next presented copy of oontract to.be entered into between the City and Messrs Fred R.Wilson and L.F.Boyle, covering all City litigation and legal services with the exception of that being handled under contract by Special Counsel DeCottes and Boggs, and on motion of Commissioner Byrd, seconded by Commissioner Speer and unanimously carried, the Mayor and Clerk were authorized and instructed to execute same on behalf of the City of FIE • `.: MINUTES.
