The City Commission of the City of Sanford, Florida, met in Special called Session at the
City Hall.in Sanford, Florida, at 10:30 O'Clook A.M. November 26, 1930.
Present: Commissioner H.J.Lehman , Mayor.

Meeting called to order by the Chairman.
Communication from Special Counsel DeCottes advising the Commission of the necessity of
Messrs. DeCottes and Boggs proceeding to New York on December 4th. to confer with Counsel
in the case of the City of Sanford Versus the Chase National Bank of New York, and to
perfect the record on appeal, and requesting that expense money in amount of $600.00 be
advanced to over the costs of this trip.
Commissioner Speer moved that expense money to the amount of $600.00 be advanced to
Messrs. DeCottes and Boggs for the aforesaid trip to ltew York City, and that they be requests
to make the trip as economical as possible.
Seconded by Commissioner Miller and carried.
Commissioner Miller next tendered his resignation as a City Commissioner as follows:
M The time arrives-in the life of every one when they must necessarily make a decision±
and as I have now in mind whereby I cannot further represent the majority of the people of
Sanford due to my firm convictions in regard to the Mandate of the Supreme Court of the
State of Florida, and I cannot conscientiously vote to levy the millage as contemplated
necessary by this order, and my general makeup will 44t permit me to further remain a member
of this Commission without being in grave danger of being in contempt of Court of which I*
do not want to be, I therefore tender you my resignation as a member of the City Commission
to take effect immediately, and at the same time I wish to express to each member of the
Commission my appreciation for the courtesy that has been accorded me since I have been as-
sociated with you. It is true that at times there have been disagreements and arguments
which bordered on what might have appeared to have been a personal matter. However, I wish
to assure you that anything I might have said or any act I may have committed while a member
of this Commission was done only from a conscientious standpoint in which I had firm con-
victions. In leaving your Body I wish you all well in your future labors and trust that
whatever might be done by this Commission may be done for the best interest of the entire
people of Sanford and I again thank you all for favors and courtesies shown me and ask that
you take immediate action on this resignation. I thank you. N
Commissioner Lehman neat made the following statement:
" Many times we may have differed in opinions upon certain issues that pertained to the Cit
but, if you remember, when I went on the City Commission I said that I expected that there would
come many times that we would not agree upon certain issued but that would be no reason why we
should hold any grievances against one another or become enemies. I hold no grievances against
you and think that anything you did as a Commissioner was as you thought for,the best interes s
of the people. w

Oommissioner Speer noxt made the following statement:
" I wish to express regret over the receipt of Mr Miller's resignation and to express my
appreciation of having had the privilege of serving on the Commission with him, and also of
the diligent efforts on his part to care for the City's needs in the pursuit of his duties
as a City Commissioner. I have found him faithful and conscientious in the pursuit of his
duties and express again my regret at receiving his resignation. I do not suppose it would be
of any use to ask for him to reconsider and therefore I move that his resignation be accepted.N
The foregoing motion was seconded by Commissioner Newman who then made the following state-
ment:
0 I would like to state that it has been a pleasure for me to have served on the Commission
with Mr. Miller with whom I had the same pleasure of serving in 1910 on the City Council when
things were not as strained as at present, and I think he is one of the hardest workers and one
of the most conscientious workers we have on this Board, and I want to move that this Commissio
extend to Mr. Miller a rising vote of thanks for the service he has rendered since he has been
on this Commission.a
Thereupon the entire Board extended to Mr. Miller a rising vote of thanks.
City Attorney Wilson next expressed regret at Mr. Miller's resignation and stated that he
felt that Mr. Miller had shown a very keen insight into the conditions of the City and the
remedy for this condition and a great deal of common sense in his views of the problems
confronting the City.
The roll was then called upon the motion to accept the resignation of Mr. Miller , the
vote being as follows:

Mr. Leffler stated that in voting he wished to express his regrets at Mr Miller's resig-
nation because he considers him ( Mr Miller) a most valuable member of this Board.
The Chairman next stated that in view of the shortness of time before the expiration of
the term of office of Mr Miller and as the people had elected Mr. C.A•Byrd to take Mr Miller's
place in January , 1931, it would be well to appoint Mr. Byrd to fill the balanoe of the term
office of Mr. Miller.
Commissioner Speer then asked that no appointment be made to fill Mr. Miller's unexpired t
of office until January , 1931.
Commissioner Lehman then made the following statement which he wished ;.made a matter of re-
cord:
" I think this is an injustice to the citizens of Sanford. Absolutely ignoring their de-
sires. As we are now constituted, we have a divided Commission and it is illegal or unjust and
inasmuch as the Citizens have elected Mr. Byrd to succeed Mr Miller, I think that it is proper
that the Commission recognize the wishes of the people of Sanford and that Mr Byrd be appointed
at once . N
After a further discussion of this matter, Commissioner Leffler moved that Mr. C.A.Byrd be
appointed to fill the unexpired term of Mr. Miller, at once.
Commissioner Lehman then surrendered the Chair to Commissioner Speer and seconded Commissi
Lef fler ' s motion.
The roll was then called upon this motion, which failed to carry, the vote being as follows:
