0312361 1 1 1 N MINUTES CITY COMMISSION, SANFORD, FLORIDA, March 12 at 7: 30 P M -19-3-6 The City Commission of the City of Sanford, Florida, met in adjourned regular session at the City Hall in the City of Sanford, Florida, at 7:30 O'Clock P.Y. March 12, 1936. Present: Commissioner S.O.Shinsholser , Acting Mayor. of W.R.Dupree " W.A.Leffler " P.N.Whitehurst City Attorney Fred R. Wilson City Clerk F.S.Lamson: Chief of Police R.G.Williams Meeting called to order by the Acting Chairman. The first matter of business being the election of a Mayor to serve the balance of the term of Mayor T.L.Dumas, deceased, Commissioner Whitehurst moved that Commissioner Shinholser be appointed temporary Chairman. Seconded by Commissioner Dupree and carried. Commissioner Leffler then mominated Commissioner Shinholser as Mayor of the City of Sanford, Florida, for the period ending the first Tuesday after the First Monday in January , 1937• Seconded by Commissioner Whitehurst. There being no further nominations and upon the question being put, Commissioner Shinholser was unanimously elected as Mayor of the City of Sanford, Florida., for the period ending the first Tuesday after the first Monday in January , 1937. Minutes of regular meeting of February 24th, adjourned session of February 27th, and regular meeting of March 9th, 1936, next read and approved. Current invoices and payrolls for the month of February , 1936, properly audited end vouchered as evidenced by vouchers Nos. 7641 thru 7703, submitted, examined, approved and payment ordered. Monthly reports of the streets, sanitation, health, water, police, fire and library departments for the month of February, 1936, submitted and examined. Financial statement and statement of revenues and expenditures during the month of February , 1936, submitted and examined. Bank statements in all accounts, properly reconciled, submitted and examined. Commissioner Leffler next introduced Resolution No. 484 and moved its passage and adoption. Seconded by Commissioner Whitehurst and carried by the following vote of the Commi.as i on : Commissioner Shinholser Aye " Dupree Aye " Leffler Aye " Whitehurst Aye said resolution No. 484 being in words and figures as follows: RESOLUTION NO 484. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA CALLING AND PROVIDING FOR THE HOLDING OF A SPECIAL ELECTION IN THE CITY OF SANFORD, FLORIDA, TO FILL THE VACANCY IN THE OFFICE Off' CITY COMMISSIONER OF SAID CITY CAUSED BY THE DEATH OF THE HONORABLE T.L. DUMAS, CITY COMMISSIONER. WHEREAS, A vacancy has occurred in the office of City Commissioner 491 492 MINUTES CITY COMMISSION, SANFORD, FLORIDA, March 12 at 7: 30 P MI g 36 of the City of Sanford, Florida, by reason of the death of Honorable T.L.Dumas, City Commissioner of said City, and there will be more than sixty days between the happening of such vacancy and a general election in said City, and it becomes necessary to hold a special election to fill said vaoancy in the office of City Commissioner: NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that a special election be and the same is hereby called to be held on the 14th day of April , 1936, to fill the vacancy in the office of City Commissioner of said City caused by the death of the Honorable T.L.Dumas, City Commissioner. BE IT FURTHER RESOLVED That the Mayor of the City of Sanford, Florida, shall issue his proclamation giving notice of such special elections, the date and purpose thereof and place where the same will be held, and the time of opening and closing of the polls, and stating therein the names of the inspectors and clerk who are designated in this resolution for such election. BE IT FURTHER RESOLVED That the notice of election provided for in the next preceding paragraph shall be published once a week for four consecutive weeks in a newspaper published in the City of Sanford, Florida, and prodf of publication there- of filed with the City Clerk. BE IT FURTHER RESOLVED, that E.F.Lane, W.E.Watson, and J.Beck, who are three intelligent, discreet and fair - minded citizens and residents and registered voters of the City of Sanford, Florida, are hereby appointed as Inspectors, and W.M. McKinnon, who is a resident and registered voter of the City of Sanford, Florida, is hereby appointed as Clerk of said special election. BE IT FURTHER RESOLVED, that the aforesaid special election shall be held in the City Commissioners' room in the City Hall of the City of Sanford, Florida, and the polls shall be opened at seven- thirty A.M. Eastern Standard Time, and shall close at sundown on said date. BE IT FURTHER RESOLVED That the City Clerk of the City of Sanford, Florida, shall open the registration books of said City, as provided by the charter of said, City, , and shall prepare ballots for the holding of said election in accordance with Ordinance No. 212 of said City, and do all things necessary and required in and about the holding of said special election and as required in and by Ordinance No. 212 of said City. O Shinholser W.A.Leffler P.N.Whitehurst W.R.Dupree As the City Commission of the City of Sanford, Florida. f, .J 1 [1 1 1 1 1 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA, March 12, at 7 :30 P M -19-16 Commissioner Whitehurst next moved that a resolution of sorrow over the death of former Mayor T.L.Dumas be prepared and spread on the minutes of the City Commission. Seconded by Commissioner Dupree and unanimously carried. Thereupon the Chairman appointed Commissioners Leffler and Whitehurst and City Clerk Lamson to prepare such resolution. L.F.Boyle, Commander of the Local Post of the American Legion, next appeared in behalf of the beautification program being conducted around the American Legion But, requesting that the City allow the use of sufficient water for this purpose and assuring that none would be wasted. Thereupon Commissioner Whitehurst moved that water be donated for this purpose until the first of September with the understanding that Mr. Boyle see that none is wasted, reserving the right, however, to withdraw the authorization in case the program is not carried out. Seconded by Commissioner Dupree and carried. At the request of Mr. Forrest Gatchell and on motion of Commissioner Leffler, seconded by Commissioner Whitehurst and carried, the Commission next authorized the refunding to 8leanthis Area of $12.50 representing the amount received for licenses as a merchant and to sell beer at the S.W.corner of Fourth St. and Sanford Ave., it appearing that through no fault of his own, Mr. Area had not and would not be able to operate a place of business at this location. Application next received from C.B. Brown for permit to sell beer and wines at 329 Sanford Avenue, and on recommendation of the Chief of Police, same was approved. Consideration next given to the regulation of sound trucks within the City limits, action being deferred pending further study. At the request of the local WPA officials, the Commission next approved furnish- ing water to the negro nursery under the same conditions as furnished to the white nursery. Communication next read from the Extension Division of the University of Florida, calling attention to the Fifth - University of Florida Short Course on Water Treatment to be held at Tampa in conjunction with the Tenth Annual Meeting of the Florida section of the American Water Works Associationx on March 31st, April lot and 2nd. 1936. Thereupon, upon motion duly carried, Water Department Engineer Abrahams was authorized to attend this course at the expense of the City. The Clerk next presented application for a WPA Project to complete the laying of sewer pipe remaining out of the ground when the funds allocated under the present project are exhausted, and on.motion of Commissioner Whitehurst, seconded by Commissioner Dupree and carried,teme was approved and the Mayor and Clerk authorized to execute on behalf of the City. Consideration next given to the project covering the relaying of the brick pavement on First Street, it appearing that in preparing this project allowance was made for the construction of a concrete gutter only as far as Myrtle Avenue 4,3 I 49 MINUTES CITY COMMISSION, SANFORD, FLORIDA, March 12, at 7:30 19 36 due to the possibility of the need for widening First Street Test from Myrtle Avenue at some future date. At this time figures prepared by Project Engineer Marl were presented showing two cars of cement necessary to complete this gutter from Myrtle Avenue, to the end of the project, one oar to French Avenue and one canto Mill Creek. Also, that the value of the brick to be salvaged as the result of the oonstruotion of the concrete gutter would be far in excess of the cost of the cement. Thereupon, in view of the little likelihood of the need for widening First Street for a long time to come, and the much improved condition of the street by the use of 'ooncrete gutters, Commissioner Whitehurst moved that concrete gutters be constructed on First Street from Myrtle Ave. to French Avenue, and that the city furnish one car of cement for this purpose. Seconded by Commissioner Leffler and carried. On motion of Commissioner Leffler, seconded by Commissioner Whitehurst and carried, the Commission next approved action authorized by former Mayor Dumas in the following Municipal Court cases: Case No. 21988 Daisy Walstine, sentenced to $10.00 or thirty days. Paid $5.00 and released. Balance suspended. Case No. 21999 Rosa Davis, Sentenced to $10.00 or Thirty Days. Paid $5.00 and released. Balance suspended. Casts No. 21987 , Ernice Sourry, sentenced to $10.00 or Thirty Days. Paid $5.00 and released. Consideration next given to the clean -up campaign being conducted under the supervision of Inspector A.R.Marshall. Thereupon on motion duly carried, Mr Marshall was ordered carried on the payroll during the last half of March in order to continue this work. Consideration next given to the request of Fire Chief Cleveland for an increase in salary, and on motion duly carried an increase of $15.00 per month was authorized, effective as of March lat. 1936, the additional amount to be charged to the Water Department covering supervision of the artesian wells and pumping equipment constituting the emergency water supply. There being no further business the meeting adjourned to immediately re- convene as a Municipal Delinquent Tax Adjustment Board . Thereupon, further consideration was given to the proper method to pursue in handling the various applications for tax adjustment, after which the meeting adjourned to meet again at 7:30 010look P.M.
