042235MINUTES CITY COMMISSION, SANFORD, FLORIDA, ril 22 8 P M 19 35 The City Commission of the City of Sanford, Florida, met in Regular Session at the City Hall in the City of Sanford, Florida at 8 O'Clock P.M. 1935 Present: Commissioner T.L.Dumas Mayor if W.A. Leffler If H.J.Lehman If V.A. Speer City Attorney Fred R Wilson City Clerk. F.S.Lamson_ Chief of Police R. G. .Williams Absent: Commissioner S.O.Shinholser. Meeting called to order by the Chairman. Minutes of regular meeting of April 8th , 1935 read and approved. April 22, Consideration was next given to the application of Harry Bradham for license to sell intoxicating liquors, Police Chief Williams reporting that his place of business appeared to be conforming to all requirements of the City Ordinar�cw with the exception of a door leading to a storeroom in the rear . Commissioner Lehman moved that the matter be delayed pending action by the Legislature. No Second. Commissioner Speer moved that the applicant be notified that his license has been withheld pending complete compliance with the City Ordinance. No Second. Commissioner Leffler moved that the license be granted. Seconded by Commissioner Lehman but failed, the vote standing as follows: Commissioner Dumas Nay " Leffler Aye " Lehman. Aye " Speer Nay Mr. C.R.Dawson, Seminole County Agricultural Agent, next presented a request that a portion of the City owned property described as lots 2,4 and 8 of Block X, St.Gertrude Addition be set aside for experimental purposes, it being the intention to apply for funds from the Public *corks Administration with which to construct a greenhouse. Request refused. Commissioner Lehman then moved that a Committee composed of Mr. Dawson, Supt. Moughton and City Clerk Lamson be appointed to ascertain what other City property, suitable for this purpose might be available. 'io second. Application next received from r.F.Graves for license to sell intoxicating liquor in the City of Sanford. Commissioner Leffler moved that the matter be taken under advisement until the next meeting, pending the necessary investigation. Seconded by Commissioner Lehman and carried. A petition sponsored by the Civic Department of the Sanford 'Woman's Club next presented urging that heavy truck traffic be diverted from Park Avenue, south of Third St. to Sanford and French Avenues. Commissioner Lehman moved that the matter be taken under consideration for thirty days and that the Chair appoint a committee to make a thorough investigation and report at that time. Seconded by Commissioner Speer and carried. MINUTES CITY COMMISSION, SANFORD, FLORIDA, A ril 22 at 8 P M 19 35 Thereupon the Chair appointed Commissioners Leffler, Lehman and Speer as a committee of three to investigate this matter. Application next received from E.A.Londonberg to renew lease on Lot s 2, 4 and 8 of Block X, St.Gertrude Addition , for the year commencing July 1st, 1935, the consideration to be two City of Sanford bords. Action deferred. The Clerk next reported having sent copy of chemical analysis made of the municipal water supply by the Southern Analytical Laboratory of Jacksonville, to Dr. A.P.Bla.ck, Professor of Chemistry at the University of Florida., with a request that he dive his recommendations as to the best method for improving this water. Communication then read from Dr. Black discussing the chemical analysis furnished him and advising that in order to render a defninte opinion, it will be necessary to make certain tests at the source of supply. Thereupon Commissioner Speer moved that Dr. Black be requested to come to Sanford to make the necessary tests and investigation. Seconded by Commissioner Leffler and carried. The Commission was next advised of the issuance of a writ of mandamus calling for the payment from net profits of the water department, of past due water bond coupons held by the Bondholders Protective Committee, totalling $9,900.00 In view of the fact that all net profits of the water department have been appropriated to the payment of water bond interest coupons, Commissioner Lehman moved that the terms of the writ be complied with. Seconded by Commissioner Lehman and carried. The Clerk next reported the issuance of licenses to sell beer to Robert Burns, 412 Sanford Ave. ; Nick Constantine at 421 E. 9th St. and Sam Kenis at 1515 Celery Avenue, and on motion of commissioner Speer, seconded by commissioner Leffler and carried, same were approved. Consideration was next given to the request of Mrs Rhoda Ewing for permit to move house from Lot 6 Long's Addition to Lot 2 Block 14 Tier 4, but due to the condition of the house to be moved, and on motion of Commissioner Leffler, seconded by Commissioner Speer and carried,same was refused. In accordance with instructions that all applications for permit to wreck or remove buildings from property where there are City taxes outstanding and unpaid, must be submitted to the City Commission, the Clerk next submitted request received from Mr. J.D.Davidson for permit to wreck two houses located on Lot 13 Block 4 Tier 2. In view of the fact that these houses are fire hazards, Commissioner Speer moved that the permit be granted. Seconded by Commissioner Lehman and carried: Request next received from W L Cooper for permit to remove four houses in ��1 MINUTES CITY COMMISSION, SANFORD, FLORIDA, April 22 at S P M. 19 35 in Gardenia Subdivision and on motion of Commissioner Speer, seconded by Commissioner Leffler and carried, action held up pending investigation. Request next received from the Southern Bell Telephone Company for permission. to remove scrub palmetto located in the parkway at the north -east corner of Sanford Ave and Twenty -fifth St., due to interference with telephone service. Permission -ranted. Commissioner Speer next introduced resolution No. 472 commending our representa- tives and seantor °.at Tallahassee together with Representative J .D.Bruton Jr. for their cooperation and assistance in passing House Bill No. 42 and Senate Bill No. 125, and also for the valuable assistance rendered by the Florida League of Municipalities. Seconded by Commissioner Lehman and carried by the following vote: Commissioner Dumas Aye If Leffler Aye If Lehman Aye If Speer Aye Said resolution being in words and figures as follows: RESOLUTIO1 NO. 472 A RESOLUTION BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, EXPRESSING APPRECIATION TO HONORABLES J.J. PARRISH, E. E. BRADY, 0. P. HERND.ON AND J. D. BRUTON , JR. , FOR THEIR ASSISTANCE TO AND 00-OPERATION -TITH THE FLORIDA LEAGUE OF MUNICIPALITIES IN THE PASSAGE BY THE LEGISLATURE, OF THE STATE OF FLORIDA OF AN ACT FORBIDDING THE SALE OF PROPERTY OF MUNICIPALITIES UNDER EXECUTION ON JUDGMENTS AGAINST THEM. WHEREAS, The Legislature of the State of Florida has just passed House Bill No. 42 and Senate Bill No. 125, said bills being identical and providing that judgments against municipalities shall not be liens upon their property and that writs of execution shall not be issued upon such judgments and said property shall not be sold thereunder; and, WHEREAS, HONORABLE J.J.PARRISH,Senator from the Nineteenth District, and HONORABLE E.E.BRADY AND O.P.HERNDON, Representatives from Seminole County, and HONORABLE J.D. BRUT ON .JR., Representative from Hillsborough County, lent their wholehearted co- operation and assistanee`.in the passage of said bill; and said bill has been approved by HONORABLE DAVE SHOLTZ, Governor of the State of Florida; and, 'WHEREAS, In the opinion of the City Commissioners of the City of Sanford, Florida, said law will redound to the benefit of the City of Sanford and all other municipalities in the State of Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSIONERS OF THE CITY OF SANFORD, FLORIDA, in regular meeting assembled, that a vote of thanks be tendered to HONORABLES J.J. PARRISH' , E.E. BRADY, 0. P.HERNDON and J. J. BRUTON , JR. for their valuable assistance and cooperation in the passage of the law referred to in the preamble hereof, and to the FLORIDA LEAGUE OF MUNICIPALITIES for the preparation and advocacy thereof.
