City of Sanford, Florida, met in regular session at the City Hall in Sanford, Florida, at 7:30 O'clock P.M. January 28, 1935• P resent: Commissioner T.L.Dumas, Mayor. " W.A. Leffler " H.J. Lehman " S. 0. Shinholser " V.A.Speer City Attorney Fred R.Wilson City Clerk F. S. Lamson. Chief of Police R.G.Williams Meeting called to order by the chairman. Minutes of regular meeting of January 14th, and adjourned meeting of January 18th, 1935 read and approved. Minutes of adjourned meeting of January 22nd, read, corrected and approved. The question next arose as to the legality of the procedure followed at the meeting of January 22nd, 1935, intending to adopt Ordinance No. 237 due to its not having been properly introduced. Thereupon Commissioner Leffler introduced Ordinance No. 237 entitled: AN ORDINANCE TO REGULATE THE SALE OR FURNISHING OF INTOXICATING LIQUORS IN THE CITY OF SANFORD, FLORIDA, REQUIRING A PERMIT TO BE OBTAINED FROM THE CITY COMMISSIONERS AND THE PAYMENT OF AN ANNUAL LICENSE TAX TO EN- GAGE IN THE BUSINESS OF SELLING INTOXICATING LIQUORS; PRESCRIBING THE AMOUNT OF SUCH LICENSE TAX AND THE LICENSE YEAR THEREFOR; PROVIDING A PENALTY FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. and same was read in full by the Clerk. Thereupon Commissioner Lehman moved that the rules be waived and that said Ordinance No. 237 be placed upon its final passage and adoption. Seconded by Commissioner Speer. Request refused... G.W.Spencer next appeared with further reference to request of the Seminole County Home Demonstration and Agricultural Fair Association Inc.for: permit for the Krause Better Shows to make Sanford as a part of the Fair to be held on February 12th, to 16th., but on motion of Commissioner Lehman, seconded by Commissioner Speer and carried, action was deferred for further consideration. Commissioner Lehman next introduced Resolation_No. 465 and moved its passage and adoption. Seconded by Commissioner Speer endcarried by the following vote of the Commission. A RESOLUTION RELATING TO THE PROPOSED TRANSFER OF CERTAIN PROPERTY BELONGING TO THE CITY OF SANFORD, FLORIDA, to SEMINOLE COUNTY, FLORIDA, FOR HOSPITAL PURPOSES. WHEREAS, the City of Sanford, Florida, is the owner of the following described lots, pieces or parcels of land situate in the City of Sanford, Florida, to -wit: and Lots 1,2 and 3 of Block 7 of Tier 5 of the CITY OF SANFORD, FLORIDA, according to E.R.Trafford's Map thereof duly of record in the public records of Seminole County, Florida. Whereas, there is located upon the above described lands and premises a building which, together with the equipment therein has been and is now operated by the City of Sanford, Florida, as a hospital, known as Fernald - Laughton Memorial Hospital; and Whereas Seminole County, Florida, has heretofore made contributions to the maintenance of said Fernald Laughton Memorial Hospital and desires to expand and improve said hospital through the Public Works Administration, or to have erected in the City of Sanford, Florida, a new hospital at some other location than the lands and premises above described: NOW THEREFORE, BE IT RESOLVED by the City Commissioners of the City of Sanford, Florida, that the City of Sanford hereby expresses a willingness to convey the above described lands and premises ( except the home thereon now used as a. nurses' home) to Seminole County , Florida, together with the equipment in the hospital building loacted on said lands and premises, subject to the terms and conditions upon which title to said lands and premises are now held by the City of Sanford, Florida, and the continued maintenance thereof as the Fernald- Laughton.Memorial Hospital, or to convey to Seminole County, Florida, such other property as may be owned by the City of Sanford, of such quantity as may be agreed upon and suitable for the purpose of erecting a hospital thereon; said deed to be made on the condition that no tax levies in addition to those now made by the County shall be made for the operation of said hospital, and to contain proper reverter clause for breach of conditions; PROVIDED, HOr'4'EVER, and this resolution is adopted upon the condition that the im- provement of the first above described lands and premises by the expansion of the hospital facilities thereon or the erection of a new hospital upon other lands end premises that 77 358 MINUTES CITY COMMISSION, SANFORD, FLORIDA, January 28 at 7: 30 P M 19 5 may be conveyed to Seminole County, Florida, by the City of Sanford, Florida, shall be made a first and prior objective in the expenditure of Public Works Administration funds in Seminole County, Florida. In connection with the anticipated release of Federal Funds for PWA projects in Florida, and more particularly in Sanford, the following two projects were selected as being of primary importance, additional ones to be designated after conference with the City Planning Board: No. 1 Completion of the CWA projects for replacing and relaying the old and worn out sewer lines, the original project for this work having been only about one-half completed. No. 2. Relaying the brick pavement on First Street, from Sanford Ave. to Oak Ave. and relaying and widening the pavement on Park Ave. from First Street to Tenth Street. In connection with these projects, Commissioner Speer was next designated to follow up the Sewer project and Commissioner Lehman to follow up the Street paving project. Ordinance No. 236 entitled: AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON WITHIN THE CORPORATE LIMITS OF THE CITY OF SANFORD FLORIDA, TO BECOME DRUNK OR BE DRUNK OR INTOXICATED BY THE VOLUNTARY USE OF INTOXICATING LIQUORS OR BEVERAGES, AND ALLOWING THE ARRESTING OFFICER TO SEIZE AND HOLD AS EVIDENCE AND FOR DISPOSITION UNDER THE DIRECTION OF THE MUNICIPAL COURT ANY INTOXICATING LIQUORS OR BEVERAGES FOUND UPON ANY PERSON ARRESTED FOR VIOLATING THIS ORDINANCE AND PRESCRIBING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE, AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ANY ORDINANCE IN CONFLICT HEREWITH. introduced and placed on its first reading at the meeting of January 3rd. 1935, was next placed on its second reading and read in full by the Clerk. 236: 7 Thereupon Commissioner Lehman moved the passage and adoption of said Ordinance No. Seconded by Commissioner Speer., The roll was called and the vote stands as follows: Commissioner Dumas Aye " Leffler Aye " Lehman Aye " Shinholser Aye " Speer Aye Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by uanimous vote, had passed and adopted said Ordinance No. 236 entitled: AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON WITHIN THE CORPORATE LIMITS OF THE CITY OF SANFORD, FLORIDA, TO BECCME DRUNK OR BE DRUNK OR INTOXICATED BY THE VOLUNTARY USE OF INTOXICATING LIQUORS OR BEVERAGES, AND ALLOWING THE ARRESTING OFFICER TO SEIZE AND HOLD AS EVIDENCE AND FOR DISPOSITION UNDER THE DIRECTION OF THE MUNICIPAL COURT ANY INTOXICATING LIQUORS OR BEVERAGES FOUND UPON ANY PERSON ARRESTED FOR VIOLATING THIS ORDINANCE AND PRESCRIBING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE, AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ANY ORDINANCE IN CONFLICT HEREWITH. On motion of Commissioner Lehman, Seconded by Commissioner Shinholser and carried, 35-9 payment of $340.00 to apply on judgment of DeCottes and Boggs was next ordered made from. -funds applicable therefor. Report for the year ending December 1934, next read from the Committee in charge of the Municipal Athletic Field as follows: January 18th, 1935 Hon. Ab a means of regulating and preserving the condition of the clay tennis courts adjacent to the water pumping station at Thirteenth Street and French Ave., the Commission next authorized the complete inclosing of these courts with a wire fence.
