122335472 2 MINUTES CITY COMMISSION, SANFORD, FLORIDA, December 23, 7:30 P M 19-35- The City Commission of the City of Sanford, Florida, met in Regular Session at the City Hall in the City of Sanford, Florida, at 7:30 O'Clock P.M. December 23, 1935• Present: Commissioner T.L.Dumas, Mayor. If W.A. Leffler If H.J.Lehman if S. 0. Shinholser. City Attorney Fred R.Wilson City Clerk F.S.Lamson Chief of Police R.G.Williams Absent: Commissioner V.A.Speer. Meeting called to order by the Chairman. Minutes of Regular meeting of December 9th, 1935 read and approved. Mr. George Barker of the Barker Poster Advertising Co. next applied for blanket permit to install not over five signboards to be constructed in accordance with the Signboard Ordinance, the boards to be installed only in the commercial or business district, the exact locations being as yet undetermined. Commissioner Shinholser moved that action be deferred until the next meeting, the Mayor in the menatime to be authorized to handle for any specific locations which may be decided upon. Seconded by Commissioner Lehman and carried. W.H.Schmidt next reported on the success of the additional street lighting authorized by the Commission under date of December 9th, advising that due to labor being furnished by the Florida Power & Light Co. end the Sanford Electric Contracting Co.,'as well as that furnished by the City, the cost had been kept down to approximately $115.00 Thereupon Commissioner Lehman moved that Mr. Schmidt be thanked for his good work, as well as the Florida Power & Light Co. and the Sanford Electric Contracting Co. for the labor donated. Seconded by Commissioner Shinholser and carried. The Clerk next reported that the Standard Accident Insurance Company had agreed to re write Employees Compensation Insurance from December 15th, 1935, the date of cancellation of the poliety previously issued and canceled, provided that that company is given the public liability and property damage insurance on the City's automotive equipment; also that the Continental Casualty Co. with whom.:the automobile insurance was carried, had agreed to cancel this policy on a pro -rata basis. Thereupon, upon motion duly carried, the cancellation of the public liability and property damage policy with the Continental Casualty Co and the placing of this insurance , together with the Employees Compensation insurance, with the Standard Accident Insurance Co was authorized and approved. City Attorney Wilson next reported that as a result of the hearing conducted by the Chairman of the Florida Industrial Commission into the death of Willis Dixon, City employee, a ruling had been handed down that the family of the deceased is entitled to compensation in accordance with the terms of the Florida Workmen's Compensation Law. 1 1 1 1 1 1 �J 1 1 MINUTES CITY COMMISSION, SANFORD, FLORIDA, December 23, at 7:30 P MI 9 35 Request next received from the Seminole County welfare Board for the usual appropriation for welfare work during the month of December, 1935, and on motion of Commissioner Lehman, seconded by Commissioner Shinholser and carried $50.00 was ordered paid to the Seminole County Welfare Board for this purpose. Communication next read from H M Papworth, Chairman of the Advisory Committee of the Sanford State Farmers' Wholesale Market, requesting that although Mr. Lehman's terms as City Commissioner expires on -January 7th, 1936, he be retained as the City's representative on this Advisory Committee during the balance of the fiscal year ending November 1, 1936. Request granted and Mr. Papworth ordered notified to that effect. Bids next presented for furnishing two batteries for use on the Fire trucks, as follows: Seminole Tire Shop: Two (2) 17 plate batteries at P5.65 each. three year guarantee. Two (2) 15 plate batteries at $22.75 each three year guarantee. Hof -Mac Battery Co. Two 2) 21 plate batteries at $21.50 each. Two 2) 19 plate batteries at $16.50 each. Two 2) 17 plate batteries at $1+.50 each. two year guarantee on above. Rockey's Tire Shop: Two (2) 19 plate batteries at $20.45 each. Maffett Auto Services Two 2) 21 plate batteries at $20.65 each. Two N2 19 plate batteries at $15.95 each. Two (2� 17 plate batteries at $16.50 each. After examination of the prices submitted and upon recommendation of Fire Chief Clevelan, based upon the length of guarantee as well as a careful check into the ability of the various batteries to do the work required, bid of the Seminole Tire Shop to furnish two (2) 17 plate batteries at $25.65 each, accepted. In connection with the request of L.B. and Edna M. Burdett that the alley running east and west across block 12 tier 6 be opened to the public , opinion next read from City Attoney Wilson that the City has no right to allow the private use of a street, avenue or alley, except for temporary purposes, such as the erection of a building on abutting property, and that an abutting property owner can mandamus the City to remove the obstructions. Thereupon Commissioner Lehman moved that the alley be cleared for use. No second, action being deferred pending further investigation. On motion duly carried, and on recommendation of the Municipal Judge and Chief of Police, the following sentences levied on prisoners in the Municipal Court were ordered suspended: 0 B.Senn, sentenced $10.00 or 30 days for drunkenness, served 10 days and released on payment of $5.00. Amount suspended $5.00 D.A.Pittmen, sentenced $200.00 or 60 days, for driving car while drunk. Served part time and released on payment of $75.00, amount suspended $125.00 Consideration next given to the matter of releasing City prisoners on Christmas Eve. Thereupon Commissioner Leffler moved that the Mayor be granted authority to release any prisoners that he might think entitled to some consideration. Seconded by Commissioner Lehman and carried. On motion duly carried, the Commission next ordered that due to the lateness in the completion of the 1935 tax roll, one percent discount be allowed on 1935 taxes paid during the month of January , 1936. In compliance with request made under date of Set ember 23rd., Commissioner Leffler next moved that the City contribute $100.00 to the Central and South Florida Water Conservation Committee, for expenses in connection with the effort to obtain a comprehensive survey of the effect the construction of the cross state sea level canal will have upon the underground water supply. Seconded by Commissioner Shinholser and carried. The Clerk next presented comparative statements prepared by Pentland, Gray and Moore, City Auditors, showing the total debt, revenues and expenditures for each year from Sept. 30, 1927 to Sept 30, 1935.
