021234209 MINUTES CITY COMMISSION, SANFORD, FLORIDA, February 12 at 7 :30 P M 1:9 34 The City Commission of the City of Sanford, Florida, met in Regular Session at the City Hall in Sanford, Florida , at 7:30 O'Clock P.M. February 12, 1934. Present: Commissioner W.A.Leffler " T.L.Dumas " H.J.Lehman " V.A.Speer. City Attorney Fred R.Wilson City Clerk, F.S.Lamson_ Chitf of Police R.G.Williams Absent: Commissioner S.O.Shinholser. Meeting called to order by the Chairman. Minutes of Regular Meeting of Ja.nua.ry 22, 1934 read and approved. Current invoices for the month of January 1934, properly audited and vouchered as evidenced by vouchers Nos. 5776 through 5844, submitted , examined, approved and payment ordered. Monthly report of the Streets, Sanitation, Health, Water and Library Depart- ments for the month of January 1934 submitted, and examined. Financial Statement and statement of revenues and expenditures during the month of January 1934, submitted and examined. Bank statements in all accounts properly reconciled, submitted and examined. G.W.Spencer, representing the holder of ajudgment against the Florida McCracken Concrete Pipe Company, appeared with reference to the machinery and equipment formerly the property of this company and since bought in by the City at tax levy sales. Mr. Spencer offered to pay to the City the amount representing its personal taxes against this property, also to reimburse the City for the amount paid for the property at the State and County Tax levy sale, in exchange for which the City to deed the machinery and equipment to his client, it being understood that the City is to have the use of this equipment as long as is necessary to complete the manufacture of concrete sewer pipe needed in the CWA project now under way for replacing obsolete and worn out sanitary sewers. Action deferred pending consideration by a full Board. Request next received from the Standard Oil Company for permit to erect terminal for storage and handling of petroleum products czl :ake shore property between Myrtle and French Avenues and lying immediately west of that of the Central Florida Tra.nsportaU= Company; also to erect retail gasoline service station on the front of this property next to State Road No. 3; also to erect dock into lake Monroe in front of this property. After careful consideration, Commissioner Speer moved that the permits be granted, subject to final approval after submission of plans and blue - prints. Seconded by Commissioner Lehman and carried. Discussion next arose with reference to the proposed replacement of all Sanitary Toilets in the City with new type approved by the -State Board of Health. Mr. Russell Broughman, representing the State Board of Health, urging the adoption of the new-.- type as a sanitary measure. 210 MINUTES CITY COMMISSION, SANFORD, FLORIDA, February 12, at 7:30 P M 19_34 Commissioner Speer then introduced an Ordinance entitled:, AN ORDINANCE PROVIDING FOR THE DISPOSAL OF HUMAN EXCRETA WITHIN THE CITY LIMITS OF SANFORD; FLORIDA, DECLARING OPEN PRIVIES TO BE A NUISANCE, PROVIDING FOR THE ABATEMENT OF SUCH NUISANCES, PROVIDING FOR THE CONSTRUCTION OF SANITARY WATER CLOSETS OR PRIVIES BY THE CITY OF SANFORD, FLORIDA, AND FOR ASSESSING THE COST THEREOF AGAINST THE PROPERTY UPON SUCH/ SAME ARE CONSTRUCTED AND ENFORCING PAYMENT OF SUCH COST, AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. and same was placed upon its first reading and read in full by the Clerk. Communication next read from Rev. Martin Bram, Chairman of Transients F.E.R.C. advising that the two houses offered the Emergency Relief Council to be used in constructing a. camp for transients would not be needed as the project had been postponed indefinitely, and same was ordered filed. Commissioner Lehman next moved that both street sweepers be put in a. state of repair and that one be equipped with pneumatic tires and puncture proof tubes. Seconded by Commissioner Speer and carried. Commissioner Dumas next moved that an additional policeman's uniform be purchased for the use of W W Owens, night watchman on Sanford Avenue. Seconded by Commissioner Speer and carried, The Commission next approved the awarding of contract for furnishing five fireman and five policeman uniforms to Woodruff and Watson at a total cost of $304.50 Itemized report next submitted by the Water Utility Department showing unpaid Charity Accounts totalling $503.26 for the two year period from February 1932 to February 1934, each of these accounts having been approved by Mrs Morse, Seminole County Welfare Board, as being a charity case and in need of water for Sanitary Purposes. Thereupon Commissioner Dumas moved that the balance as listed be charged off as uncollectible . Seconded-by Commissioner Speer and carried. Attention of the Commission was next brought to the telephone rate hearing tube held in Orlando on February 20th. and on motion duly carried, the Mayor and City Attorney were authorized to represent the City at this hearing. In line with efforts to "Clean -up" the City, and on motion of Commissioner Lehman, instructions were next issued to give publicity to the Ordinance regulating the handling of garbage, specifically that part applying to the furnishing of garbage cans; also, that the schedule showing days collections are made in the different sectiorrs of the City be advertised. The next matter for attention of the Commission was whether the 1933 delinquent real estate tax roll should be posted or published, and if published, in what newspaper. u After consideration, Commissioner Dumas moved that the 1933 delinquent tax- roll be POSTED. Seconded py Commissioner Speer and carried. Commissioner Speer next moved that the City Clerk, together with B.C. Ordinance No. 226 entitled: AN ORDINANCE REQUIRING THE PAYMENT OF A LICENSE TAX AND THE PROCURING OF A LICENSE BY ANY PERSON ENGAGED IN BUSINESS FOR HIMSELF AS A PLUMBER IN THE CITY Cr SANFORD, FLORIDA, AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. introduced and placed on its first reading at the meeting of January 22nd. was next placed'on its second reading and read by the Clerk. Thereupon the roll was called upon the passage and adoption of said Ordinance N0.226, the vote standing as follows: Commissioner Leffler Aye " Dumas Not voting If Lehman Aye If Speer Aye Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 226 entitled: AN ORDINANCE REQUIRING THE PAYMENT OF A LICENSE TAX AND THE PROCURING OF A LICENSE BY ANY PERSON ENGAGED IN BUSINESS FOR HIMSELF AS A PLUMBER IN THE CITY OF SANFORD, FLORIDA, AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. On motion of Commissioner Dumas, seconded by Commissioner Speer and carried, Ordinance No. 226 was ordered POSTED at the front door of the city Hall in the City of Sanford, Florida. Engineer Fred T.Williams next advised the Commission of a proposed O.W.A. project for widening the present brick paving on Park Avenue between Fulton and Tenth Streets. Thereupon discussion arose as to the proper width to make the paving on Park Avenue under this project, Mr. Williams suggesting that it be widened to forty -nine feet from. Fulton to Seventh Street and thirty -six feet from Seventh to Tenth Street. After careful consideration, Commissioner Lehman moved that the Commission adopt the suggestion of Mr. Williams and that the C.W.A. be requested to approve the project. Seconded by Commissioner Speer and carried. Report of the Committee in charge of the Municipal Athletic Field for the period ending December 31st. 1933 next read as follows: "February 6th. 1934 HON. DURING THE WHOLE SEASON $17.00. They were given a contract to pay $10.00 per month, but it was impossible to collect. Your Committee suggests that you issue instructions to permit them to play ball without charge, or that they be debarred from playing unless they pay. Furthermore, your Committee desires you should issue instructions, that NO person outside your Committee in charge of the Ball Park, has the power to offer privilege for RENT. Thereupon same was ordered accepted and the Clerk instructed to notify this Committee that the Commission has vested in them full authority to handle the Municipal Athletic Field, this authority including the granting of such privileges and concessions and the making of such rental charges as they deem best. Communication next read from John F.Pearson urging the installation by the City of a public sea.le, and on motion duly.adopted, same was ordered tabled for the time being. The Commission's Attention was next called to the dilapidated condition:of the building located on Lots 1 and 2 Block 2 Chapman & Tucker's Addition. Thereupon instructions were issued that proper action be taken looking towards the condemnation of this building. Instructions were next issued to City Attorney Wilson to proceed with fore- closure on delinquent tax certificates against that part of Lot 94 M.M.Smith's Subdivision of Sections, lying south of the Railroad ( Less railroad right -of -way) this property owned by the Florida McCracken Concrete Pipe Company and at present being utilized by the City for manufacture of concrete sewer pipe used in C.W.A. sewer projects. On motion of Commissioner Speer, seconded by Commissioner Dumas and unanimously carried the following resolution was next approved and adopted: RESOLUTION SHOWING THE NECESSITY FOR FEDERAL FUNDS FOR CIVIL WORK PROJECTS BE_ IT RESOLVED by the City Commission of City of Sanford, the County of Seminole, State of Florida, that the Civil Works Administration, by its proposal for a work project for paving a portion of FA Project 85 -A within the City Limits of Sanford, starting at Myrtle Avenue and extending 307 ft. west, a total of 110,559 yds. of lime rock base 6 inches thick, with a surface treatment of 2/10 gallons of asphaltic prime coat per sq. yd. is a. public project for the benefit of the,genera.l public, and not for the benefit of any private interest, and the title to the property upon which the work is to be performed is vested in the Florida State Road Department ( by deed from the City of Sanford, Fla. covering right -of -way for State Road No. 3 along the south shore of Lake Monroe.) On motion of Commissioner Speer, seconded by Commissioner Lehman and unanimously carried, the following resolution was next approved and adopted: RESOLUTION SHOWING THE NECESSITY FOR FEDERAL FUNDS FOR CIVIL WORK PROJECTS. BE IT RESOLVED, by the City Commission of City of Sanford, the County of Seminole, State of Florida, that the Civil Works Administration, by its proposal for a work project for Sanford Florida, Country Club and Golf Course. This work will consist of grading, ditching , and re- conditioning present course. This golf course is municipally owned. Outside of City Limits, is a public project for the benefit of the general public, and not for the benefit of any private interest, and the title to the property upon which the work is to be performed is vested in the City of Sanford, Florida. The project embraces work that needs to be done for the general good of the community, that there are no appropriated public funds available, nor any other way in which local public funds may be made available with which to do this work, and that unless Federal Funds are used for this purpose, the said work cannot be done at this time, nor at any time within the near future; that any material over and above 30`fo of the total cost of Project will be furnished by of Sanford, Florida. On motion of Commissioner Speer, - ,seconded by Commissioner Lehman and unanimously carried, the following resolution was next approved and adopted. RESOLUTION SHOWING THE NECESSITY FOR FEDERAL FUNDS FOR CIVIL WORK PROJECTS. BE IT RESOLVED by the City Commission of the City of Sanford, the County of Seminole, State of Florida., that the Civil Works Administration, by its proposal for a work project for Sanford Municipal Cemetery, Sanford, Florida. This work consists of cleaning the above cemetery is a public project for the benefit of the general public, and not for the benefit of any private interest, and the title to the prop- erty upon which the work is to be performed is vested in the City of Sanford, Florida. The project embraces work that needs to be done for the general good of the community, that there are no appropriated public funds available, nor any other way in which loca.l,public funds may be made available with which to do this work, and that unless Federal Funds are used for this purpose, the said work cannot be done at this time, no at any time within the near future; that any m terial over and above 30% of the total cost of Project will be furnished by the of Sanford, Florida. On motion of Commissioner Speer, seconded by Commissioner Dumas and unani- mously carried, the following resolution was next approved and adopted: RESOLUTION SHOWING THE NECESSITY FOR FEDERAL FUNDS FOR CIVIL WORK PROJECTS. BE IT RESOLVED by the City Commission of the City of Sanford, the County of Seminole, State of Florida, that the Civil Works Administration, by its proposal for a work project for relaying old damaged and obsolete sewers located in the alleys between Cypress, Sanford, Palmetto, Magnolia, Park, Oak, Myrtle, Elm, and Laurel Avenues and between First, Second streets as shown on:plan accompanying original application. BE IT RESOLVED, by the City Commission of City of Saford, the County of Seminole, State of Florida, that the Civil Works Administration, by its proposal for a work project for Cleaning Gutters, Storm Sewers and Parkways on Sanford, Palmetto, Magnolia, Park, Oak, Myrtle , Elm, Laurel and French Avenues from Seminole Boulevard to Twenty -fifth Street, also cross streets from Seminole Boulevard to Twenty -fifth Street between Sanford and French Avenues. Total of 28 miles in the City of Sanford, is a. public project for the benefit of the general public, and not for the benefit of any private interest, and the title to the property upon which the work is to be -. performed is vested in the City of Sanford Florida. The project embraces work that needs to be done for the general good of the community, that there are no appropriated public funds available, nor any other way im which local public funds may be made available with which to do this work, and that unless Federal Funds are used for this purpose, the said work cannot be done at this time, not at any time within the near future; that any material over and above 30% of the total cost of Project will be furnished by the of Sanford, Florida. BE IT RESOLVED By the City Commission of City of Sanford, the County of Seminole, State of Florida., that the Civil Works Administration, by its proposal for a work project for ditching and grading various dirt streets and roads in South Goldsboro, a colored section of the City of Sanford, as per itemized list attached to project is a. public project for the benefit of the general public, and not for the benefit of any private interest, and the title to the property upon which the work is to be per- formed is vested in the City of Sanford, Florida.. The project embraces work that needs to be done for the general good of the community, that there are no appropriated public funds available, nor any other way in which local public funds may be made available with which to do this work, and that unless Federal Funds 'are used for this purpose, the sai work cannot be done at this time, nor at any time within the near future; that any material over and above 30o of the total cost of Project will be furnished by the of Sanford, Florida.. Commissioner Dumas next moved that the salary of S.M.RiCha.rd whose services have been donated by the City to the CWA project for relaying the City's obsolete sewers be temporarily placed at $25.00 per week while engaged as foreman on this project. Seconded by Commissioner Speer and carried. On recommendation of Chief of Police, the Commission next approved acceptance of 45.00 from Rastus Harris, Case No. 20221, sentenced 12/26/33 in the Municipal Court to $15.00 Qf 45 days, in lieu of serving balance of sentence of 17 days.
