120734MINUTES CITY COMMISSION, SANFORD, FLORIDA, Camber 7 at 5:30 P M 19--34- 331 X The City Commission of the City of Sanford, Florida , met in Special Called Session at the City Hall in Sanford, Florida at 5:30 O'Clock P,M. December 7, 1934. Present: Commissioner W,A."effler, Mayor. " T.L.D.umas " H.J.Lehman a V,A.Speer " S.O.Shinholser.. City Attorney Fred R.Wilson City Clerk F.S.Lamson Meeting called to order by the Chairman. The @haitmgn then announced that the meeting had been called to confer with H.H, Coleman, Manager of the Florida Power & Light Co. concerning the proposed lighting of 50 per cent more street lights than are now in operation, at no additional cost to the City. Thereupon, Mr. Coleman submitted for consideration by the Commission a proposed form of letter agreement between the Florida Power & Light Company and the City of Sanford, Florida, whereby the Florida Power & Light Co. will furnish 50 per cent more street lights than are now in operation at no additional cost to the City, After a careful study of the proposed letter agreement, and upon the assurance by.Mr. Coleman that under the terms of paragraph three thereof, the City will be entitled to cancel the agreement at the end of the first year upon written notice thirty days prior thereto, Commissioner Speer introduced Resolution No. 459 approving said letter agreement and moved its passage and adoption, Seconded by Commissioner Lehman and unanimously carried, said Resolution No. 459 being in words and figures as follows: RESOLUTION N0. 459 APPROVING A PROPOSED LETTER AGREEMENT BETWEEN THE CITY AND FLORIDA POWER'& LI"GHT'COMPANT PROVIDING AT NO ADDITIONAL COST TO THE CITY, FOR ADDITIONAL STREET -LIGHTING "SERVICh VALUED UiAR THE TERMS OF THAT CERTAIN MUNICIPAL STREET LIGHTING -AGREEN=' BETWEEN-F& CITY AND THE COMPANY DATED OCTOBER 1, 1926 AND SUPPLEMENTARY AND AMENDATORY"AGREEiCms THERETO, AT APPROXIMATELY-FIFTY PER CENT. ) OF THE" PRESEiQT "'ANNUAL BILL FOR STREET LIGHTING UNDER SAID AGREEMENT'S AND SETTING OUT THE TERMS AND CONDITIONS UNDER WHICH SAID ADDITIONAL STREET LIGHTING SERVICE SHALL BE RENDERED; AUTHORIZM -AND DIRECTING THE MAYOR AND THE CITY CLERK OF AND ON BEHALF OF THE CITY OF SANFORD, FLORIDA TO EXECUTE AND ENTER INTO THE SAID LETTER AGREEMENT WITH FLORIDA POWER & LIGHT COMPANf, BE IT RESOLVED__BT THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA. 1. That the proposed Letter Agreement between the City and Florida Power & Light Company, copy of which is set out in form in Section 2 hereof, be and the same is hereby to form approved as and substance,:. 2. That the Mayor and the City Clerk of and on behalf of the City, be and they are hereby authorized and directed to execute and enter into with FloridaPower & Light Company the said proposed Letter Agreement approved in Section 1 hereof and hereinafter set forth in form as follows: December 6, 1934. City of Sanford Sanford, Florida Gentlemen: In order to enable the City of Sanford and its residents to enjoy additional street lighting service at no additional post to the City and its taxpayers, we will, as of the Sth day of December 1934, restore to active service, at locations to be designated by the City, sufficient of the serviceable street lights which are not now in operation so that if the bills for electric energy and services supplied to such restored street lights were computed under the Municipal, Street Lighting - Agreement between us dated October 1, 1926, and supplementary and amendatory agreements thereto, such bills would equal approximately X 332 MINUTES December 7, at 5:30 P M 9L CITY COMMISSION, SANFORD, FLORIDA, fifty per cent (50%) of $9,994,52, the ,present annual ball under the said Agreements. However, the City will not be obligated to pay anything whatsoever for the add.itIonal street lighting service furnished to the City hereunder. Street lights restored to service by us under this arrangement shall not be considered additional street lighSs or street lights restored to service in accordance with the said 'upicipal Street Lighting Agreement and supplementary and Amendatory Agreements thereto, which Agreements shall remain In full effect, except as provided herein.. This Agreement shall run for one ( 1 ) year from the date hereof and for yearly periods thereafter unless cancelled by either party by written notice to the other thirty (30) days before the e�cpiration of any yearly period,. but in no event shall the entire term of this Agreement exceed Ten ( 10 ) years. If you agree to the foregoing, kindly so indicate by causing this letter to be executed in triplicate in the spaces provided below for that purpose.
