THIS AGREEMENT, made and entered into on thisl day of , 2011, by and between City
of Sanford, a municipal corporation duly incorporated pursuant to the laws of the State of Florida, with administrative
offices at 300 North Park Avenue, Sanford, Florida 32771, hereinafter called the "OWNER" and the State of Florida
Department of Transportation, hereinafter called the "DEPARTMENT"
WI TNESSETH
WHEREAS, the DEPARTMENT intends to construct certain improvements to State. Road 15; and
WHEREAS, as a part of the intended improvements, the DEPARTMENT desires to enter OWNER's property and
to perform the following activities: to accomplish Mills Creek bridge repairs in accordance with the STRUCTURE PLANS
prepared by BERGMANN ASSOCIATES and
WHEREAS, the OWNER has no objection to the entry onto its property to perform these construction activities on
OWNER's land.
NOW, THEREFORE, in consideration of the above stated premises, the OWNER hereby grants to the
DEPARTMENT and its agents or assigns a right of entry to enter upon the OWNER's lands for the purpose of performing
the activities described above. It is further understood and agreed that the DEPARTMENT and /or its duly authorized
representative will restore the remaining lands to a safe and sanitary condition after the construction of the
improvements... By acceptance of this right of entry and the use of the OWNER's property, the DEPARTMENT accepts
the terms and conditions of this document.
