031120M O C m f W A Adjourned meeting of the City Commissionars Thursday March 11 1920 Meeting called to order at Eight P.M. by Mayor H.R.Stevens. Present, H.R. Stevens, C.E. Henry, S. 0. Chase, Commissioners,, and G. A. Abbott City Manager. Minutes of the last meeting read and approved. Communication from C.D.Landis City Attorney relative to exemption frorn taxation the property of Sanford Lodge No. 62 F. &. A.M. quoting Section 431 Laws of Florida was read and the property of said Lodge declared exempt under the law. Mr F.L.Miller addressed the Comrriission and presented a petition from a number of citizens requesting repeal of that part of traffic ordinance prohibiting the parking of cars on paved streets of Sanford. After due consideration the Commissioners decided it is not best to repeal this ordinance,but instructed the Police to show leniency in the matter to strangers who are ignorant of the law. Moved by C.E.Henry and seconded by S.O.Chase that the fines imposed by the ; -Junicipal Court in the cases of M Alexander January 31st.and R.E.Anderson March lst.be refunded and same was duly carried. Mr F.L. Miller again addressee the Coaaf< ission as reprasantini� a number of citizens and urged that the Commission take such steps as might be necessary to restrain the Southern Utilities Company from collecting their outstandiai; accounts against the City and private consumers until better and continual service should be given by said Company. It was moved by C-1- Henry and seconded by S-0-Chase that : Whereas: The Southern Utilities Company have for the past several months given very unsat- isfactory service both as to electric polar and lighting and also as to gas and water sup- ply, Be It Resolved: That the City Attorney be and he is hereby instructed to institute proceec ings to restrain said Southern Utilities Company from collecting any and all bills now:.out -t,' . 4tanding for the months of January and February 1920 and all future bills until such time as the said Company shall give good, afficiant and adequate servie continuously in compliant with their contract with the City of Sanford Florida, same was duly passed. Communication from City Engineer Fred.T.Williams relative to the cost of construct ing sewer as petitioned for by Mr John Musson at al and giving the estimated cost of same as $1719-80 and stating that Mr Musson would agree to finance the proposition, was read and referred to the City Manager with instructions to confer with Mr Musson as to further de- tudls and report at the next meeting of the Commission. Petition from G. W. Venable ralativa to moving Secord building from rear of Valdez Hotel to a location east of Sanford Avenue was read and tine Auditor & Clerk was instructed to iss -aa\i; ma on the giving of a bond by Mr Venable in the amount of $5GU.00 and limiting him to seven clays time on the job. Coaar,unication from City Engineer Frea T- Williams relative to cost of paving Sanford Avenue from Fifth Street to Tenth Str,at ti4as read and ordered filed. Communication from Cary D.Landis City Attorney tendering his resignation as City Attorney of Sanford Florida was read and on motion of C.E.-Henry seconded by S-0-Chase same was duly accepted. le Comaunication from C.D.Landis City Attorney rendering opinion as to the eligibility of Mr H.R. Stevens to be a member of the City Co:rmiscion of the City of Sanford Florida and giving it as his legal opinion that W Stevens is in every way eligible for the position was read and on motion of S. 0. Chase seconded by C.E. Henry the Commission adopted the opin- ion of the City Attorney as coinciding with their opinion in the matter and Mr Stevens ag- reed to continue as a member of the City Commission of the City of Sanford. Of THE QITY C,r .�hl�' O D, 'LORIDA: beetion 1. chat it shall hereafter be unlawfal for the oc- cupant or owner of any premises in the Oity of oanford, r+lorida, or the agent of the owner, if the owner be a non - resident of said city or absent from the city, to cause, suffer or permit any collection of standing or flowing water in which mosquitoes are likely to breed on such premises, unless such collection of water is treated in a manner prescribed by the city health Officer of the city of 6anford, Florida, or his duly authorized representative, so as to prevent the breeding of mosquitoes, and any such collection of water so unlaw- fully maintained is hereby declared to be a nuisance. oection 2. _hat the collections of water to be considered as coming within the terms of this ordinance are those which are eon - � tained,or may hereafter be contained, in ditches, ponds, pools, exca- vations, holes, depressions, open Bess pools, fountains, cisterns, i tanks, shallow wells, barrels, troughs (except horse troughs in fre- quent use) urns, boxes, bottles, tubs, buckets, defective house roof gutters, tanks of flush closets or other similar water containers. 'a t a 1 M Oa M O m w P4 A i a �eetion 3. ghat the method of treatment of any such col - lection of water for the purpose of preventing the breeding of mos- quitoes shall be approved by the vity health Lfficer of the vity of oanford, ulorida, or his duly authorized representative, and :nay be any one or more of the following: (a) acrsening with wire netting of at least sixteen (16) meshes to the inch one way or any other material which will effect- ually prevent the ingress or the egress of mosquitoes. (b) -omplete emptying every seven days of the unscreen- ed containers, together with their thorough drying and cleaning. � (c) using an approved larvicide. i i td) covering completely the surface of the water with kerosene, petroleum, or paraffin oil once every seven days. (6) Cleaning and keeping sufficiently free from vege- table growth and obstructions, and stocking with mosquito- destroying i fish; absence of half -grown mosquitoes'larvae to be evidence of com- pliance with this measure. (f) Pilling or draining to the satisfaction of the �Aty health Officer of the Qity of 6anford, _Wlorida, or his duly au- thorized representative. (g) Proper disposal of tin cans, tin boxes, broken or empty bottles, and similar articles likely to hold water. i Section 4. 'that any person responsible under the terms of i this ordinanee,or for the existence of any condition which gives rise or is likely to give rise to the breeding of mosquitoes who shall fail or refuse to take all the necessary measures directed by the city Health Officer of the City of Sanford, Florida, or his duly authoriz- j ed representative, to prevent the same in accordance with the tsrme hereof within three days after notice from the city .ealth Officer of i I 1 6 O w A J F the Uity of Sanford, elorida, or his duly authorized repressntitive , so to do, he shall be guilty of a violation of the terms and sections of this ordinance, and each and every day's failure or refusal to remedy sAch condition after the expiration of said time shall consti- tute a separate and distinct offense. oection 5. That the city health Officer of the City of San- ford, ,,lorida, and those working directly under his supervision, shall enforce the provisions of this ordinance, and for this purpose may at all reasonable times enter in or upon any premises within the city of Sanford, :Florida. 6ection 6. That this ordinance is declared to be an emer- gency measure necessary to the public health of the citizens of the Uity of Sanford, ullorida, and shall take effect from and after the date of its passage. Section 7.
