Minutes Of last Regular and Special Meetings read and approved* Communication from Sanford Public Library Ass'n. presented by Rev. A S Pack, President relative to appropriations for support of Library and requesting per - mission to erect a Public Library building in the City park was read, and referred to City Attorney for legal opinion. Ir. Deane Turner addressed the Commission relative to certain improvements on the bulkhead and presented blue prints etc. The matter was referred to the City Manager for investigation. The matter of City Cemetery was discussed and_ the committee on this matter asked for further time, Promising to report at next meeting of the Commission. Communication from Landis, Fish & Hull rendering bill for legal services was read and ordered filed. The following resolution was offered RESOLUTION. Resolution requiring the grading, paving and drainage of portions of Palmetto Magnolia Ave. Thirteenth St,, Sanford Ave. and West First St. in the City -of Sanford Florida; Prescribing the manner of constructing such pavements; providing for the con- strUotion Of such pavements by the City L of.Sanford upon the failure of the owners of 7 ahhMing property to ,do so, and for the assessment of the cost W r and expense thereof upon* ,�,4Owner or owners of all the property bounding and abutting on said portions of said streets and avenues so paved# and declaring this resolution to be an emergency -15 %OV &0%PG&0%4J6%P fcw the immediate preservation of the public safety, to become OffeOtive.immadiately upol,n its adoption. WHEREAS, the City Commission of the City of Sanford,, Florida is of the opinion that the Public Welfare and Safety demands and Requires that Palmetto Ave. from Tenth $t. to Thirteenth St. Magnolia Ave. from Tenth St. to Thirteenth St; Thirteenth St. from Park Ave. to Sanford Ave; Sanford Ave from Fifth St. to Tenth St.; and West t 81*:', from 130 ft. East of Poplar Ave. west to jasmine Ave. be paved; AND WHEREAS, there are now on file in the office of the City Manager of the city of Sanford, complete plans 0 specifications, estimates, and profiles of said proposed im- provements of s&id,Streets and Avenues,, giving all necessary information,, and said com- .­..plate plans,, specifications, estimates and profiles have been submitted to t t be City Cc m. mission and approved by ito and the City Abditor and Clark has made estimates of al 1 the expense of said .work to be done in making the aforesaid impory ements,, and the estimated cost of_ said impFovements is the sum of $92, 561.00, AND 1.11 WHEREAS, The City Commission is of the opinion that the public safety and welfare require that the improvements aforesaid be undertaken immediately, and that therefore, this resolution should be declared an Emergency Measure for the immediate preservation of the public safety, to become effective immediately upon its adoption: NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD,FLORIDA : That the owners of property abutting that portion of Palmetto Ave. begin- ping at Tenth St. and extending South to Thirteenth St. be, and they are hereby required to construct within sixty days from the date of service of notice, as hereinafter provided a Twenty -four foot pavement on the above described portion of Palmetto Ave., and lying adjacent to the respective lots, pieces or parcels of land abutting thereon. That the owners of property ab"tti% that portion of Magnolia Ave. beginning at Tenth St.aand extending south to Thirteenth St. be and they are hereby required to construct, within sixty days from date of service of notice as herein- after provided a Twenty -four foot pavement on the above described portion of Mag- nolia Ave. , and lying adjacent to the respective lots, pieces or parcels of land abutting thereon; That the Owners or property abu .-ting that portion of Thirteenth Street beginning at park Ave and extending east to Sanford Ave , be and they are hereby, required to construct , within sicty days from the date of service of notice as hereinafter provided, at Sixteen foot pavement on the above described portion of Thirteenth Street, and lying adjacent to the respective lots, pieces or parcels of land abutting thereon;, That the owners of property abutting on that portion of Sanford Ave. beginning at Fifth St. and extending south to Tenth Street, be, and the are hereby required to construct, within sixty days from the date of the serviee of notice, as hereinafter provided a Twenty -four foot pavement on the above described portion of Sanford Ave., and lying adjacent to the respective lots, pieces or par- cell of land abutting thereon. That the owners of property abutting on that portion of West First Street beginning at a point 130 ft. East of the east line of Poplar 3, Ave. and extending west to Jasmine Ave, be, and they are hereby, required to constru within sixty days from the date of service of notice, as hereinafter provided a Twenty -six foot pavement on the above described portion of West First Street , and lying adjacent to the respective lots, pieces of parcels of land abutting thereon. That said pavement shall be constructed of the material selected by the City Com- mission, after receiving competitive bids on the various kinds of material selected by the City Commission as desirable and suitable, and according to plans, and speci- fications now on file in the office of the City Manager. , begin .It That prior to the construction of said pavement the portions of said Avenues and streets herein required to be paved shall be graded and the drainage provided for in.., accordance with the said plans and specifications now on file in the office of the City Manager. BE IT FURTHER RESOLVED that the City Manager shall cause written notice of the passage of this resolution to be served in the manner required by Section 179 of Chapter 5361, of the Laws of Florida, Acts of 1919, upon the owner, or agent of the owner, of each lot or parcel of land abutting upon said portion of said palmetto Ave. Magnolia Ave.; Thirteenth Street; Sanford Ave.; and best First Street: AND BE IT FURTHER RESOLVED, That if the grading, paving, and drainage of said por- tion of said Palmetto Ave., Magnolia Ave.; Thirteenth Street; Sanford Ave.; and Vest First Street hereinbefore described, be not done within sixty days from the service of notice provided for in the preceding paragraph, the City Manager shall proceed, by contract, to construct such paving, grading, and drainage, The City of Sanford, to pay for all Streit Intersection, and in addition, so much of the balance of the cost of said improvements as will amount to one -third of the total cost there- of, and the remaining two - thirds of the total cost to be at the expense of the owners of the property abutting upon said portions of Palmetto Ave.,Magnolia Ave., Thirteen] Street, Sanford Ave. and Vest First Street so paved; And. BE IR FURTHER RESOLVED: That in the avant the City of Sanford constructs such improvements, two - thirds of the total cost of which said improvements shall be at the expense of the owners or owner of the property abutting upon said improvements; that the total cost assessed against each one of the owners of property abutting on said improvements shall be due and payable upon the completion of said improvements and all such payments so due shall bear interest at the rate of 5% per annum from and after the completion of said improvement until paid . BE IT FURTHER RESOLVED: That this resolution be, and JLt is hereby, declared an Emergency Measure for the immediate preservation of the public safety, and shall become effective imirediately upon its adoption, and within ten days after the passage and adoption thereof, the Ci,y A --ditor & Cl --rk shall publish a notice of the pas- sage and adoption of this resolution, as provided and required by Section 25 and 26 of Chapter 5361, Laws of Florida, Acts. of 1919, the same being the Charter of the City of Sanford. The foregoing resolution was unanimously adopted by the City of binford this 10th. day of October A. D.1921.
