050822REGULAR MEETING OF CITY COMMISSION MONDAY MAY 891922 Meeting called to order bar Mayor C E Henry at 8 P.M.. present: E $envy, Mayor, S' d Chase and Forrest lake Commissioners, C.d.Ryan City Manager G G Herring City Attorney, and Mr Geo A DeCottes, Special Counsel. Minutes of last Regular Meeting read and approved. Communication from Mr w C DeCoursey re certain City Tax Certificates read and referred to the Auditor & Clerk for investigation and report. Mr Goo A DeCottes , Special Co7insel addressed the Commission re Charter Amend- ment ordinance etc. Commissioner, Forrest fake then intorduced 'an ordinance entitled: "An ordinance repealing revoking and rescinding an ordinance adopted by the City Com- mission of the City of ianford, Florida, on the 3rd. day of May A.D.1922, the same being an ordinance No. 33 declaring the same to, be an emergency measure,, to take effect immediately Ripon its final passage and adoption." And moved that same be placed upon its first reading and read in full, said motion was duly seconded by Commissioner, 0 Chase. The question was then put upon said motion �.- w�a,�- lam•, . which prevei led by unanimous vote of the City Commission. Thereupon, Ordina -- a .% Was placed upon its first reading and read in full. It was moved by Commissioner Forrest Make and seconded by.Commissioner, S.O.Chase that the requirements of a second reading of the above and foregoing drdi nanoe at another regular meeting of the City "Commission,, not less then one week from date hereof, shall be dispensed with by the unanimous vote of the City Commission. Carried by the unanimous vote of the City Commission of the City of Sanford-, Florida this 8th day of May A.D.19220 .Commissioner Forrest 4ke then introduced an ordirnanoe entitled: C# 3 "An Ordinance amending Sections 7 97,164,206 and 217; and repealing Segtion 174 of Chapter 8361,Lawe of Florida,lfi9 Entitled 11 An Act to Abo�ish the resent Municipal Government of the Oity of Sanford, County of Semino e, State of Florida and to Organize, Inoorporate.and Establish a City Government for the same, and to Prescribe the Krisdiotionjowers and Functions of Said Municipality." and moved that same be placed upon its first reading and read in fu11.'Said motion was duly seconded by Commissioner S 0 Ohase. The question was then put upon said mo- tion, which prevailed by the unanimous vote of the City Commission Thereupon, the said ordinance was placed upon its first reading and read in fall. Thereupon, Commissioner, Forrest Lake moved that the rules be waived and said ordinance be placed upon its second reading by title only, whioh'motion'was duly second- ed. Thereupon, the question recurred upon the motion to place said ordi- nanoe upon its second reading by title only, which motion prevailed by the nn- vote of the City Commission. Thereupon, said ordinance was placed upon its second reading by title only. Thereupon, Commissioner Forrest lake moved that the rules be further waived that said ordinance be read in full and placed upon its third reading and fin - passage, which motion was duly seconded. ;hereupon, the roll was ordered called upon the question of the further ver of the rules. There upon, said ordinance was then read in full and the roll was ordered ad upon the final passage and adoption of said Ordinance. I co 0 M A NOTICE OF CHARTER AMENDMENT ELECTION Whereas, the City Commission of the City of Sanford, Florida, on the 8th. day of Kay A.D. 1922, duly passed and adopted a certain ordinance Entitled. "An Ordinance Amending Sections 7,97,164,206,..and 217 and Repealing Section 174 of Chapter 8361; Laws of Florida, 1919, Entitled " An Act to Abolish the Present Nanioipal'.0overn. ment of the City ©f Sanford p�yi, County of Seminole, State of Florida and to Organize, Incorporate and Establish a City Government for the same, and to pre- scribe the Jurisdiction, Powers and Functions of said Municipality." Whereas, Said ordinance provides for the amendment of Sec 7,Seo 97, Sec. 1649 Sea. 206, and See, 217, and the repeal of Sec. 174 of the Charter under v&ich the City of Sanford, Florida is now operating and funotioning, and Whereas, it is provided by the charter of the City of Sanford, Florida that any proposed amendment of said charter shall be submitted for approval or rejection to the electors of the City of Sanford, Florida, at an election duly called and held for said purpose, Therefore, C E Henry, as Mav or of the City of Sanford, Florida under and by virtue of the authority in me' vested, and we, C I'' Henry, S 0 Chase and Forrest fie, as Commissioners of the City of Sanford Florida composing ng and comprising the City Commission of the City of Sanford, Florida , do hereby call an election to be held in the City of Sanford, Florida, on the 12th day of July A.D.1922 to determine the Tuestion by the referendum dote of a majority of the electors of said City quali- fied to vote, participating in said election, whether the amendments of the present charter of the Oity of Sanford, Florida, proposed by the aforesaid ordinance shall be adopted and approved, either in vole or in part. And I, C E Henry, as Mayor of the City of Sanford, Florida, and We, C.E.Henry S O Chase, and Forrest Lake as the City Commission of the City of Sanford, Florida, do hereby appoint V. E Douglass, 0 P Herndon, and R C Maxwell, Inspectors of said election, and t M Haynes, Clerk of Said election. The said election hereby ordered and called to be held on the said 12th day of July A. D 1922 shall be held and conducted in the manner prescribed by the ordi- nances and the charter of the City of Sanford, Florida. And it is further ordered that not less than thirty days prior to- the date of the election hereby ordered to be held the City Auditor & Clerk shall mail a copy of the aforesaid ordinance proposing the amendments to the present charter of the City of Sanford, Florida to each elector whose name appears upon the registration books of the City. Communication from Mr F W ]Mahoney re the purchase of a certain tract of bulk' head property and requesting that the City release this portion of said property from certain notes and mortgages now filed against the bulkhead property as to the tract s Beg. at the Int. of North line of Fulton St. with the west line of park Ave. ran thence north 100 ft West about 117 ft, to alley south 100 ft, E. to beg. Commissioner Forrest flake moved that the request of Mr Mahoney be granted which was duly seconded by Commissioner S 0 Chase and passed by the unanimous vote of the City Commission. City Engineer F,T,Williams offered Y. Check's amended plat of Blookl, -'Ulw £N & 3N, Tier 9 of E R Trafford's Map for approval by the City Commission. On motion commissioner Forrest yak e, seconded by Commissioner, S 0 Chase, same was accepted and ordered added to the City Plats, The City Commission the proceeded to canvass the returns of the Municipal U- brary Election held on the 26th day of April A. D. 1922, to determine the question and maintenance of a public library by the City of Sanford, Florida, and found the result of said election as shown by the om vass of said returns, to be as fol- lows, to -wit: For the approval of that certain ord.inanoe of the City of Sanford Florida, entitled, " An Ordinance providing for the establishment and Maintenance of a public Library and resAing room free for the use of the inhabitants of the City of Sanford, Florida, to Call ar4 Election to Determine the Question of the Estab- lishment and maintenance of the same." ...............1b6 votes and Against the approval of that certain Ordinance of the City of Sanford Florida, entitled " An Ordinam a providing for the Establishment•and maintenance of a Public Library and Reading Room Free for the use of the Inhabi:.tants of the City of Sanford, Florida, and authorizing the Mayor of the City of Sanford, Florida, to call an Election to determine the Question of the Establishment and Mainte- nance of the same." .... ............................... 42 votes • Thereupon, the following order and resolution was duly passed and adopted. Whereas, the returns of the election held on the 16th day of April A.D. 1922, to determine the question of the establishment and maintenance of a public library by the City of Sanford., have been made to this Commission, and and Whereas, said returns have been duly opened and canvassed by said �ommissicn Whereas, said returns show that 156 votes were oas for the approval of the establishment and maintenance of said library, and 42 votes were cast against the establishment and maintenance of said library, and, Whereas, by the canvass of the returns, it is found that a majority of 114 votes were oast for the approval of that certain ordinance entitled, rAn Ordinance providing for the establishment and maintenance of a public Library and Reading room Free for the Use of the Inhabitants of the City of San- ford, and authorizing the Mayor of the Oity of Sanford, Florida, to Call an elect- ion to determine the question of the establishment and maintenance of the same," and FOR THp BSTABLISHMMNT AND MAINTENACE OF A PUBLIC LIBRARY 7 w a MEW Therefore, Be it Resolved by the Gity Commission of the City of Sanford, Florida, and it is so declared, that the result of said election held as aforesaid, on the 26th day of April A.D.1922, is in favor of the establishment and maintenance of a public library by the City of Sanford, Florida. ,Adopted this 8th day of May A.D.1922.
