022623I I / Minutes of Regular Meeting of City Commission Monday February 26,1923. 2130 P.M. Present: Commissioner Forrest Lake ( Mayor) Commissioners S 0' Chase, and C. J. Marshall, C J Ryan, City Manger, J J Dickinson, City Attorney, F.T.Williams, City Engineer. Minutes of last,Regular Meeting read and approved. Communi cat ion from the-- ahemberof Commerce relative to negotiations for purchase of public Utilities was read and filed. Communication. from Mr J E Craig Rot investigation and valuation of public util- ities was read and proposition accepted at a fee of $4000.000 same was filed with bid. Communication from Geo. A Main Rei water testing etc, was read and referred to Clerk to acknowledge and file* Petition from property owners in Spurlings addition Re: extension of water mains read and Qity Manager was authorized to proceed in the matter. Communication from the U„I.War Dept. engineer was read and the following reso- lution was offered. RESOLUTION. 4 c6'�'% . Resolution rescinding, revoking and recalling a resolution "requesting the War Department of the United States of America to fix and establish a harbor line along 'th'e north side of the City of Sanford in Seminole County, Florida,, between said City and Lake Monroe, and the St Johns River, a navigable stream." WEIREAS, The City Commissioners of the City of Sanford,. Florida, heretofore passed and adopted a resolution requesting the War Department of the United states of Amer - ios to fix and establish a harbor line along the north side of the City of Sanford, F1ord&a, between said City and Lake Monroe, and the St. Johns River, a navigable stre AND WHEREAS, the said City Commissioners have been advised that to grant such request would materially interfere with certain improvements contemplated by the said City at this time, and further, that the time for fixing and establishing such harbor line is premature. THEREFORE, BE IT RESOYLED BY THE CITY OF SANFORD, FLORIDA, That its request for the fixing and establishing such harbor line be, and the same is hereby recalled, revoked and rescinded, and the Said War Department is hereby requested to take no further or other action in the matter pursuant to such request at this time Adopted in regular session this 26th day of February A.D.1923 Attestl L K ili s �rGity Clerk ( Seal) Forr t L mayor, commissioner S.O.0 as commissioner G J Marshall commissioner S �i a a The following Ordinance was offered: ORDINANCE # An Ordinance for the preservation and protection of the Public streets and high- ways of the City of Sanford, Florida, requiring all motor driven vehicles and im- plements ran or operated over or upon the said streets and highways to be equipped with pneumatic tires, and providing punishment for violation'thereof. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLIRIDA: SECTION 1. That on and after the passage of this ordinance all motor driven ve- hicles and implements ran or operated orer or upon the streets and highways of the City'of Sanford, Florida shall be equipped with pneumatic tires, and it shall be unlawfal for any person, firm or corporation to run or operate such motor driven vehicle or implement over or upon said streets and highways of the City of Sanford Florida, unless the same be equipped with such pneumatic tires in accordance with the provisions of this ordinance. SECTION 2 h That any person, firm or corporation who shall violate-the provisions of this ordinance shall be punished by a fine not to exceed $100.00 or by imprisonment not to exceed 30 days, or by both such fine and imprisonment, in the discretion of tbw court. SECTION3. That this ordinance is hereby declared to be an emergency measure for the immediate protection and preservation of the streets and highways df the City of Sanford Florida, and shall become effective from and after the date of its passage. SECTION 4. That this ordinance shall be published in some newspaper of general cir- culation in the City of Sanford, Florida one time within ten days after the date of its passage. Passed by a unanimous vote of the City Commission of the City � Sanford, Florida this 26th day of February 1923. Said Ordinance was then placed upon its second reading and read title only this 26th day of February -&.v.1923. Whereupon Commissioner Chase moved its adoption. J.J. Dickinson as Chairman of said Committee. Communication from 0 J Ryan, City Manager, requesting action on his resignation now before the Commission. On motion of Commissioner C 4 Marshall a vote on the accept- ance of the Managers resignation to take effect March 15,1923 was taken ,resulting as follows: C.J. Marshall Yea Forrest Lake Y8a S.o.Chase. Nay Application of Dr. J N Tolar for the office of City Physician and Health Officer was read and filed. Commission C J Marshall nominated Dr. W.T.Langley for the office of City Physician and Health Officer, same being duly seconded. On motion Dr. Langley was_ unanimously elected and the following resolution was offered : RESOLUTION. i ► Resolution appointing a City Physician of the City of Sanford, Florida. WHEREAS, Section 207, Chapter 8361 of the Laws of Florida, provides that the City Commission shall have the power to appoint a City Physician to be an attache of the Department of Public Safety and Welfare, and WHEREAS, This is an emergency measure necessary for the usual daily operation of the Municipal Government of the City of San ford, NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA Section 1, That Dr. W.T.Langley, be, and he is hereby appointed City Physician of the City of Sanford, Florida Section 2, That Dr. W.T. Langley, the City Physician, shall hold office and serve during the pleasure of the City Commission of the City of Sanford, Floride. The adoption of the above resolution was moved by C.J.Marshall and seconded by S.O.Chase on the 26th day of February A.D.1923, and on vote the same was unanimously passed as follows: Forrest Lake Yea Mayor, Commissioner C J Marshall Yea Commissioner.
