B Williams, A &tjr &NageXgrJ J Dickinson, City Attorney, George A_DeCcttes,.,Speoid. Counsel. Minutes last Regular and two special meetings read and approved, Mr Geo. A. DeCottes gave verbal report as to Charter Amendments, stating same would be duly introduced in Legislature by Representative F. Lake. The following Ordinance was offered :s�p AN ORDINANCE PROVIDING FOR THE CONSTRUCTION Cr AN ASPHALT PAVEMENT ON SECOND STREET FROM OAK AVENUE TO FRENCH AVENUE THIRD STREET FROM SANFORD AVE TO MAGNOLIA AVE. AND FROM "OAK AVE. TO AVACADO AVE, AVACADO AVE FROM FIRST STREET TO THIRD STREET FIFTH STREET. FROM MAGNOLIA AVE TO MYRTLE AVE. NINTH STREET FROM CYPRESS AVE TO PARK AVE. THIRTEENTH STREET FROM SANFORD AVE TO FRENCH AVE. CENTRAL.ST. FROM SANFORD AVE TO FRENCH AVE. PALMETTO AVE. FROM CENTRAL STREET TO HUGHEY STREET. PARMITTO AVE. FROM CENTRAL ST TO HUGHEY ST., PALMETTO AVE FROM COMMERCIAL ST TO LAKE MONROE, OAK AVE FROM TENTH STREET TO THIRTEENTH STREET, AND LAUREL AVE FROM SIXTH ST. TO THIRTEEN STREET, AND PROVIDING FOR THE REBATE OF ANY SURPLUS OR EXCESS REMAINING UNEXPENDED Fa SUCH PURPOSES FOR 11HICH ASSESSMENTS HAVE BEEN MADE AGAINST PROPERTY ABUTTING OS..SAIB STREETS AND AVENUES, Whereas, a contract has been let to the Hutton Engineering and Contracting Company, for the paving and improving-of the streets and avenues in the title to this ordinanoe with asphalt, the distances and widths heretofore provided for and designated in a preliminary resolution regarding the improvement of said streets avenues heretofore duly adopted by the City Commission, and, Whereas, the City Commission has fully ratified, approved and confirmed the action of the City Manager of Sanford, Florida, in entering into said contract for the pavement of said streets and avenues with asphalt heretofore made and entered into by and between the City of Sanford, through its Manager, and the said Hutton Engineering and Contracting Company, and Whereas, this ordinance is an emergency measure providing for the usual daily operation of a Municipal Department. Therefore, Be It dnaoted by the City of. Sanford, Florida: SECTION 1. That Second Street from Oak Ave., west to French Ave., Third Street from Sanford Ave. west to Magnolia Ave. and from Oak Ave. west to Avadado Ave.,,.Avaoado Ave.,from First St. south to Third St., Fifth St. from Magnolia Ave. west to Myrtle Ave., Ninth St. from Cypress Ave. West to Park Ave., Thirteenth St. from Sanford Ave. west to French Ave., Central St. from Sanford Ave. west to French Avenue,. Palmetto Ave. from Central St. south to Hughey St., Palmetto Ave. from Commercial St. north to Lake Monroe, Oak Ave. from Tenth St. south to Thirteenth $t., and Laurel Ave. from Sixth St. south to Thirteenth St., shall be paved with asphalt in a000rdanoe with the plans and specifications covering said proposed improvements of said streets and ave- nues now on file in the office of the City Manager of Sanford , Florida, and as incorporated in and made a part of the contract between the City of Sanford, Florida and said.Hutton Engineering and Contracting Company. SECTION 11. Upon the completion of the pavement of the aforesaid streets and avenues the City Manager shall rebate to all abutting property owners owning property on any Of the aforesaid streets and avenues that have been specially assessed, the differeno r, ca 0 ccm O G A pro rata between that proportion of the proposed improvements heretofore assessed against said abutting property and the aotual.00st of the proportion of said improve- merits chargeable to the abutting property . Thereupon Commissioner Chase moved that the rules be waived and said ordinance 1-be placed upon its second reading and final passage which motion was seconded by Commission Marshall and unanimously passed. Said ordinance was then placed upon its second reading read by title only this 14th day of May A.D. 1923. Whereupon Commissioner Chase moved its adoption. Mr A W Pearman, Secretary of Chamber of Commerce came before the Commission re- questing that Pavilion on Bulkhead be transferred to adjoining City Lot. without being destroyed. The matter was referred to City Manager to move same as requested. Communisation from F T Williams Re: advertising signs on Parkways of the City was read and the City Manager was instructed to have same removed. Communication from Mr John Russell Re: Smoke from Millerls Bakery read and the mat- ter was referred to the City Manager. Communication from First National Bank Re: Orders from J B Southatd and Jos. E. Craig, read and filed. Communication from F T Williams enclosing letter from Mr W T Donnelly Re: Dock and Boat Basin read and it was moved by Commissioner C J Marshall, seconded by Commissioner S. 0 Chase, and unanimously passed that Mr Donnelly's suggestions be complied with, and that the City Manager be, and he is hereby authorized to advertise for bids on the con - struotion of Dook and Boat Basin as per specifications submitted by the City Engineer. alb •iii , The following Ordinance was offered.: ORDINANCE #51 AN ORDINANCE REGULATING THE,CONSTRUCTION OF PRIVATE DRIVEWAYS OUT OF OR OVER THE PUBLIC STREETS OF THE CITY OF SANFORD, FLORIDA. TO PROVIDE THEIR MANNER OF CONSTRUCTION; AND TO PROVIDE PENALTIES FOR THE VIOLATION THEREOF. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA SECTIOY,l That it shall be unlawful for any person, firm or corporation to construct any private driveway leading out of or over any public street of the City of Sanford, xa Florida, without first having obtained a permit so to do from the City Clerk, whose duty it shall be to issue such permits without cost upon application duly made therefor. SECTION 2. All private driveways leading out of or over the public streets of Sanford Florida, shall be not less than nine feet in width and shall have concrete or granite curbing on each sideorunning from the street to the sidewalk and-oonnecting with the street curbing, and shall be curved, having not less than five foot radius. SECTION 3 All private driveways leading out or over any public street of the City of Sanford Florida. shall be paved with concrete, not less than four inches in thidknese, constructed in compliance with sidewalk specifications. Or may be pave with brick on saris foundation, or asphalt on compacted rook base five inches in thickness. All Materials used, and work done shall be in conformity to plans and specifications furn- ished by the City of Sanford, under the direction of the Street Department. SECTION 4. Any person firm or corporation who shall violate the provisions of this ordinance shall be punished by a fine of not more than $100.00 or by imprisonment not exceeding 60 days, or by both such fine and imprisonment, in the discretion of the court. _ SECTION 5. All ordinances and parts of ordinances in conflict with the provisions of this ordinance be, and the same are hereby repealed. SECTION -6. This ordinance shall be published one time within ten days in a newspaper, published in the City'of Sanford, Florida. Re.:.free water service for Park sprinklers was ,read and same was accepted and filed. Communication from Southern Utilities Co. Re: Water mains, and delay in obtaining pipe for same was read, and on motion duly seconded and passed, the City Manager was authorized to obtain about 200 ft. of oast iron pipe for this purpose and have same placed at the expense of the Southern Utilities Co. On motion duly seconded and passed the City Manager was authorized to build addition to Jail about 12 x 34 securing entrance from alley instead of through the Fire Department as at present. On motion duly seconded and passed the City Manager was authorized to purchase four wheels for Fire Truck from American LaFrance Fire Engine Co. and to obtain bids on tires for same from local dealers. The Auditor & Clerk was authorized to instruct the Clerk of Circuit Court to cancel of record the following tax certificates. It appearing that the description given in same is defective: 1902 taxes, oertif #134, Face. $1.50 1903 * " lo6 to 1.50 It was moved by Commissioner C J Marshall, seconded by Commissioner Chase and carried that the Manager be authorized to construct a storage and wash house in alley between Myrtle & Oak Ave. near Rater Street for the use of the Sanitary Dept. Communication from Tampa Tribune re: taking advertising space in Special Edition to be published May 27 Inst., after consideration it was moved by Commissioner C J Marshall and seconded by Commissioner 8 0 Chase and carried that the City take two pages at a price of $150.00 per page. Same to be paid for when funds are available therefor. Report of the City Manager for April was read and filed. Report of the Auditor & Clerk for April was read, accepted and filed.
