All of said improving, grading, construction, re- oonstruotion, paving and re- paving be done in compliance with plans and specifications and estimates of said proposed improve meat of First Street from Mill Creek west to the City Limits. now on file in the office of the City Manager of the City of Sanford, Florida, which said plans, specifications and estimates have been heretofore approved by-the City Commission and oonstttute the plans,. . t, IN specifications and estim to for said work. Thereforg be it resolved, that the City Commission of the City of Sanford, Florida, deems it advisable as a necessary public improvement, to pave, re -pave, hard surface and re -hard surface with vitrified brick or other hard surgaos material First Street from Mill Creek west to the City Limits, said improvement of First Street to be of the following widths, to -wit: From Mill Creek west to Jassamine Ave. 24 feet in width, and from Jassamine Ave. west to the corporate limits 19 feet in width, that all of the said paving, re- paviW- har- hard - surfacing, and re -hard surfacing of First Street, as aforesaid -shall be done in strict compliance with the plans , specifications and estimates for said work and improvement now on file in the office of the City Manager of the City of Sanford, Flor as aforesaid, BE IT FURTHER RESOLVED, That a total expenditure of Forty -One thousand Dollars ($41,000.00) is hereby authorized to cover the cost of paving, re- paving, hard- surfacing and re- hardsurfacing of First Street from Mill Creek west to the Citu Limit which said sum of Forty -one Thousand ( $41,000.00) is the total estimated cost of said improvement, that one -third of the total cost of the improvement, aforesaid, shall be borne by the City of Sanford, Florida, and shall be apportioned to be paid from the General Improvement Fund of the City of Sanford, Florida, out of any moneys available thereofr, and the remaining two- thirds of the cost of said improvement shall be as- sessed against all property abutting and fronting upon that portion of First Street to be so improved, and against all lots and lands adjoining and contiguous, or bounding and abutting upon said improvement . BE IT FURTHER RESOLVED, that the total estimated cost of the improvement as aforesaid, of First Street from Mill Creek west to Jassamine Ave. a width of 24 ft, as determined by this Commission is the sum of Twenty -one thousand Ninety Dollars ($21,090.00) that the total estimated cost of the improvement as aforesaid, of First Street from Xassamine Ave. west to the corporate limits, a width of 18 feet, as determined by this commission, is the sum of Nineteen Thousand Nine hundred ten dollars ($19,910.00) that the estimated cost of said contemplated improvement of First Street from Mill Creek west to Jassamine Ave. to be specially assessed against all lots and landesadjoining and contiguous or bounding and abutting upon such improvement, as determined by this Commission, is the gum of Fourteen Thousand Sixty dollars ($14,060.00) and that the estimated cost for said contemplated improvement of First street from Jassamine Ave. west to the oorporate limits to be specially as- sessed against all lots and lands adjoining and contiguous or bounding and abutting upon such improvement, as determined by this Commission, is the sum of Thirteen Thouswkd Two hundred Seventy Three Dollars and Thirty three oents($13,273.33) Be It further Resolved, that it is the determination of this Commission that all lots and lands adjoining and contiguous , or bounding and abutting upon First Street from Mill Creek west to the City Limits, will be specially benefitted by the improvement, provided for by this resolution, and that the special assessments to be MLde against all lots and lands adjoining and contiguous or bounding and abutting upon such contemplated improvement, shall be made upon a foot frontage basis that is to say that in the preparation of the special roll covering the contemplated M Oi M O 6 co w a ,0 583 improvement, such special benefits shall be determined and pro -rated according to the foot frontage of the respeotifve properties speoially benefitted by said improvement. BE IT FURTHER RESOLVED, That the Tax Assessor and City Clerk of the City of Sanford Florida, in accordance with the provisions of Sections 101 and 102 of the Charter of the City of Sanford, Florida, shall proceed without delay to make an assessment roll, assessing the special benefits to be received as the result of the improvement oontem- plated , against all lots and lands adjoining and contiguous or bounding and abutting upon such imorovement, and upon completion of said special assessment roll to cause a copy the of to be published two times successively, once each week, in a newspaper published in Sanford, Florida, attaching to said assessment roll so published, a notice directed to all property owners interested in said special assessments, stating in accordance with the provisions of the Chatter of the City of Sanford, Florida, a definite time and place where complaints will be heard and when said special assessment roll will be finally oon- firmed by the City Commission, sitting as an Equalizing Board, BE IT FURTHER RESOLVED, that the special assessments provided for by this reso- luiton to be made and entered against the property bounding and abutting upon said im- provement shall be payable at the option of the property owners as follows; Either in Rill within thirty days after said assessments shall stand equalized, approved and confirmed, or in ten annual installments, with interest at the rate of Eight per pent per annum upon all deferred payments, from and after the time said special assessments shall be and stand finally equalized, approved, and confirmed BE IT FURTHER RESOLVED, THAT THIS RESOLUTION SHALL BE and become effective imme- diately from and after its passage and adoption. WHEREAS, a survey of that portion of. Palmetto Ave. from the Corner of Palmetto Avenue and Second Street, north to the waters of Lake Monroe, discloses that the various property owners, as well as the City of Sanford, owning property on the east side of Palmetto Ave. from the corner of Palmetto Avenue and Second Street north t the waters of Lake Monroe, have built and constructed permanent brick structures and buildings, which said buildings and structures extend into and are constructed in part on said portion of Palmetto Avenue as said palmetto Avenue is located and shown on and by E R Trafford,s Map of Sanford, Florida, the only official plat at this time in existence, showing the various streets, avenues and alleys of Sanford, Florida, and WHEREAS, the City of Sanford.. Committee of citizens, Mr A E Yowell et al re: bulkheading proposition, made verbal report and after a general discussion all citizens appeared heartily in favor of same provided the cost could be brought within reasonable limits. Colonel G W Knight presented a petition of several hundred citizens asking that election be called at as early a date as practicable to determine the question whether the City of Sanford should issue and sell bonds amounting to 475,000.00 for the purpose Of acquiring and, developatant of Golf Course, parks and fair grounds and athletic field etc. On motion by Commissioner C J Marsbull , seconded by Commissioner S 0 Chase and Passed unanimously the City Attorney was directed to prepare and submit at neat regular meeting of the City Commission an ordinance proposing an issue of bonds for the purpose above set forth. Report of Special Committee from Chamber of Commerce recommending additional paving etc was read, and ordered published. Mr Edward Higgins, President of Chamber of Commerce reported that the Chamber after consultation with Engineer Craig was in favor of eliminating deep wells and substituting shallow wells for water supply as proposed by Engineer Craig. Commissioner C 4 Marshall moved, and it was seconded by Commissioner S 0 Chase that the City Commission proceed at once into negotiations to acquire the City Water works and that the City Manager request Mr Houston of the Southern Utilities Co. to come to Sanford and confer with the City Commission at an early date. f` X 5-C)n City.Manager presented deed from Mr S S Baumel giving City right -of -way through his property extending Palmetto Ave. south from Sixteenth St. Mr G C Fellows was present and agreed to enter into negotiations looking to a right -of -way through his property at point. Mrs J G Leonardy and several other ladies .Dame before the Commission requesting assistance in the matter of Mrs K Hoolihan, now in private hospital and the Commission Weed to contribute $35.00 contingent upon the patient being transferred to City Hos- pital under care of Dr. Marshall. Also in the case of Mrs A L Wilson and children now in indigent circumstances, the Commission agreed to contribute $30.00 toward her support. The above recommendations were moved by Commissioner S 0 Chase and seconded by asioner C J Marshall and passed. Communication from W A Fitts Sr. re: opezling south Palmetto Ave. and other streets same vicinity was read and filed for "�referenoe. The construction of the asphalt pavement on Palmetto Avenue from Second Street south to Fifteenth Street, having been completed, and duly inspected by the Commission, and the City Engineer having made his report th -.t the improvement of said portion of Palmotto Aveni had been made in strict conformity with the plans and specifications therefor, or_ file in the office of the City Clerk, and a final e-,timate having been prepared and submitted by the Assessor, showing the actual cost of said pavement chargeable to all property abutting upon said portion of Palmetto Avenue, the completed paving of Palmetto Avenue from Second Street south to Fifteenth Street was finally accepted by the City Commission and the final assessment roll as submitted by the Assessor, covering said pavement, showing the the actual cost of said pavement chargeable to all property abutting upon said Palmetto Avenue from Second Street south to Fifteenth Street, was Ipproved and cor_f med, and the Clerk was ordered and directed to publish a notiee.to all property owners; owning proper- ty on Palmetto Avenue from Second Street south to fifteenth Street, that the construction of the asphalt pavement on said portion of Palmetto Avenue had been finally accepted,ar_d that the final assessments against abutting property on said portion of Palmetto Avenue,as set forth in said final special assessment roll were payable in full without interest up to September 1st, 1923, and from and after said date, said special assessments would be payable only in ten equal annual installments wit'1 interest at the rate o f eight per -centum per annum on all deferred payments.
