Present: Commissioners Forrest Lake (Mayor), S. 0. Chase and C. J. Marshall;
George A. DeCottes, City Attorney; W. B. Williams, City Manager; Fred T. Williams,
City Engineer.
Minutes of last Regular and Adjourned Meetings read and approved.
Communication from the Pacific Tank & Pipe Co., Re: Redwood Stave Pipe read
and uion due consideration the -City Manager was instructed to re- advertise for bids
on wood stave pipe for Water Works Construction to be opened Sept. Sth, 1924. All
former bids having been unsatisfactory.
Communication from F. T. Williams, Re: Nickels Sidewalk read and filed without
action.
City Engineer presented original Plat of Chapman & Tucker's Addition to Sanford
and on motion seconded and passed he was instructed to have same recorded in the
Seminole County Records.
Petition from some owners of property abutting on Pecan Avenue between Third
Street and Tenth Street requesting that same be paved.a width of 24 feet instead of
16 feet as advertised and the City Engineer was instructed to proceed on this basis.
Petition from some owners of property abutting on Tenth Street between Pecan
Avenue and Mulberry Avenue requesting that isamp..- be�paved a width of 24 feet instead
of 16 feet as advertised and upon motion duly seconded and passed the petition was
not granted as the said Petition doe's not represent a ma at Hof the frontage on
said Street Q.- ���\,
On motion duly seconded and passed the City Engineer was authorized to proceed
with Preliminary Steps for paving Tenth Street from Idyrtlp Avenue to French Avenue
a width of 24 feet with asphalt.
Commissioner C. J. Marshall introduced Resolution #157, entitled:
"A Resolution providing for the paving, re- paving, hard surfacing and re -hard surfac-
ing of Holly Avenue from Ninth Street South to Goldsboro Street, a width of 24 feet."
Thereupon said Resolution was read in full. Upon the reading of said Resolution
the question was put on the adoption of same. Those voting in favor of the passage an
adoption of said resolution were Commissioners Forrest Lake, S. 0, * Chase and C. J.
Marshall. Those voting against the ptipsage and adoption of said Resolution were:
Commissioners None.
Thereupon the Chairman of the Commission announced that the City Commission of
Sanford, Florida had unanimously passed and adopted that certain Resolution, entitled
"A Resolution providing for the paving, re- paving, hard surfacing and re -hard surfac-
ing of Holly Avenue from Ninth Street South to Goldsboro Street, a width of 24 feet."
Thereupon Commissioner C. J. Marshall introduced Resolution #158, entitled::
nA Resolution providing for the paving, re- paving, hard surfacing and re -hard surfac-
ing of Park Avenue from Hughey Street South to Franklin Street, a width of 24 feet."
Thereupon said Resolution was read in full. Upon the reading of said Resolution
the question was put on the adoption of same. Those voting in favor of the passage an
adoption of said resolution were Commissioners: Forrest Lake, S. 0. Chase and C. J.

Marshall. Those voting against the passage and adoption of said Resolution were:

Thereupon the Chairman of the City Commission announced that the City Commission
of Sanford, Florida had unanimously passed and adopted that certain Resolution, entitl
"A Resolution providing for the paving, re- paving, hard surfacing and rehhard surfacing
of Park Avenue from Hughey Street South to Franklin Street, a width of 24 feet.„
Communibcations from Cityr�A,ttorney, George A. DeCottes and G. W. Spencer, Jr., Re:
The partnership relations existing between them read and filed.
Communication from the-Southern Utilities Company offering to sell their entire
Electric Light Plant to the City for the sum of $950,000 dollars was read and filed.
Communication from the City Attorney to Southern Utilities Company answering
above communication was also read and filed.
The City Commission then proceeding as an Equalizing Board, Re: City Tax Roll
for 1924, to.hear complaints if any, heard the following complaints: -
Mr. L. P. McCulley complaining as to assessment on Lots 1 & 2 Bl6ok 11 Tier 6
and on motion duly seconded the Assessor was instructed to reduce assessment on same
from $10,000.00 to $9,000.00.
Mr. G. W. Spencer, Jr., representing F. A. Swan relative to assessment on the
NW4 of SE4 of See-36., Tp.19 S.R.30 E., requesting that same be reduced was heard and
upon motion duly seconded and passed said assessment of $24,000.00 for the year 1924
was approved and confirmed as just and right.
Communication from Mr. J. D. Hood representing the Lake Front Improvement Company
requesting that 1924 assessment on all the property of said Company be made nto conform
to the assessment for 1923 and same was read and on kotion duly seconded and passed the
Assessor was instructed to comply with thi• request.
Mr. 0. P. Herndon appeared before the City Commission relative to repairing house
injured by falling tree and the matter was referred to the City Manager to make proper
adjustment of same.
Commissioner C. J. Marshall offered Resolution No.159, entitled:
"A Resolution Prescribing the form and Details of an Issue of Public Utility
Bonds by the City of Sanford, Florida, in the sum of One Hundred and Sixty Thousand
Dollars, providing for the levy of an Annual Tax upon all Taxable Property Within the
City of Sanfbrd, Florida, sufficient to produce eac7A year the Necessary Amount of Money
to Pay the Interest on Said Bonds and to Create a Sinking Fund for the Purpose of the
Retirement of said Bonds at the Maturity Thereof."

ANNUAL TAX UPON ALL TAXABLE-PROPERTY WITHIN THE CITY OF SA.NFORD,
FLORIDA, SUFFICIENT TO RPODUbE EACH YEAR THE NECESSARY AMOUNT OF
MONEY TO PAY'THE INTEREST ON SAID BONDS AND TO CREATE A SINKING

Whereas, at a regular meeting of the City Commission of the City of Sanford,
Florida, held on the 10th day of December, 1923, this Commission did duly enact and
adopt a certain ordinance numbered 69 entitled;
"An Ordinance Providing for the Acquisition and Establishment of a Gas Plant or
Plants by the City of Sanford, Florida, to be Maintained and Operated as a Public Util
ity, and Providing for an Issue of Utility Bonds by the City of Sanford, Florida, in t
Sum of One Hundred and Sixty Thousand Dollars, the Proceeds to be Derived from the
Sala Thereof to be used to Acquire, Establish, Purchase and Construct a Gas Plant or
Plants ", and
Whereas, this Commission did further cause an order to be adopted, calling an
election to be held in the City of Sanford, on the 11th day of January, A. R. 1924, to
determine the question at said election whether the o®dinance aforesaid should be
adopted, approved and confirmed by the electors of the City of Sanford, Florida, and
whether the bonds provided for in said ordinance should be issued by the City of San-
ford, Florida, in the manner and for the purposes in said ordinance provided and set
forth, and
Whereas, in full and strict compiance with all the requirements of law, and at
the time and place desigmated in said notice of election, an election was duly held in
the City of Sanford, Florida, on the said 11th day of January, 1924, and as the result
of said election, the aforesaid ordinance, numbered 69, was adopted, approved and con-
firmed by the blectors of the City of Sanford, Florida, and by said election it was
further determined that the bonds provided for in said ordinance numbered 69, should be
issued by the City of Sanford, Florida, in the manner and for the purposes in said
ordinance provided and set forth, and
Whereas, the question of issuing bonds for the purpose specified in said
ordinance, 69, had not been submitted to the voters of the City of Sanford, Florida,
within one year prior to January 11th, 1924, and
Whereas, in strict compliance with the requirements of law, the City Commission
of the City of Sanford, Florida, did, subsequent to the date of said election., hold a
meeting and proceed to canvass the returns and result of said election, and at said
meeting it unanimously adopted a resolution declaring the said election to be in favor
of the adoption, approval and confirmation of said ordinance 69, and in favor of the
issuance of the bonds provided for in said ordinance 69, and
Whereas, subsequently, by a decree and judgment of the Circuit Court of the
Seventh Judicial Circuit of the State of Florida, dated the 6th., day of February, 192 ,
and duly entered and recorded on the 7th., day of February 1924, in Chancery Order Boo
N0.5, on page 21, the said bonds provided for in said ordinance 69, in the aggregate
sum of One Hundred and Sixty Thousand Dollars, for the municipal purpose provided for
in said ordinance, were validated and confirmed, which judgment and decree of the Cir-
cuit Court of the Seventh Judicial Circuit of the State of Florida, is now in Rill
force and effect and unappealed, and the propriety and finality of which said judgment
and decree, since its rendition, has in no manner been challenged or questioned, and
Whereas, all precedent conditions and requirements imposed by law to exist,

happen and be performed before said bonds, or any-part thereof, osn be lawfully
issued, do exist, have happened and have been performed, and
Whereas., the date, form and details of said bonds, and the interest coupons
to be attached thereto, and the special tax to be annually levied to pay the in-
terest on said bonds and create a sinking fund for the retirement of said bonds at
maturity, not having been properly desAgnated, and it now being destled that the
same be so indicated,
Therefore, Be It Resolved: That bonds of the City of Sanford, Florida, in the
aggregate sum of One Hundred and Sixty Thousand Dollars, provided for by said
ordinaAbe 69, as Approved and confirmed by the electors of the City of Sanford,
Florida, be issued, said bonds to bear a rate of interest of five and one -half (5j)
per centum per annum, to be of the denomination of One Thousand ($1000.00) Dollars
each, and to be numbered froft 1 to 160, both numbers inclusive, to be dated July 1st
1924, and.to mature July 1st, 1954, both principal and interest of said bonds shall
be payable at The Chase Naticnal Bank, in the City of New York, State of New York,
in lawful money of the United States of America, interest payable semi - annually on
January first and July first of each year, said bonds shall be signed by the Mayor
of the City of Sanford, Florida, and the Clerk of the City of Sanford, Florida, and
shall have affixed thereto the seal of the City of Sanford, Florida; the interest
coupons to be attached to said bonds to be signed with the engraved or lithographed
fac- simile signatures of said Mayor and said Clerk; said bonds and coupons, with the
necessary variations as to dates and numbers, and the certificate4,of validation
thereof, shall be substantially in the following form, to -wit:

Florida, a municipal corporation, duly organized and existing under and in pursu-
ance of the Laws of the State of Florida, for value received, acknowledges itself
indebted, and promises to pay to the bearer hereof the sum of
ONE THOUSAND DOLLARS,
in lawful.money of the United States of America, on the first day of July, A. D.
1954, with interest thereon at the rate of five and one -half per centum per annum,
payable semi- annually, January first, and July first of each year, on presentation
and surrender of the interest coupons hereto annexed as they severally become due,
both principal and interest being payable at The Chase National Bank, in the City
r of New York, State of New York.
This bond is one of,,,& series of one hundred and sixty bonds, aggregating One

Government for the Same, and to Prescribe the Jurisdiction, Powers and Functions
of said Municipality,"
and pursuant to Ordinance No. 69, of the City of Sanford, Florida, entitled:
"An Ordinance Providing for the acquisition and Establishment of a Gas Plant
or Plants by the City of Sanford, Florida, to be Maintained and Operated as a Publ
Utility, and Providing for an Issue of Utility Bonds by the City of Sanford, Florida,
in the sum of One Hundred and Sixty Thousand Dollars, the Proceeds to be Derived
from the Sale Thereof to be used to Acquire, Establish, Purchase and Construct a
Gas Plant or Plants,"
pursuant to a vote of a majority of the qualified electors residing within the
boundaries of the said City of Sanford, Florida, at an election duly and legally
called, held and conducted on the 11th day of January, A. D; 1924, the ballots cast
at said election and the vote and returns thereof having been duly canvassed, pro-
claimed, certified, filed, recorded, and declared as required by law, and also pur-
suant to certain orders and resolutions of the City Commission of the City of
Sanford, Florida, duly had and adopted.
It is Hereby Certified, Recited and Declared, that all acts, conditions and
things required by law to exist, happen and be performed, precedent to, and in the
issuance of this bond, have existed, have happened and have been performed in
regular and due time, form and manner, as required by law, and that�:the amount of
this bond, together with all other indebtedness of the City of Sanford, Florida,
does not exceed any limit prescribed by the Constitution and Statutes of the State
of Florida, and that before the issuance of this bond, provision has been made by
resolution of the City Commission, to assess, annually, a tax upon real and persona
property, railroads, telegraph and telephone lines, owned or situated within the
City of Sanford, Florida, to realize a sum sufficient to pay the interest upon this
bond, as it may become due, and to* create a sinking fund for the payment of the
principal hereof at the maturity of same, and that the issue of bonds, of which thi
bond is a part, has been duly confirmed and validated by a decree of the Circuit
Court of the Seventh Judicial Circuit of the State of Florida, in and for Seminole
County, in a proceeding begun by the City of Sanford, Florida, a municipal corpora-
tion, against the State of Florida, of which proceeding due notice was duly and
regularly given to the State of Florida and to the public. And for the payment of
the principal and interest of this bond, the full faith and credit of the City of
Sanford, Florida, is hereby irrevocably pledged.

BE IT FURTHER RESOLVED that after said bonds have been executed as herein
provided, they shall be presented to the Clerk of the Circuit Court of the Seventh
Judicial Circuit of Florida, in and for Seminole County, for the purpose of having
endorsed thereon a certificate of validation in the form hereinabove prescribed, and

able property of said City a tax sufficient to meet said deficiency, it being the
intention of the said City to provide for the payment of the principal and interest
of said bonds primarily out of the net income, revenue and profits derived from the
operationnof thegas plant or plants of the City of Sanford, Florida, but the full
faith and credit of the City of Sanford, Florida is hereby irrevocably pledged for
their payment, and if necessary there shall be levied annually upon all the taxable
property of said City, while said bonds remain outstanding and unpaid, a tax suf-
ficient to provide funds for the payment of the interest accruing from time to time
on said bonds, and to pay the principal thereof at maturity, and

the sale and award thereof, same shall be duly executed by the Mayor and the Clerk

Therefore, Be It Resolved: That bonds of the City of Sanford, Florida, in
the aggregate sum of Seventy -five Thousand Dollars, provided for by said ordinance
70, as approved and confirmed by the electors of the City of Sanford, Florida, be
issued, said bonds to gear a rate of interest of five and one -half (5-Z') per centum
per annum, to be.of the denomination of One Thousand ($1000.00) Dollars each, and
to be numbered from 1 to 75, both numbers inclusive, to be dated July 1st., 1924,
and to mature July 1st., 1954, both principal and interest of said bonds shall be
payable at The Chase National Bank, in the -City of New York, State of New York, in

January first and July first of each year, said bonds shall be signed by the Mayor
of the City of Sanford, Florida., and the Clerk of the City of Sanford, Florida,

This bond is one of a series of seventy -five bonds, aggregating Seventy -five
Thousand Dollars, of like date, tenor and maturity, issued by the City of Samford,
Florida, for lawful, municipal purposes, in strict comformity with the Constitution
and Laws of the State of Florida, including among others, Chapter 9597, Laws of
Florida, 1923, entitled:
"An Act to Abolish the Present Municipal Government of the City.of Sanford,
Seminole County, State of Florida, and to Organize, In and Establish a City
Government for the Same, and to Prescribe the Jurisdiction, Powers and Functions of
said Municipality,"
and pursuant to Ordinance No-70, of the City of Sanford, Florida, entitled:
"An Ordinance Providing for an Issue of Bonds by the City of Sanford, Flori
in the sum of Seventjt -five Thousand Dollars, the Proceeds to be Herited from the
Sale Thereof to be used to Acquire, Build, Vonstruct and Equip With the Necessary
Furniture and Fixtures, a City Hall and Administration Building,"
pursuant to a vote of a Majority of the qualified electors residing within the
boundaries of the said City of Sanford, Florida, at an election duly and legally
called, held and conducted on the 11th day of January, A. D. 1924, the ballots cast
at said election and the vote and returns thereof having been duly canvassed, pro-
claimed, certified, filed, recorded and declared as required by law, and also pursu
ant to certain - orders and resolutions of the City Commission of the City of Sanford
Florida, duly had and adopted.
It is Hereby Certified, Recited and Declared, that all acts, conditions and
things required by law to exist, happen and be performed, precedent to, and in the
issuance of this bond, have existed, have happened and have been performed in rea l
and due time, form and manner, as required by law, and that the amount of this bond
together with all other indebtedness of the City of Sanford, Florida, does not ex-
ceed any limit prescribed by the Constitution and Statutes of the State of Florida,
and that before the issuance of this bond, provision has been made by resolution of
the City Commission, to assess, annually, a tax upon all real and personal pro,- ,erty,
railroads, telegraph and telephone lines, owned or situated within the City of San-
ford, Florida, to realize a sum sufficient to pay the interest upon this bond, as i'
may become due, and to create a sinking fdtnd for the payment of the principal here-
of at the maturity of same, and that the issue of bonds, of which this bond is a
part, has been duly confirmed and validated by a decree of the Circuit Court of the
Seventh Judicial Circuit of the State of Florida, in and for Seminole County, in a
proceeding begun by the City of Sanford, Florida, a municipal corporation, against
the State of Florida, of which proceeding due notice was duly and regularly given
to the State of Florida acid to the public. And for the payment of the principal and
interest of this bond, the full faifh and credit of the City of Sanford, Florida, 14
hereby irrevocably pledged.

BE IT FURTHER RESOLVED that after said bonds have been executed as herein
