080627CITY COMMISSION, SANFORD, FLORIDA, MINUTES Adjourned Neeting August 6th 12N 19. 2~ The City Commission of the City of S~nford, Florida met in adjourned session at Noon on the 6th d~y of August A.D. 192? in accordance with the provisions of Sectio~ 130 of the Charter of the City of Sanford, Florida, to canvass the returns of the Special Referendum Charter Amendment election held throughout the City o£ $~nford, Florida, on August 5th 1927. Present: Commissioners S.O.Chase and E F Housholder. Absent: Eayor - Con~issioner Fort,st Lake. Also present: City Attorney George A DeCottes, City ~anager W. B Williams, and City Clerk L R Philips. On motion of Co~mmissioner S 0 Chase, Commissioner E F Housholder was elected temporary Chairman. The number of votes cast agairst the adoption of Charter of the City of Sanford Florida. the amendment Section 124 of the Charter 511 votes. of Section 124 of the 456 votes. The number of votes cast for the adoption ~f Section 7, of the Charter of the City of S~m. ford Florida. 465 votes. The nun~ber of votes cast against the adoption of Section 7 of the Charter of the City of Sanford, Florida. 486 votes. · hereupon, the following order and resolution was duly passed and adopted.: ~EREAS, the returns of the Election ordered to &e held on August 5th 1927 throughout the City of Sanford, Florida, for the approval or rejection of certain proposed amendments and the approval of Section 7 of an Act the City of S~nford , entitled: the City Charter of the City of S~n£ord, Florida, entitled: "AN ACT to amend sections, 8, 13, 59, 99, 124 of the Charter of Florida, the same being Ch~oter 9897 Laws of Florida, Acts of 1923 to 484 votes 468 votes 526 votes 437 votes 511 votes 456 votes 59 and 124 of the Charter of the City of Sanford. BE IT FURTHER RESOLVED, and it is hereby declared, that the result of said election held of August 5th 1927 as aforesaid, shows that a majority of voters participating in said electiion voted against the adoption of the ~uen~nent of Sections S and 99 of the Charter of the City For m~endment of Section 13 Against amendment of Section 13 For amen&nent of Section 59 Against amendment of Section 59 For amendment of Section 124 Agai,~st amendment of Section 124 therefore, said amendments to Sections 13, Florida, now become operative. "An Act to abolish the present ~lunicipal Government of the City of Sanford , Seminole County, State of Florida, and to organize and incorporate and establish a City Government for the same, ~nd prescribe the jurisdiction, powers and functions of said Municipality" the aforesaid sections relating to the number of City Commissioners of said City of S~uford and their terms of offfice , the number of members of the City Commission of said City of Sanford necessary to constitute a quorum, the Municipal Court of said City af Sanford, and compensation of the Judge thereof, the yearly budget of the City of Sanford, and the levy of taxes therefor, the making of public improvements and repairs in streets and assess- ments of the costs thereof, the time of the regular municipal elections of said City of Sanford, and to provide for an election of a ~ayor of s~-id City of Sanford," have been made to this Co~nission by the Clerk and Inspectors of said Election; and ?~EREAS, said returna have been duly canvassed by said Commission, therefore, BE IT RESOLVED, and it is hereby declared, that the result of said election held on August 5th. 1927 as aforesaid, shows that a majority of voters participating in said election voted for the adoption of the amendment of Sections 13, 59 and 124 of the Charter of the City of Sanford, Florida , the votes on said amendments being as follows: CITY COMMISSION, SANFORD, FLORIDA, MINUTES 19 27 For Amend~nent of Section 8 485 Votes. Against ~he ~J~endment of Section 8 507 Votes For the amen~uent of Section 99 4?8 votes. Agair~t the amen&ment of Section 99 481 votes For the adoption of Section 7 465 votes Against the adoption of SectiOn ? 486 votes Therefore, said ~uendments to Section 8 and 99 and said Section y have and do not become operative. been rejected BE IT F~THER RESOLVED, and it is hereby declared that the result of said election held on August 5th 1927 as aforesaid, shows that the vote on the amen&merit of Section 26 of the Charter of the City of Sanford, Florida was a tie vote, said vote being as follows: For the amen&ment of Section 26 48y votes Agai ~t the amendment of Section 26 487 votes therefore, the vote on said amen&nent being a tie vote, said amendment has been neither rejected or adopted. Upon motion of D~ S 0 Chase, unanimously adopted, the Clerk was directed to return to the b~llot box tally sheets and reoort of the Clerk and Inspectors of the election and then to re-seal said b~llot box, lock same and place said ballot box in his v~nlt in his office for safe keepin~ and to keep the key or keys of said ballot box in his safe. Thereupon, the Clerk , in compliance ~ith said Order, returned to the ballot box the t~lly sheet, report in d~olicate of the Clerk and Inspectors of the election and re-sealed and re-locked said b~llot box in the presence of the Cormnissioners in open session and also in the presence of George A DeCottes, ~ B ~illiams, Chief of Police Williams, S N RiChard, S L Smart and George W HcRory.
