MINUTES Adjourned Meetin~ October 14 at I P ,9 27 The City Commission of the City of Sanford Florida met in adjourned session of Regular Meeting at the City Hall at Sanford, Florida at On~ O'Clock P M , October 14th. 1927. Present: Commissioners E F Housholdar , M~yor W 0 Hill City Attorney, George A DeOottes City Manager, W B Williams City Engineer, Fred T Williams City Clerk, L R Philips Absent: Commissioner, S 0 Chase The meeting was called to order by the Chairman and the City Clerk was ordered to read the minutes of the previous meetings. Pursuant to this request the City Olerk read the minutes of meetings of the City 0ommiesion held on September 26th, September 2?th, September 30th and October 5th, which minutes were approved. A communication was read to the Commission from the City Attorney with regard to the proposed project of hydraulic fill in the West Side Bulkhead District from where the work is completed Eastward by the County to the present reclaimed bulkhead district, ad- vising the 0ommission that, considering the present state of' the finances of the City of Sanfor Florida, no ways and mans could at this time be devised by which funds could be acquired by the City for the completion of said proposed project. Thereupon, upon motion of Commissioner W C Hill, which unanimously prevailed, the recommendation of the 0ity Attorney as contained in his communication on the subject of fill on the West Side was approved and accepted, and thereupon, the City Attorney stated that there was a possibility that funds might be provided for said proposed project provided the property owners interested along the route of the proposed fill would be willing voluntarily to! accept assessments against their property abutting said fill proportionately according to foot frontage in an amount sufficient to produce the mum required to cover the cost of s aid proposed! fill, and stated further that the legal machinery authorizing a voluntary acceptance of an assessment of this nature had already been set up in the proceeding:authorizing the improvementl of the West side Bulkhead District. The City Attorney further advised that even if this plan could be worked out, it would involve the raising of funds to the extent of $100,000 more than now contemplated in the refinancing plan and he could not yet definitely advise whether any investment banker in offering to refinance the City would consider, in connection with said refinancing, the advancement of the additional sum of $100,000 which will be required for use in the completion of said project, assuming that after the fill has been completed there will be some further improvement of said fill in the widenirg of the proposed highway to be constructed by the State Highway Department or in furnishing adequate drain sewerage for said road bed. Co~nmunications were read by the City Clerk f rom the City Attorney addressed to the 0ity Commission, three in number, regarding the proposed sale of $155,000 Oity of $anford Florida 5~% street improvement bonds. In one of said communications, the City Attorney advised the Commission that all bids received at the advertised sale of October 5th. for the purchase of the above issue of bonds should be rejected. The second communication advised CITY COMMISSION, SANFORD, FLORIDA, MINUTES October 14 standing vouchers in its possession, and when directed to proceed with said investigation, the same would be handled to conclusion as rapidly as possible and the report would be rendered jointly by the City Attorney and his associate counsel passing on the legality of the claim of the Hutton Construction Company. It was moved by Commissioner W C Hill and unanimously adopted that all bids received on October 5th for the purchase of $155,000~ City of Sanford Florida , 5~% street paving bonds be rejected, and the Clerk was instructed to return to the bidders their good faith checks/ It was moved by Commissioner W C Hill and unanimously adopted that for the present that the City of Sar_ford Florida defer action on the sale at private sale of $155,000 City of Sanford, Florida 5~% street paving bonds. It was moved by Commissioner W C Hill and unautmously adopted that the City Attorne~ together withhis associate counsel, Lucien H Boggs, proceed at once to make an investigation of the claim of the Hutton Construction Company against the City of Sanford, Florida, based on certain unpaid vouchers in its possession heretofore issued unto it by the City of SanfOrd Florida, for paving construction, and to report in w~iting over their joint signatures their findings as to the validity of all claims of Hutton Construction Company against the City of Sanford, Florida based on said vouchers, and that said report be rendered unto this Com- mission with the least possible delay. Nr ~ B Hutton, President oS the Hutton Construction Company, appeared before the City Commission stating that he w~s ready to purchase at private sale at a legal and law- fulprice the $155,OO0 City of Sanford, Florida 5~% street paving bonds, and after a thorough discussion of the matter was advised by the Chairman of the action just taken by the Commission~oon advice from their attorney to defer action on the sale at private sale of this issue of bonds. N~Hutton was also advised of the action taken by the ~City Commission in- structing their attorney, together with his associate counsel, to make a thorough investi- gation to ascertain the validity of the vouchers in the possession of Hutton Const=uction Company heretofore issued to Hutton Construction Company by the City of Sanford, Florida. N~ Hutton was further advised that this investigation was not only going to be conducted with regard to the vouchers held by the Hutton Construction Company, but all outstanding vouchers heretofore issued by the City of Sanford, Florida. It was recommended that action be taken through the Legal Department to proceed to enforce payment of all delinquent taxes due the City of Sanford, Florida, which have been past due for a period of two yea~s. It was further recommended by the City Attorney that vigorous action be taken compelling property o~ers to pay past due street paving special assessments now delinquent, and thereupon, after a short discussion of the matters, action on the recommendations of the City Attorney was deferred to a subse~uent meeting. The City Attorney reco~nended that ordinances be enacted repealing the bond- ing ordinances heretofore enacted, authorizing the issuance of $400,000 in bonds , the proceeds to be used on Nunicipal Docks and Wharves; the unsold issue of $50,000, the proceeds to be used for municipal fire stations; the unsold issue of bonds in the sum CITY COMMISSION, SANFORD, FLORIDA,_ MINUTES October 14 After~a short discussion, action was deferred to a subsequent meeting. It was further recommended by the City Attorney that two resolutions appearing in the minutes of the meetings of the City Commission, one on Oca~er ~, 1925 ~nd one on February ~,1926 with regard to purported authorization of temporary financing of the re- quirements of the City,be by resolutions duly rescinded and vacated. The City attorney was directed to prepare the necessary resolutions vacating the two resolutions referred to. The manner in which the salaries were to be paid to the employees of the public library was brought before the Oommission by the City Clerk and after a short discussion, the Clerk was directed that in the futures all salaries payable to the employees of the public library be vouchered through the 0ity Auditor's office and that all bills payable for the operation of the library be likewise vouchered through the City Auditor's office. The matter of the purchase of new officer,s uniforms was ~brough before the Commissio~ by Acting Chief of Police Martin, who was advised by the Ohairman that he sould accept the lowest and most satisfactory competitive bid on these uniforms. The City ~auager appeared before the Commission and advised that the Acting Ohief of Police recommended the appointment as temporary patrolmen, $ C Gardner, D K McNab, and as special officer, C C Flinn. Thereupon, upon motion of Commissioner W C Hill which unanimous- ly prevailed, the appointment of S C Gardner, D K McNab, as temporary patrolmen and C C Flinu~ as special officer of the City of Sanford, was approved. The Acting Chief reported to the Ci~ty Manager that he had designated as temporary Acting First Lieutenant of Police, G V Phillips, and said temporary appointment of the Acting Chief of Police was approved. Upon the request of the Commission, the City Attorney advised that boxing exhibitioms held by the National G-e_vd under i~s auspices were not subject to the payment of any occupational license tax for the conduct of such exhibitions, and the City Manager was direct- ed to ascertain to his own s~tisfaction that any boxing exhibitiQns conducted in the City in the National Gue~vd Armory were being conducted under the auspices of the National Guard. The Clerk was directed to issue two checks to George A DeCottes, one in the sum of $1OOO.00 and the other in the sum of $750.00 applying as a credit on voucher 4568 On motion of Commissioner W C Hill, u~imously adopted, providing that Acting Chief of Police Martin with Police Judge W E White, pass on the ~ases of all prisoners of heretofore the City of $anfor-~'~aroled and make such disposition of these cases as in their Judgment deemed best and make a report of their actions in the premises in writing to this Commission at its next meeting. Report of the City Manager for the month of September was submitted and ordered filed. There being no further business, upon motion made and duly seconded, the meeting was adjourned.
