MEETING December 9 ~9 97 Exhibit "B" to minutes of December 8, 1997 Regular Meeting MINUTES Meeting between Mayor Larry Dale, representing Sanford City Commission and Commissioner Tom Green, representing Lake Mary Commission, to agree on final details for agreement between the two cities, Hills of Lake Mary Homeowners Association, and Twin Lakes Garden Apartments, Inc., 4:10 P.M. on December 9, 1997. This document is prepared in response to the request from the City Clerk to provide outline minutes for I ae subject meeting. The meeting convened at 4:10 P.M., December 9, 1997 at the Seminole County Services Building, Roem 3024. Those in attendance included Mayor Dale, Commissioner Green, Cecil Thompson, representing Hills of Lake M~,ry Homeowners Association, Jim Hattaway, representing Twin Lakes Garden Apartments, Inc., John Litton, Lake Mary C ty Manager, and William Simmons, Sanford City Manager. The newly prepared proposed agreement was discussed in detail. It was noted that all changes discussed at t ~e 7:00 A.M. meeting had been made, including the preparation of an addendum agreement, which would be signed by all parties except City of Sanford. This addendum agreement addressed Sections 5H, 51 and 6 which had previously been included in the basic agreement but it had been agreed that it was not appropriate for inclusion in the agreement signed by City of Sanfo: d. It was further noted that an item requiring installation of a fountain at the entrance to the apartment complex was not included in the new agreement. In response to questions, Jim Hattaway advised that the architect for the developer had strongly recommended against making that commitment before additional design work had been done to ensure installation would 5e feasible. This situation caused considerable consternation on the part of Commissioner Green and Mr. Thompson. TL~e remainder of the agreement was reviewed and agreement reached on minor revisions, including correction of the specified d~ te of the agreement. Mr. Hattaway was advised by Commissioner Green and Cecil Thompson that neither would sign t~e agreement which did not provide for the fountain. Mr. Hattaway attempted several times, unsuccessfully, to reach his client to obtain his client' s agreement to include the fountain. When Mr. Hattway was unsuccessful in this endeavor, Mayor Da7 e, Commissioner Green, and Mr. Thompson agreed to have the agreement redrawn to include the fountain feature, proceed :o sign the agreement, and present it to Mr. Hattaway for action as appropriate by his client, including the signature of the propel .y owner and developer.
