121597 Exhibit CE718672 MINUTES City Commission, Sanford, Florida MINUTES A meeting was held on Monday, December 15, 1997 at 11:00 a.m. in the Building Department Conference Room, Lake Mary City Hall, Lake Mary, Florida, to discuss a proposed Agreement regarding Twin Lakes Garden Apartments. Present: Mayor Larry A. Dale, Sanford Attorney Jim Hattaway, representing Wally Devlin Wally Devlin City Manager John Litton, Lake Mary Commissioner Thom Greene, Lake Mary Cecil Thompson, President, Hills of Lake Mary Homeowners' Association Also present: Elaine Backhause, Orlando Sentinel Reporter At the Sanford City Commission's December 8, 1997 Regular Meeting the City Commission authorized Mayor Dale to sign on behalf of the City Commission, an Agreement with the City of Lake Mary, the Hills of Lake Mary Homeowners Association, Ira Southward (land owner), and Wally Devlin (Developer). This Agreement, which would run with the land, would allow an appeal under consideration to be dropped. This Agreement was reached and signed later Monday afternoon by all parties. Mayor Dale executed the Agreement at approximately 1:25 p.m. A copy of the Agreement has since been forwarded to City Hall. The meeting lasted approximately two and one-half hours. Some oft he discussion regarded contention between the Hills of Lake Mary President Cecil Thompson and the Developer over the issue of a Comprehensive Plan Amendment designation of ROI (Residential, Office and Institutional) versus Mr. Thompson' s belief that it should be MR-15. After debate and discussion this issue was resolved. There was also discussion regarding an Amendment and Addendum to the Agreement, of which the City of Sanford had no part. The disagreement appeared to be about payment by the Developer to the City of Lake Mary of attorney's fees billed to date from Skip Fowler, Lake Mary's attorney. It is understood that agreement was reached.
