PUBLIC HEARING
IN RE: APPEAL FROM THE DECISION OF THE HISTORIC PRESERVATION
BOARD TO DENY A CERTIFICATE OF APPROPRIATENESS TO INSTALL
50 AIR CONDITIONING UNITS BY CUTTING 41~ INCH X 18 INCH
HOLES IN WALLS AT 1401 MAGNOLIA AVENUE, SANFORD, FLORIDA.
The City Con~nission based on the clear and convincing evidence
contained in the record before the Historic Preservation Board
(HPB) on February 14, 2002, makes the following FINDINGS OF FACT,
CONCLUSIONS OF LAW, and enters the following ORDER:
FINDINGS OF FACT
(1) That the property at 1401 Magnolia Avenue, Sanford, Florida,
is a former school building undergoing renovation, and part of the
renovation is a request to install fifty (50) air conditioning
units by cutting 50 18 inch x 41~ inch holes in the brick walls.
(2) That on February 14, 2002, the HPB denied a Certificate of
Appropriateness to install fifty (50) air conditioning units by
cutting fifty (50)-41~ inch x 18 inch holes in the walls at 1401
Magnolia Avenue.
(3) That at the time the HPB considered the request there were
no photos or illustrations provided to show what the units would
look like when installed, and that subsequent to the HPB'S denial
the applicant submitted pictures of one installed air conditioning
unit.
CONCLUSIONS OF LAW
(1) This cor~nission finds that the HPB is the appropriate board
to consider all the evidence and take action thereafter.
ORDER
THEREFORE, IT IS OWERED that the Appellant/~plicant's
re~est to overturn the HPB'S denial of a Certificate of
Appropriateness On Feb~a~ 14, 2002, is remanded back to the HPB.
