The City Commission based on the clear and convincing evidence presented on February 9, 2004, makes the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and enters the following ORDER: (1) That the property at 104 South Park Avenue, Sanford, Florida, is subject to Schedule S of the Land Development Regulations, and that Schedule S, Section 8.0, C. Standards for new Construction, Additions and Alterations, Windows and Doors requires that when existing windows that are inappropriate to the style and period of the building are being replaced that they be replaced with new windows that are appropriate to the style and period of the building. (2) That Schedule S, Section 7.0, E. Variances to the Standards of Schedule S permits window materials to be replaced with the same or like materials when the general intent of Schedule S is accomplished from a visual perspective. (3) That on January 8, 2004, the Historic Preservation Board (HPB) denied a Certificate of Appropriateness to replace aluminum windows with aluminum windows at 104 South Park Avenue because aluminum windows are inappropriate to the style and the period of the building. CONCLUSIONS OF LAW (1) This commission finds that the proposed replacement of aluminum windows with aluminum windows at 104 South Park Avenue will accomplish the general intent of Schedule S from a visual perspective and therefore is appropriate. IS ORDERED that the Appellant/Applicant's aluminum windows with aluminum windows at 104 THEREFORE, IT request to replace South Park Avenue is approved and the HPB's denial of a Certificate of Appropriateness on January 8, 2004, is overturned.
