Mr. E.C.Smith Jr. next appeared on be~lf of the Seminole County C~pter of the American Red Cross and requested a contribution towa~ the Red Cross War Fund, of which Seminole County's quota Is $8,500.00 Thereupon after careful consideration It was felt t~t this request ~' for a wort~ cause, and on mo~ion of Commissioner Hill, seconded by Commissioner ~dge and carried, a donation In amount of $65.00 was authorized for the American ~d Cross War Fund. Scribner's Laboratories at Orlando, next presented, such report showing all such milk within the requirements of "grade A milk." On motion duly carried, the Co.mission next apnroved the execution of the following lease agreement with the Universal Concrete Pine Company, which was authorized by the Commission at the adjourned meeting of December 3,1942: THIS LEASE, Made and entered into in dunlicate as and of the l~th. day of March 1943 between CITY OF BANFORD, F~ORI~A, a municipal corporation, of Seminole County, Florida, hereinafter referred to as LESSOR and UNIVERSAL CONCRETE PIPE COMPANY, INCORBORATED, a corporation organized and existing under the laws of the State of West Virginia, of 297 South High Street, Columbus, Ohio, hereinafter referred to as LESSEE, WITNESSETH: THAT the said LESSOR for and in consideration of the rentals to be paid by the LESSEE as hereinafter stated and the other covenants herein to be contained, on the part of the LESSEE to be performed, the LESSOR has leased and let and by these presents does lease and let unto the LESSEE the following described lot, piece or parcel of land situate in Seminole County Florida, to-wit: Subdivision of ~arts o[ ..... ~ ~ ~o ~,,hliC records of Seminole East, as recorded in Pla~ DOO~ 1, page County, Florida. TO HAVE AND TO HOLD the above described nremises unto the LESSEE for and during a term of three years beginning on the l~th. day of March, 1943, and ending on the l~th. day of March , 1946, at and for a rental of Three Hundred and no/lOC ($300.00) Dollars for the first year of said term; Four Hundred and no/lOC ($400.00) Dollars for the second year of said term amd Five Hundred and no/lOC ($500.00) Dollars for the third year of said term, the first year's rental having been ~ei~ upon the execution and delivery of this lease and each of the remaining two years' rentals to be ~id in advance at the beginning of each year thereof. The LESSEE has leased the above described premises of and from the LESBOR for the aforesaid term and covenants and agrees to pay the remainder of the aforesaid rentals therefor when and as the same she, ll become due and payable, the first year's rental having been naid upon the execution and delivery of this lease. THE LESSEE further covenants and agrees as follows: 1. To maintain and keep the present buildings on the above described premises in a state of sound repair. 2. To keep the building now or hereafter erected upon the above described premises insured to their full insurable value against all risk of damage or destruction by fire or windstorm, wit~ loss payable to the LESSOR. In the event of the damage or destruction at the op- by fire or windstorm of said oremises, the proceeds of said insurance may , tton of the LESSOR, be employed to restore or repair the building so damaged or destroyed. In the event said oroceeds are not so employed, this lease shall terminate without any liability on the part of either the LESSOR or LESSEE. 3 Ail buildings or other structures erected by the LESSEE upon the above described premises during the term hereof shall be and become a part of the premises and the prop- arty of the LEBSEE at the end of the term hereof or upon earlier termination of said lease. 4. That default for a period of thirty (TO) days in paying any of the rentals becoming due hereunder or in paying before they become delinquent all taxes that may be levied or assessed against the above described premises during the term hereof or in keeping the buildings on said Premises in a state of sound repair or in keeping said buildings insured as herein required, shall cause this lease to immediately termi- nate and said premises shall thereupon be surrendered to the LESSOR, its successors or assigns, and the LESSOR, its successors and assigns, shall have the right to re- possess said premises without the necessity to resort to process of law therefor. The LESSOR hereby gives and grants unto the LEBBEE the right and option at any time during the term hereof to purchase the above described premises of and from the LESSOR at and for the sum of Five Thousand and no/lOC ($5000.00) Dollars cash, to be said upon execution and delivery by the LESSOR to the LEBSEE of a general warranty deed of conveyance of said premises. Upon the exercise of the option to ~urchase hereby given and granted, the LESSOR shall, within thirty (30) days after the exercise of said option, furnish to the LESSEE an abstract of title showing the LESSOR to be vested with a good and marketable title to said premises and the LESSEE shall have thirty (30) days ~> in which to have said abstract exe_m~lned and if said title is found to be good and market- able, the LESSOR shall tender and deliver unto the LESSEE a general warranty deed of conveyance of said premises upon payment of said sum of Five Thousand and no/lOC ($5000.00) Dollars. If said title is not found to be good and marketable, the LESSOR may rescind this contract to purchase or may Proceed to perfect said title within a reasonable time, whereupon the purchase of said property shall be consummated aa aforesaid and if the LESSOR is not able to nerfect said title within a reasonable time, if it Undertakes to do so, there shall be no liability en the Dart of the LESSOR, its successors or assigns, for failure so to do. Seconded by Commissioner Lodge and carried by the following vote of the Commission: Commissioner Higgins MiNUTeS The Clerk next reported that applications have been received from three other local oil distributors to sell the City gasoline through their service station at a discount of 1~ per gallon Ieee than the regular retail ~rlce. Thereupon after considerable discussion, and in view of the fact that Commissioner Bishop was absent from the regular meeting of the City Commission of March 8th., at which the Board voted to ~ay 4~ per gallon above the list tank-wagon price for all gasoline purchased by the Clt~ thru service stations, Commissioner Gut moved that the matter be presented for re-consideration. Beconded by Commissioner Lodge and carried unanimously. Thereupon after further discussion, the motion was again ~laced before the Board to pay .04 per gallon above the list tank-wagon price for all gasoline purchased by the City thru service stations.
