071243-Regular Session MINUTES CITY COMMISSION, SANFORD, FLORIDA, July at 7:3o ? 1943 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at ?:30 o'clock P.M. July 12,1943. Present: Commissioner Edward Higgins, Mayor Geo.D.Bishop H.James Gut W.C .Hill M.J.Lodge City Attorney Fred R.Wilson City Clerk H N Bayer Ohief of Police R.G.Williams Meeting called to order by the Chairman. Current invoices and payrolls for the month of June 1943, properly audited and vouchered as evidenced by voucher Nos. 5836 thru 5911 , submitted, examined , approved and payment authorized. Monthly reports of Streets, Sanitation, Health, Water, Police, Fire, Library and Golf Departments for the month of June 1943, submitted and examined. Financial statement and statement of revenues and expenditures during the month of June,1943 , submitted and examined. Bank statements in all accounts for the month of June 1943, properly reconciled, submitted and examined. On motion of Commissioner Lodge, seconded by Commissioner Bishop and carried, the Commission next authorized the employment of W.A.Zachary in the Police Department tO patrol the zoo and bandshell five hours each day at a salary of .40 per hour. A certified copy of Chapter 22453, House Bill No. 813, Act of 1943 Legislature next presented as follows: CHAPTER 22453 No. 819 House Bill No. 813 An Act Creating a Pension Fund for the Police Department of the C ~ty of Sanford, Florida; Defining Members of the Police Department of said City; Providing for Monthly Oontributions to be made by Members of said Police Department to said Fund and Authorizing the Imposition and Collection of Costs in Criminal Cases by the Municipal Court of said City and the Payment of said Costs to said Pension Fund and Authorizing the Transfer of Certain Funds now on hand in said City Heretofore Collected as costs by the Municipal Court to said Pension Fund; Providing for a Board of Trustees to Admi~ster said Pension Fund and Providing for the Payment of Pensions to Members of the Police Department of said City having the Qualifications Therefor as herein required, and Providing for the Acceptance or Rejection of the Benefits of this AcS by the Members of the Police Department of said City. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA: ~ection 1. That there is hereby created a pension fund for the Police Department of the City of Sanford, Florida, to consist of the funds hereinafter described and to be administered by a Board of Trustees as hereinafter provided. Section 2. That members of the Police Department of the City of 8anford, Florida, and embraced by this Act, shall be construed as including all officers and policemen MINUTES CITY COMMISSION~ SANFORD, FLORIDA, July 12 at 7:30 P M 19 nated depository for funds of the City of Sanford, Florida, and said funds so deposited shall be secured by direct obligations of the Government of the United States or such obligations as shall be fully guaranteed as to principal and interest by the Government of the United States. Section 9. That whenever any member of the Police Department of the City of Sanford, Florida, shall have served for a period of twenty years as a member of said Police Department, including service before and after the passage of this Act, although such service may not have consisted of twenty consecutive years of service, he shall be entitled to retire from said Police Department and shall be paid out of the aforesaid pension fund, a monthly pension of One Hundred Dollars per month for the remainder of his life, if the amount in said pension fund is sufficient for said purpose. If the aforesaid pension fund is not sufficient to pay said pension, said pension shall be reduced proportionately among the members entitled to said pension until said fund shall be sufficent to pay said pension in full. Upon the retirement of any member of the Police Department prior to his having served as a member thereof for twenty years, he shall not be entitled to a refund of his contributions to said fund, but upon becoming again a member of the Police Department, his prior service may be accepted as part of the twenty years' service required to entitle him to a pension hereunder. Section lC. That City of Sanford, Florida, if at any time any member of the Police Department of the wishes to relinquish the benefits of this Act, he may do so by notifying the Chairman of said Board of Trustees and Secretary thereof and the City Commission of the City of 7anford, thereafter no deduction shall be made from his salary as a contribution to said pension fund, but he shall not continue to be entitled to the benefits of this Act nor entitled to a refund of contributions previously made thereto. Section ll. All moneys paid out of the pension fund herein provided for shall only be paid by check drawn on the bank in which said funds are deposited and which check shall be signed by the Secretary and Treasurer of said Board of Trustees and countersigned by the Mayor and Chief of Police as members of said Board of Trustees. Section 12. That all laws or parts of laws in conflict herewith be and the same are hereby repealed. Section 13. That this Act shall become effective immediately upon its passage and approval by the Governor or upon its becoming a law without such approval. Became a law without the Governor,s approval. MINUTES CITY COMMISSION, SANFORD, FLORIDA, July 12 at 7:30 P M 19 43 five feet of right-of-way on each side of Park Avenue from the railroad south to Twenty- first Street, Commissioner Gut next moved that City Attorney Wilson be authorized to secure an expert appraisal of the properties involved in such proceedings. Seconded by Commissioner Lodge and carried. Request next received from the local Lions Club for financial assistance toward defraying the cost of displaying an exhibit at the International Lions Clubs Convention to be held in Chicago on July l?-l~, and on motion duly carried, an expenditure in amount of $25.00 was authorized for that purpose.
