Mr. G.W.Spencer, Attorney for the property owners contesting the condemnation suit of City of Sanford for acquiring additional right-of-way for the State Road Department to widen Park Avenue , next appeared with reference to the City's offer to work out a compromised settlement with his clients and for his fee for legal services in connection therewith, and offered to secure the cee~s for the five foot right-of-way from each of the following defendants in said suit at the following prices: L.P.Hagan - The Easterly five feet of Lot !Ii~ Sanford Hts. at a price of $50.00 Margaret L & C F Procter - The Easterly five feet of Lot 16 Sanford Heights, at a price of $215.O0 Howard C & ) Elizabeth -)The easterly five feet of Lot 47 , Sanford Heights, at a Long )price of $1OO.OO Gertrude C.Hart - The Easterly five feet of Lot 83, Sanford Heights, at a price of $50.00 Marianna & A.Derby - The westerly five feet of Lots 2 and 3 of Block C Markham Park Heights; and westerly five feet of S. 54 ft. of Beg~ at Int. of S. line of N E 1/4 of N E 1/4 of Sec. 3b Twp.19 S.R.30 E., with the ,~Wly line of Oviedo Branch of the A.C.L.R.R. run W. to ~ark Ave. N. to R.R. Gladys Cooper Berry - The Westerly five feet of Lot 5 , Spencer Heights, at a price of $25.00 Annie Laurie Meeds. The Westerly five feet of Lot 3 Sanford Terrace ; at a price of $174.OO Thereupon after careful consideration, and on motion duly carried, the Commission authorized the payment to each of the aforesaid property owners of the foregoing amounts submitted by their attorney G.W.Sp~ncer, for deed of conveyance to the State Road Department of the above described properties for street right-of-way purposes. Consideration next given to the matter of the legal fee of Attorney Spencer for services rendered the defendants in the £oregoing condemnation suit. Thereupon after considerable discussion , and on motion duly carried, the Commission authorized the payment of $9oL~.o5 to Attorney G.W. Spencer for legal services rendered the defendants in the aforesaid suit of City of Sanford condemning certain real e~tate to 384. MINUTES CITY COMMISSION, SANFORD, FLORIDA, August 23 at 7:30 P I~ 19 Nap of Sanford, stating that he is the owner of all the property abutting said alley and the sanitary sewer unaer same does not service any property in this block except his; also agreeing to maintain said sanitary sewer in this block if the alley is closed. Thereupon after careful consideration, City Attorney Uilson was directed to prepare an ordinance closing and vacating the aforesaid alley, for passage at the next regular meeting of the City Commission. The Clerk next reported that one of the City's trucks , a 1934 Eodel l½ Ton Diamond "T" Flat Dump, was destroyed by fire at the City's dump on August 10th and that the Insurance Con, any had paid the City the sum of $250.00 for the damages, which is the full amount of coverage carried on the truck. In connection with the request of the Sanford Equipment Cor~pany for the City to install a whiteway light at the southeast corner of Park Avenue and Second Street, presented at the meeti~ of July 26,1943, and on motion duly carried, the Clerk was next authorized to request the Florida Power & Light Company to discontinue the 100 CP, all-night burning whiteway light at the southeast corner of Palmetto Avenue and Seminole Boulevard; and install one lOOCP,all-night burning over-head bracket light 40 feet south of Second Street in the alley between Park Avenue and Nagnolia Avenue. On motion of Commissioner Lodge, seconded by Commissioner Gut and carried, the Commission next authorized the following sales of property acquired by the City thru foreclosure of taxes and/or special assessment liens, subject to 1942 City taxes and all unpaid State and County taxes. Ers Lucy Hall Smith - Lots 12 and 14 of Block 13 San Lanta Second Section at a price of $200.00 E.D.Johnson - Lot 20 Florida Land & Colo. Co. Add. to S.$anford , at a price of $7.2g James T.Sheppard - E. 50 ft. of N.W. 1/4 of Block ll Tier 13, at a price of $227.16 Commissioner Gut next advised that the property located at the northeast corner of Sixth Street and Locust Avenue, tentatively selected by the Commission as a site for the proposed colored recreation center is owned by Ers Fannie Barnhart, and can be purchased at a price of $600.00, subject to County taxes for years 1941 and 1942 in amount of $16~.??, including interest and penalties and City taxes for years 1941 and 1942 in amount of $35.37, including interest and penalties. Said property being described as Lots 48 thru 55 of J E Pace's Subdivision of Block "C" Nellonville. Thereupon after careful consideration, and on motion of Commissioner Hill, seconded by Commissioner Lodge and carried, the Commission authorized the purchase of the aforesaid property from Nfs. Barnhart at a price of $600.00, subject to the aforesaid City and County taxes for years 1941 and 1942, upon the City Attorney's approval of title to same. WHEREAS, pursuant to Resolution No. 660 of the City Commission of the City of Sanford adopted on the 14th day of June 1943, the City of Sanford, Florida, instituted a proceeding in the Circuit Court of Seminole County, Florida, for the condemnation of the easterly five feet of certain lots abutting the westerly side of that portion of Park Avenue between the Atlantic Coast Line Railroad right- of-way, near Fifteenth Street, and Twenty-first Street in said City and the westerly five feet of certain lots abutting Park Avenue on the easterly side thereof, and W~{EREAS, the State Road Department of Florida has agreed to widen the present pavement of Park Avenue from Tenth Street to Twenty-third Street from its present width of twenty-four feet to a width of forty-four feet and to reconstruct side- walks destroyed by said widening of said pavement and to construct sidewalks contiguous to property abutting said portion of Park Avenue where sidewalks have not heretofore been constructed and the City Commission of said City of Sanford deems it expedient and advisable to agree that the City will reconstruct said sidewslks destroyed by said widening of said pavement and construct sidewalks where none have existed heretofore as aforesaid, upon failure of the State Road Department of Florida so to do and also to re-plant shrubbery necessary to be removed from said five-foot strip where said five-foot strip has been conveyed to the State Road Department of Florida by the owhers thereof. NOW, THEP~EFORE, BE IT RESOLVED by the City Commission of the City of 8anford, Florida: THAT upon failure of the State Road Department of Florida to reconstruct side- walks destroyed by the State Road Department of Florida in widening the pavement of Park Avenue from its intersection with the Atlantic Coast Line Railroad right-of-way near Fifteenth Street, to Twenty-first Street from its present width of twenty-four feet to a width of forty-four feet and construct sidewalks contiguous to property abutting said portion of Park Avenue where sidewalks have not heretofore existed, said work of reconstructing sidewalks and constructing sidewalks as aforesaid will be don by the City without expense to the abutting property owners, and BE IT FURTHER RESOLVED that the City of Sanford will without expense to the DroDertv nw~ ~_~-~ ........ (Seal) Application next received from L.A.Tate and j.R.Weaver for permit to sell beer and wines at corner of South French Avenue and 8tats Road No. 3, and on ~ecommendation of Chief of Police Williams, same was approved. On motion duly carried, the Clerk and City Attorney were next authorized access to safety deposit box no. 177 at the Sanford Atlantic National Bank for the purpose of securing the Water Plant Revenue Certificates due September 1,1943, said Certificates owned by the Insurance Fund as an investment. In connection with interest due September 1,1943, on Series A and B Refunding Bonds dated l~arch 1,1937, and Series C,D and E Refunding Bonds dated March l, 1941, and on advice from the Clerk that sufficient funds are on hand for the purpose, Commissioner Lodge next moved that the Clerk be authorized to transmit to the Central Hanover Bank & Trust Con, any, New York City, funds in amount sufficient to pay interest coupons due September 1,1943, on the outstanding Series A,B,C, D and E Refunding Bonds. Seconded by Commissioner Hill and carried. On motion of Commissioner Hill, seconded by Commissioner Lodge and carried, the Commission next approved the purchase fro~ Cohu & Torrey, New York City, of 15 Refunding 8eries A bonds, with coupons due Sept 1,1943, and subsequent coupons attached, at a price of $437.50 each and interest, and 3 Refunding Series B Bonds with coupons Due Sept.l,1943, and subsec~ent coupons attached, at a price of $835.00 each and interest. Application next received fro~ C.E.McKee for the City to remove 3 Australian pine trees from the parkway in front of hie home at llO W. 17th Street, and on recommendation of Supt.
