Mr.E.C.Harner Jr. next appeared on behalf of the Seminole County Chapter of American Red Cross and requested a contribution toward the annual Red Cross War Fund. Thereupon after careful consideration it was felt that this request is for a worthy cause, and on motion of Commiseloner C-ut, seconded by Commissioner Bishop and carried, a donation in amount of $125.OO was authorized for the American Red Cross War Fund. Pursuant to the authorization of ~he City Commission at the adjourned meeting of March 23,1944, the following performance agreement between the City and Geo.W. Bi,one Jr. Municipal Planning Engineer, covering his services for zoning Sanford was next read tn full, and on motion of Commis~ioner Bishop, seconded by Commissioner Gut and carried, the Mayor and Clerk were authorized to execute same on behalf of the City: THIS SGP~EEMENT, made and entered into the 27th. day of March 19~, by an~ between the City of Sanford, a municipal cornoratton located in Seminole County, Florida, party of the first ~art, and George W. Slmons,Jr.,Consulttng Municipal and Planning Engineer of Jacksonville, Florida, ~arty of the second Dart. WYTNEBBETH : The party of the second oart is employed by the ~arty of the first part and agrees to perform for the natty of the first Dart the following services to-wit: 1. Conduct necessary studies and investigations preliminary and essential to the pre~arstion of the initial zoning plan and to the drafting of the ordinance or regulations to accompany said olan. 2. Meet with the City Commission on completion of the Initial plan and subsequently meet with the Zoning ~ommtesion to discuss the progress of work and plan. The Zoning ~ommission will be a~pointed pursuant to the State Enabling Act of 1939, (Chapter 19939, No.51~. 3. Yollow~ng the meeting with the City 0ommisston and Zoning ~ommission make such revisions in the plan and ordinance that seem desirable and prepare the second Tentative Map. At such meeting the Zoning Commission will arrange the time and place of its Public Hearing. 4. Seconded by Commissioner Lodge and carried. Thereupon said lease agreement was ordered spread on the minutes of this meeting, ae follows: MINUTES CITY COMMISSION, SANFORD, FLORIDA, }~roh 27 at ?:30 P M19 ~ 471 LEASE OF WAR PUBLIC WORKS Project No Fla. ~-252 (F) The United States of America ( herein called the "Government#) hereby leases to City of Sanford, Florida, a municipal corporation, ( herein called the #Lessee#), upon the terms and conditions and in consideration of the covenants and agreements of the Lessee hereinafter set forth, the land and improvements thereon hereinafter particularly described, war public works facilities identified by the above Project No. and described below ( such war public works facilities being hereinafter referred to as the #Leased Property #) for the term of twenty years from the date hereof. The Leased Property consists of the following lots, pieces or narcels of land in the County of Seminole and State of Florida, more narticularly described as follows: Beginning on Westerly side of 100 feet r~ght of wa~ of State Road No.S at a noint 581.4 feet South 24 degrees ~ minutes West of a point on East side of Section 11, Townshi~ 20 South, Range 30 East, which Is 711.6 feet South of the Northeast Corner of said Section 11, thence run North 65 degrees 26 minutes West 125 feet, thence North 24 degrees 34 minutes East 50 feet, thence South 65 degrees 26 minutes East 125 feet, thence South 24 degrees ~4 minutes West 50 feet to beginning. Possession of the Leased Property has been delivered to the Lessee. In consideration of the foregoing, the Lessee covenants and agrees that following the delivery to it of the possession of the Leased Property: (a) It will pay to the Government an annual rental of One Thousand ($1000.00) Dollars in advance, the first year's rental having been ~aid upon the execution and delivery of this Lease, the receipt of which is hereby acknowledged, and a like payment shall be made on the anniversary date of this Lease until twenty annual rental ~ayments have been raid, unless the right to nurchase said Leased Property from the ~overnment is exercised prior to the end of the term hereof, as hereinafter ~rovlded. (d) It will pay all costs of operation of the Leased Property and all expense and liability incurred in connection therewith, including the purchase of necessary tools and equipment. (e~ If the Leased Property is to be operated on a revenue-producing basis, it will establish, maintain and collect fair, Just and reasonable rates and charges for the commodities and services supplied and made available by the Leased Property (f) It will ~rocure and maintain for the benefit of the ~overnment such in- surance covering the risks to which the Leased Property is exposed as ts customari- ly carried in connection with similar facilities located in the same or a compara- ble area, in form and amounts reasonably sufficient to protect the Government's finan- cial interest in the Leased Property, and subject to the following conaitions: (1) the kinds and amounts of insurance and the insurers shall be subject to a~nroval of the Government, (2) the insurance shall be made sayable to the Government as the insured, (3) the insurance nolicies shall be delivered promptly to the Government, (4) the Lessee shall notify the ~roper insurance com~anies and the Govern- ment promptly of any loss or damage to the Leased Property; (~) in the event of any losses covered by such insruance the Government shall an~ly any insurance proceeds received during the term of this Lease to the re~alr, restoration and replacement of the Leased Pro~erty, or any ~ortion thereof, damaged or destroyed ; (g) It will permit the Government at any reasonable time to enter upon, in- svect and exhibit the Leased Pro~erty and also to examine the books, records and accounts of the Lessee pertaining to its water department. (h) It will save the Government harmless from any liability or claim arising from the Lessee's nossesslon, use, maintenance and operation of the Leased Pro~erty or the fulfillment of its responsibilities hereunder. The Lessee covenants and agrees that it w~ll not assign or transfer its rights or interest under this Lease, or transfer possession or dispose of the Leased Pro~erty or any part thereof, or create or permit a lien or charge upon or claim against the Leased Property or any part thereof, without the consent of the Government evidenced in writing. The ~overnment assumes no liability for any damage, injury, loss or expense caused by, resulting from, or arising in connection with the Leased Property, or for any defect in or representations not herein contained concerning the Lease~ Property. The Lessee shall have the right prior to the end of the term hereof to pur- chase the Leased Property of and from the Government at such price as may be agreed upon between the Government and the Lessee, and rentals ~aid shall a~ply on the pur- chase price. If the Lessee does not purchase the Leased Property from the Government prior to the end of the term hereof, the Government will, if the Lessee shall have oaid the rentals hereinbefore required to be oaid for the term hereof, convey the Leased Property to the Lessee at the end of the term hereof, and. the rentals so paid shall constitute the consideration for the conveyance of said Leased Property. Application next received from John F.Pearson to purchase the City owned prop- erty deecribed as : Lots 6,7 and 8 Block 1 Tier 6, E R Trafford's Map. Thereupon after careful con~ideration, and in view of the fact that the City will have no municipal use for the aforesaid property, the Commission authorized it for sale at a price of $3~O.00 Request next received from Geo. Thureton for the City to install a street light at the intersection of Second Street and Virginia Avenue, and same was ordered filed until such time the War Production Board releases street light- lng materials and fixtures for new conetruction. The Clerk next reported that Lot 9 Block 13 Tier G, E.R.Trafford'e Map was assessed as Improved property for the years 1934 thru 1939, whereas, the dwelling on this ~roperty was destroyed by fire prior to 1934 and it should have been assessed ae unimproved for those years. Thereupon in order to correct this error in assessment, Commissioner C-ut moved that the taxes against the aforesaid property be adjusted to $3.1~ for the years 1934 thru 1937, $2.~2 for 1938, and .90 for year 1939. Seconded by Commissioner Lodge and carried. Request next received from Mrs Elizabeth Peters, 608 W.Flrst Street for the Commission to waive the interest and ~enalties accrued on her personal property taxes for years 1932/34 and 1937/40. Thereupon after careful consideration, it was felt that the Commission had no authority to accept payment of such taxes without the accrued interest and penalties thereon, and the request could not be granted. On motion duly carried, the Commission next authorized the renewal of contract with the Gulf Oil Corporation for the ensuing year for furniehtng Gulf Pax-vis "Ma lubricating oil for the diesel engines at the water plant at a price of gallon. Mayor Higgine next reported that firemen J.T.Vernon,J.R. Crow, Manning Harriett and C.M.Whitten tendered their resignations on March 24,1944, because of dissatisfaction over their rate of salary, but that Crow, Harriett and ~hitten 474 MINUTES CITY COMMISSION, SANFORD, FLORIDA, ~in~.~ v: n their Jobs under the same terms and conditions as were, and that on recommendation of Fire Chief Cleveland, they were reinstated to their Dosietions as firemen. ~ayor Hlggins next presented bill of Col. Oilbe~A.¥oungberg~ Consulting Engineer, Jacksonville, in amount of $500.00 , covering his services in prepar- ing a brief on the proposed imnrovements to 12-foot depth of the St. Johns River Channel from Sanford to Palatka, stating that Col. Youngberg was employed to pre- Dare the brief by Central Florida Incorporated, a corporation consisting of repre- sentatives from all cities of Central Florida, who have organized for the ~urpose of developing navigation and promoting theconservatlon and control of the inland waters of central Florida; and advising that said organization has no funds for carrying on such promotion work, except thru contributions from the several cities represented by it, and requested the Commission to pay the aforesaid bill in amount of $500.00 as part of the City's contribution to the said organization, inasmuch as Sanford will accrue the most benefits from this proposed project because of its location on the St. Jonns River. Thereuvon after considerable discussion, Commissioner Gut moved that the City pay Engineer Youngberg the sum of $500.00 for his services in preparing the aforesaid brief, and that Central Florida Incorporate~ be requested to credit this vayment as a contribution from the City of Sanford. Seconded by Commissioner Bisho~ and carried. Request next received from the Board of Public Instruction of Seminole County to be allowed the delinquent tax adjustment in the ~ayment of delinquent taxes for years 19~6 and 1937 against several lots in Orange Heights , as provided under Resolution No.578, which authorizes the adjustment of 1~38 and prior taxes to the same valuation assessed for year 1939. The aforesaid property hav~ng been exempt from taxes for year 1938 and subsequent years. Thereupon Commissioner Gut moved that the Tax Collector be authorized to accept payment of the taxes for years 1936 and 1937 against the aforesaid property by adjusting same to the assessed valuation that would have been placed against it for theyear 1939, should it have been assessed for taxes. Seconded by Commissioner Hill and carried. On motion duly carried, theCommission next a~Droved the acceptance from the Florida State Bank of Sanford, of First National Bank of Atlanta Safe-~eeping Receipt No 11981 covering $50,OOO.O~ U.S.Traasury 2% Bonds of 1951-53 , due September 15,1953, Nos 78967/71 at $10,OOO each, with coupons due September and subsequent couvons attached. These securities being deposited to protect City of Sanford funds Dn deposit in said bank. Communication next read from J.D. Brown,Baltimore,Md. offering to purchase all the city-owned lots in Bel-Air , San Lanta Second Section and Magnolia Heights Subdivisions at a price of $1OO.OO each, by ~urchaelng at least five of said lots each month. This property having been acquired by the City thru foreclosure of taxes and/or special assessment liens. Thereupon after careful consideration, and on motion duly adopted, the Com- mission offered to grant Hr. Brown a 90 days option to ~urchase 1OO lots in Bel-Air Subdivision at a ~rice of $100.OO each, with a stipulation that said option will be extended for additional 9© day periods, provided he has purchased 1~ or more lots during the term of each 90 days option. Minutes of regular meeting of February 28, adjourned meeting of March 1, and regular meeting of March 14,1944, next read and aoproved. Current invoices and oayrolls for the month of March 1944, oroperly audited and vouchered as evidenced by Voucher Nos. 6626 thru 6722 , submitted, examined, aooroved and payment authorized. Monthly reoorts of Streets, Sanitation, Health, Water, Police, Fire, Library and Golf Deoartments for the month of March 1944, submitted and examined. Financial statement and statement of revenues and expenditures during the month of March 1944, submitted and examined. Bank statements in all accounts for the month of March 19~, nroperly reccndiled, submitted and examined. Mr. Garland W. Soencer, Attorney , next accosted before the Board and advised that he had been emnloyed by employees of the Police and Fire Departments to represent them in a legal caoacity to consult with the Commission in oreparing the nronosed Civil Service System for City employees, in order to wrotect their interest in the matter. Thereuoon after considerable discussion, in which Attorney the names of his clients, it was the oninion of the Commission that not accept recognition of counsel for any City Emoloyees, but would be glad to listen to Mr. Soencer as a citizen and tax payer with reenact to any criticism and recom- mendations that he may have to offer in connection with the oropoeed Civil Service System. Commissioner Gut then moved that City Attorney Wilson be authorized to invite Mr. Spencer, as a citizen, to confer with him in oreparing the Oroposed Civil Service Ordinance, with a view to receiving the benefits from any constructive ideas or sug- gestions that Mr. Seencer may have to offer that should be embodied in said Ordinance.
