The City Commission of the City of Sanford, Florida,met in Special Called session
at the City Hall in the City of Sanford, Florida at ll:30 o'clock A N ~arch 22, 1947.

Neeting called to order by the Chairman who announced that the meeting had been
called to consider a request of the Florida Power & Light Company for the City to release
its application to the War Assets Administration for the electrical distribution system
at the Sanford Naval Air Station to b e transferred to the City as part of the airport
property; stating that it is the desire of the Florida Power & Light Company to pur-
chase this equipment from the War Assets Administration and to maintain and operate it
as part of their distribution system.
Thereupon after careful consider~tion it w~s the opinion of the Commission that
it would be for the best interest of the City to acquire this electric~.l distribution
system, and then enter into an agreement with the Florida Power & Light Company to main-
rain and operate it, and on motion duly carried,

Meeting called to order by the Chairman.
The amended lease agreement to be entered into with James $.Rlvers on the
site for radio broadcasting station, was next submitted and read in full by the Clerk.
Thereupon Commissioner Bishop moved the approval of the aforesaid lease
agreement and that the Mayor and Clerk be authorized to execute same on behalf of
the City.
Seconded by Commissioner Williams and carried.
Said lease agreement being in words and figures as follows:
THIS INDENTURE OF LEASE AND EASEMENT, Made in triplicate this 24th day of March
1947, by the CITY OF SANFORD,FLORIDA, a municipal corporation, hereinafter referred to
as lessor and J~ES B RIVERS, of 0ordele, Georgia, hereinafter referred to as lessee,
witnesseth:
That the lessor for and in consideration of the rentals
lessee, and covenants on his part to be performed as hereinafter
and by these presents does lease and let unto the lessee, the following described lot,
piece or parcel of land, situate in the City of Sanford, Florida, to-wit:
Begin at a point on the north property line of East First Street 258.6
feet East and 41 feet North of the intersection of San Carlos Avenue
and East Flret Street, run thence Eaeterly along the North property
line of East First Street 125 feet, thence Northerly parallel to San
Carlos Avenue 225 feet, thence Westerly parallel to East First Street
125 feet, thence Southerly parallel to San Carlos Avenue 225.ft. to
point of beginning,
and has granted, and by these presents does grant, to the lessee, an easement across
the following described property, to-wit:
Begin at a point on the north property line of East First Street 41 feet
North and 163.6 feet East of the intersection of East First Street and
San Carlos Avenue, run thence Northerly parallel to San Carlos Avenue
to South property line of Seminole Boulevard, thence Easterly along
South property line of Seminole Boulevard $o its intersection with the
West property line of Mellonvllle Avenue, thence Southerly along the
West property line of Mellonville Avenue to its intersection with the
North property line of East First Street, thence Westerly along the North

lessee for a period of ninety-nine (99) years from the date hereof, unless sooner
terminated, subject to the terms and conditions hereinafter set forth.

($1.00) per year, payable in advance, for the first ten years of this lease, and

And the lessee, as further consideration, for this lease and easement, agrees
1. The aforesaid premises are lease by him for the purpose of erecting
and maintaining thereon a radio station, ae radio stations are now known or may be
known in the future, and shall not be used for any other purpose without the written
permission of the lessor, and he will build said radio station and put it in operation
within a period of one year from the date of this lease and easement, provided that
the erection of an antenna upon the leased property shall satisfy the requlremente
of this paragraph.
2. The easement aforesaid, across the premises secondly above described,
is granted for use only by the lessee for the purpose of installing underground aerial
mat, which shall be se installed that said property can be used by the lessor, its
successors or assigns, for building, planting or other purposes, and for the ~urthe~
purpose of installing such guy wires above ground as lessee shall deem necessary,
provided that lessee shall shift or adjust the location of such guy wires upon such
easement property as may be necessary to permit the erection of any buildings which
lessor, its successors or assigns, shall desire to erect upon such property.
3. The lessor shall have the right to examine the exterior plans for any
building or buildings proposed to be erected by the lessee on the above described
premises, prior to its or their erection, and said exterior plans shall be subject
to the approval of the lessor.
4. Any building or buildings erected by the lessee upon the above described
premises shall be and become a part of the lands upon which erected, and upon the
expiration of the term of this lease, or its earlier termination, shall be and
become the property of the lessor, its successors or ass igns~
5. Any building or buildings erected upon the above described premises shall be
at all times kept in a state of sound repair and neat appearance, and likewise, the grounds
on which said radio station shall be erected shall be at all times maintained in a neat
and attractive manner, and upon failure of the lessee to comply with this covenant after
30 days notice in writing by the lessor so to do, the lessor shall have the right to
enter upon said premises for the purpose of performing the provisions hereof, and
the lessee shall reimburse the lessor for the expenses thereof within 30 days after
presentation of bill therefor.
6. Lessee shall keep any and all buildings erected upon the hereby lease and let
premises, insured against all risk of damage or destruction by fire and wind storm
to their full insurable value. Said insurance policy or policies sh~ll be payable to the
lessor and lessee Jointly, and in case of partial loss or damage to said building or
buildings, proceeds of said insurance policy or policies shall be applied to the
restoration of said building or buildings to its, or their, former condition; and
in the event of a complete destruction of said building or buildings, the lessee
agrees within one year from the date of said destruction to erect on said premises
a new building or buildings, and the proceeds of said insurance policy or policies
may be applied for such purpose, said building or buildings to be of at least
equal to, if not greater value than the building or buildings destroyed; and over and
over again so long as said partial or complete destruction may occur.

the lessee shall immediately surrender possession of said premises and
thereon and easement to the lessor, its successors or assigns.
8. The lessee will pay to the lessor for the eleventh and each
buildings erected
successive year
of said term thereafter, to and including the fifteenth year, one percent of the gross
income of the radio station to be erected by the lessee on the above described premises;
one and one-half percent of said gross income for the sixteenth and each successive year
thereafter until, and including the twentieth year, of said term, and two percent of
said gross income for each year thereafter until the end of said term. Should lessee
erect only an antenna on the premises hereby leased, as permitted by the provisions
of paragraph i hereof, or an antenna and additional facilities, gross income as used in
this paragraph 8 shall apply to gross income of the entire radio station of which said
antenna, or antenna and additional facilities, is a part, whegher or not: such entire
radio station be located on the premises above described. The aforesaid rentals shall
be paid to the lessor by the lessee annually, and detailed report of said income shall be
made to the lessor by the lessee at the time of making such payment, and the lessor shall
have the right to inspect and audit the records of the lessee within a reasonable time
after the making of said payment and report for the purpose of determining the correctness
thereof. Said report and payments shall be made to lessor,
within thirty days after the end of each year.
9. Any building or buildings or other structures,
its successors or assigns,
improvements, or facilities
erected on the first above described tract of land by the lessee, his heirs, executors,
administrators or assigns, and any facilities placed upon the secondly above described
tract of land by the lessee, his heirs, executors, administrators, or assigns, shall be
assessable by the lessor for personal property taxes and the lessee shall pay during the term
hereof, beginning with the year 1947, before they become delinquent, said personal property
taxes and shall pay during the term hereof, beginning with the year 1947, before they
become delinquent, all taxes of every kind that may be assessed against the first
above described tract of land, and any building or buildings or other structures of
facilities erected or placed thereon by the lessee, his heirs, executors, administrators,
or assigns and shall pay during the term hereof, beginning with the year 1947, before
they become delinquent, all other taxes of every kind that may be assessed against any
facilities placed upon the secondly above described tract of land by the lessee, his
heirs, executors, administrators or assigns..
lC. The Lessee, his heirs, executors, administrators or assigns shall not assign
this lease without the written consent of lessor, excepting only that this provision shall
not apply to the first assignment hereof to any corporation hereafter formed of which
lessee shall be the principal stockholder.
ll. The lessee shall save the lessor haa-mless from any claim for damages to
any person or persons incurred in the erection or operation of said radio station, and
shall reimburse the lessor for any damages it may sustain by reason thereof.
12. The lessee will at all times obey and comply with all legal requirements,
rules and ordinances of lessor and laws of the State of Florida and of the United States
which may affect the premises hereby leased or the business carried on therein.
Lessor covenants and agrees that the lessee upon paying the rentals and per-
forming and fulfilling the conditions and provisions hereof, upon lessee's part to be paid,
performed and fulfilled, shall and may peaceably and quietly hold, occupy and enjoy the

aforesaid premises for and during the term aforesaid, free from any act, hindrance,
ejectment, or molestation by the said lessor or any person or persons claiming through
or under it.
This lease is made upon the express conditions that said lessee shall
promptly pay the rental hereunder end shall fulfill and perform all and singular the
agreements, conditions and provisions, contained herein, in the manner provided for here-
in; and if at any time the rental hereunder, or any part thereof, shall remain unpaid
for thirty (30) days after it becomes due without demand made therefor; or if the
lessee shall fail to pay, before they become delinquent, taxes and special assessments as
hereinbefore required, or to fulfill any of the other terms and conditions hereof, in
the manner called for herein; end if said non-performance or non-fulfillment shall con-
tinue for a period of sixty (60) days after written notice of the same has been given to
the lessee, or his duly authorized agent, it shall be lawful and optional for the lessor
to declare a forfeiture of this said lease; and into s aid premises to re-enter end the
same to have again, repossess and enjoy as in lessor's first and former estate; and
thereupon this lease and all agreements and covenants of the Lessor's behalf to be
performed and kept, shall cease, terminate and be utterly void, the same as if this
lease had not been made; and in addition thereto , the lessor shall be entitled to
whatever remedies it me~ have at law, for the collection of any unpaid rental hereunder
or for any other sums, for damages or otherwise, that it may have sustained on account
of the lessee's nonfulfillment of the terms and conditions of this lease.
Wherever written notice is provided herein to be given to lessee, same may
be accomplished by mailing such notice to lessee, hie heirs, executors, administrators or
assigns at his or their last known post office address.

Thereupon after comparison of prices submitted and on recommendations of water
plant engineer Abrahams, the Commission awardea the contract to Gulf Oil Corporation
for furnishing distillate fuel at the sellers market price, and Parvis "M" Lubricating
oil at a price of .52 per gallon.
On motion duly carried, the Commission next authorized the purchase from Britt
Tractor Company of one Ferguson Mower Attachment at a cost of $2?3.00 tobe installed on
Ford Tractor to replace old attachment thst has worn to such an extent that it is beyond
keeping in a state of repair.
On motion of Commissioner Carraway, seconded by Commissioner Bishop and carried
the Commission next authorized the purchase for the water department of one electrgnicpIpe
and valve locater from M.M.Lory, Siox City, Iowa, at a price of $195.00.
On motion of Commissioner Lesher, seconded by Commissioner Carraway and carried,
the Commission next authorized the purchase from LeRoy Strawder of one second-hand steel
barge at a price of $150.OO, to be used for pulling piles, and general maintenance of
docks and wharves.
Report of March analysis of milk from all dairies operating in Sanford as pre-
pared by Dr. L R Scribner's Laboratories at Orlando, next submitted, such report snowing
all such milk within the requirements of Grade "A" Milk.

EXTENDING AN INVITATION TO THE AMERICAN LEGION DEPARTMENT OF FLORIDA,
TO ESTABLISH ITS PEP~,~ANENT HEADQUARTERS IN THE CITY OF SANFORD, FLORIDA,
AND OFFERING CERTAIN PROPERTY TO IT FOR THAT PURPOSE.
WHEREAS, the headquarters of the American Legion,Department of Florida ,
have been temporarily located in the City of Sanford, Florida, for approximately
twenty-four months, and the City of Sanford and its citizens have felt honored
to have the City designated as temporary headquarters of the Legion, and feel also that
the departmental offices and personnel of the headquarters have been pleased with the City

the City of Oanford, to have the permanent headquarters of the American Legion, Depart-

NOW, THEREFORE,BE IT RESOLVED by the City Commissioners of the City of Sanford,
Florida that a cordial invitation be and is hereby extended to the American Legion,
Department of Florida, to locate its permanent headquarters in the City of Sanford.
BE IT FURTHER RESOLVED that the City of Sanford does hereby offer as a gift to
the American Legion, Department of Florida, that certain property located on Lake
Nonroe, lying between Hood Avenue and Palmetto Avenue, and comprising approximately a city
block, on which to locate said permanent headquarters and any memorial building honoring
the veterans of the World Wars.

were assessed as improved property for year 1946 in error, whereas, the improvements were
not completed Until February of 1946.
Thereupon in order to correct this error in assessment, Commissioner Williams
moved that the taxes assessed against the aforesaid property for year 1946 be adjusted

The proposed lease agreement with the Sanford Baseball Association covering
the Municipal Athletic Field, was next presented for consideration.
Thereupon uo~missioner Carraway moved the approval of the lease agreement and
that the Mayor and Clerk be authorized to execute same on behalf of the City.

THAT for and in consideration of the sum of one dollar and other valuable con-
siderations to it in hand paid by the Lessee, and the covenants on the part of the
Lessee hereinafter stated, the Lessor has leased and let and by these presents does lease
and let unto the Lessee those certain premises situate in the City of Sanford, Florida,
and described as follows:

THE MUNICIPAL ATHLETIC FIELD as now enclosed belonging to the Lessor
and situate at the Northeast corner of Mellonvllle Avenue and Celery
Avenue in said City of Sanford, Florida, including the grandstand,
bleachers, flood lights and other equipment thereon, and the Club
House belonging to Lessor immediately north of said atheltic field
as enclosed.
TO HAVE AND TO HOLD the above described premises and property unto the Lessee
from the first day of April 194y, or immediately after possession of said premises
and property has been surrendered by the Toledo Mud Hens Baseball Club, and until
Labor Day,194?, provided that if the baseball team of the Lessee is in the "play-off"
of the Florida State League for the 1947 season, the Lessee shall have the right to
retain possession of said property and premises until said "pls~-off" is concluded.
As part of the consideration of this lease the Lessee covenants and agrees ae
follows:
1. To operate on said premises during the 194y baseball season for the term
of this lease a baseball team of the Florida State Baseball League or other league
engaged in baseball contests in the State of Florida.
2. To maintain and keep said Municipal Athletic Field in good condition at all
times during the term hereof, and make, at its own expense, all needful repairs on the
buildings, grandstand, bleachers, flood lighting system, including replacement of
broken light bulbs, club house, fences and other improvements.
3- To promptly pay all bi~s for electricity used upon the aforesaid premises
and property during the term hereof and all rentals for the transformers for the
aforesaid flood lighting system. The Lessor will furnish water necessary for reasonable
maintenance of said premises.
4. To be solely responsible for all damages that may be suffered by person or
property as the result of playing games of baseball upon the aforesaid premises or as the
result of any other acts or any omissions on the part of the Lessee, its agents, Servants,
or employees, or on account of the condition now or hereafter of the grandstand, bleachers,
club house or other equipment thereon, and to obtain at their own expense and keep in
force during the term hereof a liability insurance policy in the amount of not less than
$5,000.00 one person and $50,000.00 one accident, and conditioned to save the Lessor hard-
less from any damages that may be sustained, as aforesaid.
5. To not assign this lease without the consent thereto in writing by the Lessor.
6. To surrender the aforesaid premises, club house and equipment to the Lessee
at the end of the term hereof or earlier termination hereof in as good condition as said
premises,club house and equipment were at the date hereof, ordinary wear and tear and
damage by the elements excepted.
In the event of the destruction by fire of the grandstand or club house or
bleachers or fences on the aforesaid premises, or their damage to such an extent as to
interfere with the playing of baseball games, as aforesaid, this lease shall immediately
terminate without any liability on the part of the Lessor.
It is hereby expressly understood that in the event the Lessor is held by a
Court of competent Jurisdiction not to have had authority to make this lease, there
shall be no liability upon the Lessor on account thereof.
IN WITNESS WHEREOF, the Lessor has caused these presents to be executed in its
name by its ~ayor, and attested and its corporate seal hereunto affixed by its City
Clerk, and the Lessee has cuased these presents to be executed in its name by its
president and secretary, all on the day and year first above written.

The City Manager next submitted a report prepared by Supt. of Public Works
Lubinskl, showing the condition of the City's automotive equipment, with recommenda-
tions that the following new equipment be purchased to replace old equipment that has
worn to such an extent that it is beyond keeping in a state of repair:
1 Pick-up Truck ( to replace truck driven by Supt. of Puklic Works.)
i Pick-up Truck ( to replace truck driven by Sanitary Officer.)
3 l½ ton Long Wheel base trucks ( to replace old trucks used for
collecting garbage and trash)
i Derrick Truck ( to replace old derrick truck used for general
utility purposes.)
Thereupon after considerable discussion, and on motion duly carried, the
City Uanager was directed to advertise for bids to be received by the City Commission
at regular meeting of April 28, for furnishing two pick-up trucks to be delivered with-
in 60 days, and three l½ ton long wheel base trucks to be delivered within 90 days.
Commissioner Lesher next introduced Ordinance No. 412, entitled:

the City of Sanford, Florida, met in regular session
at 7:30 o'clock P M, April 14,1947
Current invoices and payrolls for month of Narch 1947, properly audited
amd vouchered as evidenced by voucher nos 89 thru 200, submitted , examined, approved
and payment authorized.
Monthly reports of streets , sanitation, health, water, police, fire, library
and airport departments for the month of Narch, submitted and examined.
Financial statement and statement of revenues and expenditures during month
of Narch,1947, submitted and examined.
Bank statements in all acennts for month of March 1947, properly reconciled, sub-
mitted and examined.
Application next received from Mr J.A.Calhoun to lease the concession at the
Zoo for one year, offering a rental of $600.00 payable in advance.
Natter taken under advisement, pending whether or not the present operator of
the concessions is agreeable to paying the amount offered by ~r. Calhoun.
Mr. Alvin Odham, Sales Nanager for the Holler ~otor Sales, next appeared and
requested that the delivery date in the bid specifications for the two pick-up trucks,
be changed from 60 days to 90 days, advising that the Chevrolet factory has shut down
and will not be back in production in time to make delivery in the period specified in
the bids to be opened at the meeting of April 28.
Request denied.
Attorney A. Edwin Shinholser next appeared on behalf of Nr James S. Rivers
with further reference to the construction of the radio broadcasting station, and
submitted a proposed easement agreement to be entered into by the City, granting ~r.
Rivers an easement to install an underground cable across San Carlos Avenue during
such time the radio studio is operated in the ~ayfair Inn.
Thereupon Commissioner Bishop moved that the easement be granted and the
Nayor and Clerk be authorized to execute the agreement on behalf of the City.
Seconded by Commissioner Lesher and carried.
