041447- MINUTES City COMMISSION, SANFORD, FLORIDA~ April 14 at .7:30 P 457 City of Sanford, Florida, and WHEREAS, said radio Station is being so installed that only the antenna and part of the equipment thereof will presently be installed on the property described in said Indenture of Lease and Easement while the broadcasting studio will be located in the building now known as Nayfair Inn on the West side of San C~rlos Avenue, and WHEREAS, it is necessary that said broadcasting studio be connected by wires and cables extending from said broadcasting studio to the antenna aforesaid across said San Carlos Avenue and the second parcel of property described in said Indenture of Lease and Easement, same being part of the property hereinafter described; NOW, THEREFORE, in consideration of the premises, party of the first part has granted, and by these presents does hereby grant unto party of the second part, his successors and assigns an easement across the following described property,to-wit: That portion of San Carlos Avenue between First Street and Seminole Boule- vard in the City of Sanford Florida, and ALSO: Begin at a point on the North property line of East First Street 41 feet North and 163.6 feet East of the intersection of East First Street and San Carlos Avenue, run thence Northerly parallel to San Carlos Avenue to South property line of Seminole Boulevard, Thence Easterly along South property line of Seminole Boulevard to its intersection with the West property line of Mellonville Avenue, thence Southerly along the West property line of Mellonville Avenue to its intersection with the North property line of East First Street, thence Westerly along the North Property line of East First Street to point of beginning, except the property heretofore leased. for the placing of cables and wires across such property as may be necessary for party of the second part by the most direct, practicable route to connect the radio broadcasting studio to be operated by party of the second part in the building presently designated as Nayfair Inn with such antenna as shall erect on the property heretofore leased from party of the second part for use with such broadcasting studio; and all rights hereunder shall terminate upon removal by party of the second part of the first part by party the easement hereby granted party of the second part of his said radio broadcasting studio from the said building now deisgnated as Mayfair Inn; the easement hereby granted is granted upon condition: (1) that the cables and wires to be placed across the above described property shall be installed underground and be so installed that said property can be used by the parts of the first part, its successors or assigns for building, planting or other purposes, and that there shall be no interference with the use of the street aforesaid as a public street. (2) That if the installation of such wires and cables across San Carlos Avenue shall require disturbance of the paving of said San Carlos Avenue, party of the Second part shall immediately after such installation repair said paving and restore same at expense of party of the second part to its present condition. Commissioner Carraway then moved tha the bid be awarded to the lowest bidder, that of John Krider in amount of $134.44, provided the tares to be furnished are first grade and of equal quality with the other tires bid upon. T.S.Crawley of 1910 Sanford Avenue next appeared and requested that the alley running east and west from Sanford Avenue to Palmetto Avenue in back of his home be re- opened. This alley having been temporarily closed by City Ordinance No. 378, passed and adopted by the City Commission under date of September 6, 1945. Matter taken under advisement. Application next received from Manuel Jacobson for permit to operate a liquor package store in his new building at 106 Palmetto Avenue, and on motion of Commissioner Lesher, seconded by Cmmmissioner Williams, and carried, same was ordered filed, as the maximum number of permits have already been granted under authority of Ordinance No.359, limiting not in excess of one such permit and license to each 1500 persons, according to the last State or Federal census. On motion of Commissioner Bishop, seconded by Commissioner Lesher and carried, the Commission next approved the purchase from B.J.Van Ingen & Company, Miami, of 5 Refunding Series "B" Bonds at a price of $975.00 each. On motion duly adopted, the Tax Collector was next authorized and directed to hold the 1946 tax sale on the let. day of July 1947, instead of the 1st. day of June. The proposed Lease Agreement for leasing the Yacht Club Building to the Sanford Coast Guard Auxlliary,U.S.Naval Reserve, Sanford Junior Naval Reserve and Sanford Outboard Motor Boat Association was next submitted for consideration. TOLL, of Sanford, Florida, as T~ustee for the parties and purposes hereinafter stated, hereinafter referred to as Lessee, WITNESSETN: THAT the said Lessor for and in consideration of an annual rental of one dollar per year, to be paid by the Lessee to the Lessor each year in advance, and the covenants on the part of the Lessee, as hereinafter stated, to be performed, has leased and let and by these presents does lease and let unto the Lessee that certain premises situate in City of Sanford, Florida, and known as: The old Yacht Club Building owned by the Lessor on the north side of Seminole Boulevard and extending over Lake Nonroe between North Park Avenue and North Myrtle Avenue. TO HAVE AND TO HOLD the above described premises for a term of one year from April 15, 1947, unto the said Lessee, William J.Toll, as Trustee for the Sanford Coast Guard Auxiliary, U.S.Naval Reserve, Sanford Junior Naval Reserve, and Sanford Outboard Notor Boat Association, and the Lessee does hereby covenant and agree as follows: 1. The above demised premises shall be under the immediate control of the Lessee, but subject to his supervision and control by a committee of five members, consisting of the Commander of the Sanford Coast Guard Auxiliary, the Commander of the U.S.Naval Reserve, the Commander of the Sanford Junior Naval Reserve, and the Commander of the Sanford Outboard Notor Boat Association, a nd one member to be elected at large by said four members. 2. That each of the above mentioned organizations, namely Sanford Coast Guard Auxiliary, U.S.Naval Reserve, Sanford Junior Naval Reserve, and Sanford Outboard Motor Boat Association, and such other organizations as may be formed in a bona fide manner to use the water front of Lake Nonroe for recreational, amusment or other legitimate purposes or for water front development purposes, shall have %he equal right to use the demised premises under such rules and regulations as may be promulgated by said committee; provided, however, that such part of said demiseaas may be suitable for the purpose shall be set aside by said committee and exclusively used for the deposit there- in of electronic equipment of the U.S. Naval Reserve and said portion of said building shall not be used for any other purpose so long as it is required for %he storage of said electronic equipment. 3. The Lessee shall promptly pay all bills for utilities' service to said premises. 4. The Lessee shall pay before they become delinquent any and all personal property taxes assessed upon the demised premises, including taxes for the year 1947. 5- The Lessee shall keep the building on said premises in a good state of repair at his own expense. 6. The Lessee shall not assign this lease without written consent of the Lessor.- ?. No offensive or illegal use of said premises shall be made or permitted. ~. The Lessee agrees to save the Lessor harmless and indemnified from all loss, damage, liability, or expense incurred or claimed by reason of Lessee's neglect or use of the premises, or the condition of said premises, or by reaso~ of any injury or damage to any person or property therein. 9. In the event of destruction of said premises by fire or their damage to such an extent as to render them untenantable, this lease shall become null and void without any liability on the part of either the Lessor or the Lessee. ll. The aforesaid committee by a majority of three votes shall have the right to remove the Trustee hereunder and substitute some other party as Trustee in his place and stead, or the Lessor shall have the right to remove said Trustee and substitute some other party as Lessee and Trustee hereunder,for good cause, after reasonable notice and hearirg, or upon petition by a majority of the aforesaid organizations for whom the Lessee is Trustee hereunder, and the rights hereby expressed for the removal of the Trustee shall continue to exist from time to time as to a substituted Trustee or Trustees. Default on the part of the Lessee in the performance of any of the aforesaid covenants after thirty days' written notice by the Lessor so to do, shall work an immediate forfeiture of this lease, and Lessor shall have the right to re-enter and re-take possession of said premises without the necessity to resort to process of law therefor. This lease may be renewed by the Lessee at the additional year upon giving the Lessor thirty days end of the term hereof for an notice in writing before the expiration of this ~se, and, likewise,said lease may be renewed for a third year the same manner and upon the same terms and conditions. On motion of Commissioner Lesher, seconded by Commissioner Williams and carried, the Commission next authorized the delivery of two Refunding Series "E" Bonds Nos 28 and 29, dated March l, 1941, payable September l, 1977, with coupons due September l, 1947, and subsequent coupons attached, to Central Trust Company New York City, in exchange for two Refinancing Series A-3 Bonds Nos ll and 12, dated January l, 1928, due January l, 1931; also the payment of $480.00 to Central Trust Company for coupons Nos i to 12 inclusive, detached from said Refunding Series "E" Bonds. On motion of Commissioner Lesher, seconded by Commiszioner Williams and carried, the Florida Power & Light Company was next authorized and directed to discontinue the 250 C.P.Whiteway street light located at alley approach on south side of Second Street between Palmetto and Nagnolia Avenues, and to install a 100 C.P. overhead bracket light at this location. This whiteway light being removed in order for Holler lictor Sales to construct a driveway into their new building. On motion of Commissioner Lesher, seconded by Commissioner Bishop and carried, the Florida Power & Light Company was next authorized and directed to connect to their street lighting circuit the two discontinued whiteway lights located on north side of Commercisl Street between Palmetto and Hood Avenues in front cf the Bus Station. The Clerk next advised that the robbery insurance coverage in amount of $1,000.O0 for money and securitiee on hand at the City Hall is not sufficient to cover the weekly payrolls that now exceeds this amount. Thereupon Commissioner Bishop moved that the aforesaid insurance coverage be in- creased to $2,OOO.00, at a premium cost of $67.50 per year. Seconded by Commissioner Carraway and carried. On motion of Commissioner Bishop, seconded by Coa~issloner Williams and carried, Inspector Duncan was next authorized to attend the short course for dairy and milk inspectors to be held at the University of Florida on April 7-9,1947, the expenses in connection therewith to be borne by the City. On motion duly carried, Inspector Duncan was also authorized to attend the meeting of State Electrical Inspectors to be held in Orlando on April 28 and 29, 1947, the expenses in connection therewith to be borne by the City. On motion of Commissioner C,rraway, seconded by Commissioner Lesher and carried, the Commission next authorized the payment of expenses of N.O.Garner, Clerk of the Civil Service Board in connection with attending the conference of Fl~ida Association of Civil Service Boards to be held in Iiiami Beach on April 25 and 26, 1947. On motion of Commissioner Carraway, seconded by Commissioner Bishop and carried, the Commission next approved the conveyance without cost of Lot 17 of Block 7,Bel Air to S.H.Norrls, Veteran of World War II, and Lot 2 of Block 10 of Bel Air, to Samuel J. Rankin Jr., veteran of World War II; these lots having been reserved for veterans of World War II for the purpose of constructing dwellings thereon within six months from date of conveyance. Communication next read from the Florida League of ~unicipallties requesting the Commission to adopt a resolution urging the Legislature to suppor the cities' program for financial relief through the 1947 Session of Legislature, and the City Attorney was directed to prepare the necessary resolution for consideration. Communication next read from Mr Lyle T.Pritchard, Deputy Regional Director of the War Assets Administration, Jacksonville, notifying the City that the Revocable Permit granted it by the Navy under date of July 24, 1947, covering all of the Sanford Naval Air Station, including personal property, had been revoked, and canceled, effective as of April 15, 1947. Also, advising that the City's appl~ation had been accepted for transfer to it of that portion of the Sanford Naval Air Station that has been classified and designated as a Public Airport, and instructing the City to take possession of said airport property on April 3, 194~,( which has been done.) MINUTES 19 The City Nanager was next instructed to consider the City's obligations for maintain- ing and operating the airport in accordance with the provisions stipulated in the appli- cation of transfer under the Surplus Property Dispossl Act, and to make recommendations to the Commission at the meeting to be held on April 21, 1947. Consideration next given to the numerous complaints received by the Commission and Police Department against the noise from motorcycles operated without the proper mufflers. Thereupon after considerable discussion and on advice of the City Attorney that the City has an ordinance in effect prohibiting the operating of any motor vehicle without being muffled, the Chief of Police was instructed to enforce said ordinance by making all motorcycle operators conform to the regulations. The City Manager and Chief of Police were next directed to make a survey of the traffic congested street intersections and to make recommendations to the Commission as to any additional traffic signal lights that may be needed. Commissioner Bishop next introduced Ordinance No. 413, entitled: ORDINANCE NO. 413. Roy Browning, Lessee of the Nunicipal Airport and operator of the Sanford School of Aviation, next appeared and gave a report on the activities at the airport, including his commercial enterprises being operated in the hangar building in connection with his aviation activities, and requested that this area be excluded from the airport area proposed to be annexed to the City by the 1947 Legislature, so that his enterprises will not be governed by the rules and regulations of the City. Thereupon after careful consideration, and on motion duly carried, the Commission directed that the proposed boundaries of the airport property to be annexed to the City be changed so as to exclude the hangar and landing field area. On motion of Commissioner Carraway, seconded by Commissioner Bishop and carried , the Commission next authorized the high cost of living bonus of $10.O0 per month for all white employees and $5.00 per month for colored employees, be extended for another 60 days, including the month of Nay. The Nayor and Fire Chief Cleveland next recommended to the Commission %he employment of two additional firemen, one for each shift, in order that %he department have sufficient man-power to combat more than one fire at a time, inasmuch as the City is growing, with several new buildings constructed during the past year. Meeting called to order by the Chairman. The City ~anager next subm~ ted an estim~e on the cost of fertilizing, spraying and pruning the citrus grove at the municipal airport, as follows: 18 tons of ~-6-8 Fertilizer applied at $39.50 per ton $711.00 16,000 gallons of Bordol Emulsion Spray applied 416.O0 1,700 trees pruned at price of .20 per tree __3_~0 Total cost. $1,~?. OO Thereupon after considerable discussion, theCommission directed that Mr. Glen Lingle be requested to make an inspection of the citrus grove and to ~ubmit recommendations and estimates for further consi~eration of the Commission. On motion of Commissioner Williams, seconded by Commissioner Bishop and carried, the Commission next approved the purchase from Damon & Boles Company, Boston, Mass. of 20 Refunding Series "A" Bonds at a price of $650.00 each. The City Manager next advised that Mr James Hudson, who had the contract for con- structing the Tourist Information building, has completed his contract and is ready for final inspection and acceptance of the building. Thereupon the City Manager was authorized to make final inspection and accept the building on behalf of the City. A letter was next read from Title Guaranty & Abstract Company, requesting the CilV to furnish Quit-claim deeds on property that was acquired by the City thru foreclosure of its tax liens and then lost to the County thru foreclosure of its tax liens, in order that the new owner may clear the title to such properties. Thereupon after considerable discussion, and on motion of Commissioner Carraway, seconded by Commissioner Bishop and carried, the Commission authorized the Mayor and Clerk to furnish Quit-claim deeds at a price of $?.50 for each lot or parcel of land, to parties who have acquired such property from Seminole County, of which the City had previously acquired title thru foreclosure of tax liens. The City Manager next gave a report on his recommendations for curtailing the operating expenses at the municipal airport since the War Assets Administration had cancelled the Revocable Permit for operating the entire Sanford Naval Air Station property, which would necessitate dispensing of the services of the Superintendent, one fireman, and one laborer. Thereupon the City Manager was directed to notify Mr. Edmund B.Stowe, Supt. of the Airport, B.H. Giles, airport fireman, and one of the laborers, that their services would be discontinued as of June l, 1947, in order for the City to curtail the operating expenses to a minimum. Mr. C.A.~addy, Superintendent of the West Virginia Training School that has been operating a vocational training school at the Sanford Naval Air Station since October l, 1946, under the City's Revocable Permit granted by the Navy, which was cancelled by the
