The City Commission of the City of Sanford, Florida, met in adjourned regular session at the City Hall in the City of Sanford, Florida at 7:30 o'clock P.N.December 29, 19~7. Ordinance No. 428, entitled: ORDINANCE No 428 ~q ORDINANCE OF THE CITY OF S ANFORD, FLORIDA AUTHORIZING THE CITY CLERK OF SAID CITY TO TAKE AFFIDAVITS FOR ARREST FOR VIOLATION OF CITY ORDINANCES AND ISSUE WARP~qTS FOR SUCH ARRESTS AND AUTHORIZING THE CHIEF OF POLICE OF THE CITY OF SANFORD IN THE ABSENCE FROM THE CITY HALL OF.THE CITY CLERK TO TAKE AFFIDAVITS FOR ARRESTS FOR VIOLATION OF CITY ORDINANCES AND ISSUE WARRANTS FOR SUCH ARRESTS, AND AUTHORIZING EXECUTION OF SUCH WARRANTS ISSUED BY THE CITY CLERK OR CHIEF OF POLICE BY ANY POLICE OFFICER OF'THE CITf OF S~JqFORD. introduced and placed on its first reading at the regular meeting of December 8,1947 was next placed on its final reading and read in full by the Clerk. Thereupon the roll was called for the final passage and adoption of said Ordinance No. 428, the vote being as follows: Commissioner Gut Aye " Bishop Aye " Lesher Aye " ~iillams Aye Thereupon the Chairman announced that the City Commission of the City of Sanford Florida , by unanimous vote had passed and adopted said Ordinance No. 428, entitled: ORDINANCE No. 428 AN ORDINANCE OFiTHE CITY OF SANFORD, FLORIDA AUTHORIZING THE CITY CLERK OF SAID CITY TO TAKE AFFIDAVITS MCR ARREST FOR VIOLATION OF CITY ORDINANCES AND ISSUE WARRANTS FOR SUCH ARRESTS AND AUTHORIZING THE CHIEF OF POI ICE OF THE CITY OF SANFORD IN THE ABSENCE FROM THE CITY HALL OF THE CITY CLERK TO TAKE AFFIDAVITS FOR ARRESTS FOR VIOLATION OF CITY ORDINANCES AND ISSUE WARRANTS FOR SUCH ARRESTS, AND AUTHORIZING EXECUTION OF SUCH WARRANTS ISSUED BY THE CITY CLERK OR CHIEF OF POLICE BY ANY POLICE OFFICER OF THE CITY OF SANFORD. On motion duly adopted, Ordinance No. 428 was next ordered POSTED at the front door of the City Hall in the City of Sanford, Florida, in accordance with the terms of t he Charter, as amended. City Attormy Wilson next submitted the following letter of intent of the City of Sanford to lease to the West Virginia Training School, Inc. certain buildings and land at the Municipal Airport, and on motion duly carried, same was approved and the Mayor authorized to execute same on behalf of the City . "December 27, 1947 West Virginia Training School , Inc. Sanford, Florida. Gentlemen: If an when the City of Sanford, Florida, acquires title by deed from the United States to the property hereinafter described, and if permissible under said deed, the City of Sanford will lease to you the following buildings now located at what wz~s formerly the Sanford Naval Air Station at S~nford, Florida, namely: , H-8§796 MINUTES City Commission, Sanford, Florida, Deceabe~....29 a~-7-:-~0 -.19.47 PM Building No. 1 Building No. 2 Building No. 6 Building No. 74 Building No. 16 Building No. 14 Building Nos 25, 29, ~0, Building No. Building No 33 Building No 13 Building No 12 26, 2?, 2~ 31 and 32 Administration Building Marine Barracks Link Trainer Wave Barracks Ship Service B.O.Q Barracks Subsistence Cooks Quarters Brig Steam Plan% and the following land: The entire block that contains the Administration Building. The Marine Barracks and the Link Trainer. The entire block that contains the Barracks, the Subsistence Building, the Wave Barracks, the Cooks Quarters and the Brig, except two of the Barracks Buildings and land. That portion of the block %hat contains tae Ship Service Building. The south portion of this block starting with a line midway between the dispensary and the Ship Service. All the land west of Mellonvllle Avenue, south of the Ship Service block with the exception of a large right of way for the railroad. The East side of the Olock that contains the B.O.Q and J.O.Q Buildings divided by a line running north and south between the two buildings. For a term of 99 years from the 1st day of January , 1948, at and for an annual rental of $13,000.00 payable in semi-annual installments of $6500.00 each on the 1st day o f January and 1st day of July of each year, the first payment to be made as and of the 1st day of January 1948, for a perlod of 25 years from the 1st day of January , 19h8, and at the end of said period of 25 years at and for an annual rental of $10.00 per year payable annually in advance for the remainder of said term of 99 years. The lease shall be in such form as m~y be approved by the City Commission of the City of Sanford, and among other things shall contain the following provisions: 1. That the lease shall be subject to any and all conditions, coveBants and restrictions contained in the deed from the United States to the City of Sanford and also to any and all ~overnmental regulations in connection therewith. 2. That you are to maintain at your own expense all of the aforesaid buildings and keep the same in a state of sound repair. 3. That you are to pay for water and sewage disposal. 4. That you are to pay all taxes that may be levied upon said property. 5- That you are to operate the steam boiler plant and supply steam and hot water to other occupants of the property at an equitable rate. 6. That you agree to the City surveying and laying out streets and reservations for utilities. 7. That said lease shll be subject to forfeiture for aefault for a period of 30 days in the payment of any rental or for a default after 60 days notice in writing to remedy any failure to perform any other covenants on your part contained in the ~ ass. 8 That in the event any of the aforesaid buildings are destroyed or rendered untenantable by fire or the elements the aforesid rental shall be diminished in the proportion that the building or buildings destroyed or rendered untenantable shall bear to the value of all of s~ld buildings until the same are restored or rendered again tenantable by the City if it elects to restore or render the same tenantable; if the City shall not elect to restore the building or buildings destroyed or rendered untenantable the lessee shall continue to pay said rental in the diminished amount. The amount by which the rent should be diminished in the event said building or buildings are rendered untenantable by fire or the elements shall be determined by agreement between the parties or by arbitration if they can not agree thereon. 9 That said lease shall not be assigned without the consent of the Cityi itc successors or assigns, but it may contain a provision that you may sub-let portions of the buildings subject to the terms of this lease, but the City will, of course, look to you and not to the sub-lessees to carry out the terms of the lease. lC. The City will also furnish you with aoproximately 20 acres of land on the Sanford Naval Air Base for your farming purposes. The foregoing is to be treated only as an outline in general of what the City is willing to do in thematter of a lease to~ou and the foregoing provisions to be con- tained in said lease are not to be considered as complete, but only call your attention to certain provisions which the City will wish to assert in tae lease. Further consideration next given to the application of George C Harden to lease the back portion of airport property for grazing purposes. Thereupon after considerable discussion, final action was deferred, pending a survey of the property by the Commission. Consideration next given to the application o f Central Florida Foods Inc. to lease the Concrete Warehouse Building No. 9-A, located at the airport, effective as of January l, 1945. Thereupon after considerable discussion of the terms and conditions of the proposed lease agreement, the City Attor~y was directed to prepare said lease for a term of two years at a rental of $225.©0 p er month, subject to renewal at terms to be agreed upon. Pursuant to the request of Commissioner Lesher, the Neon Arts Sign Company of Orlando, next submittea plans and specifications of a proposed "Sanford Municipal Pier" sign to be installed on the bandshell building, of which the cost amounted to and same was taken under consideration. The service contract agreement wl~h W.M.Bishop for maintaining the police radio equipment was next submitted for further oonaideration, and on motion of Commissioner Bishop, seconded by Commissioner Williams and carried, same was approved and the Mayor and Clerk authorized to execute said agreement on behalf of the Ci~. Said agreement being in words and figures as follows: AGREENENT THIS AGREEmeNT Made and entered into in duplicate this 29th day of December 19~?, by and between the CITY OF SAN?OBD, FLORIDA, a municipal corporation, party of the first part, and W.M.BISHOP of Nlller & ~ishop Radio & Appliances, ll8 South ~ark Avenue, Sanford, Plorida, party of the second part, WITNESS~TH, that party of the first part hereby agrees that effective December l, 1947, and continuing from month to month thereafter until terminated as hereinafter provided, party of the first part hereby employs party of [the second part and gives to him the exclusive right to service, maintain, ~nd check all radio communication equipment, both mobile and fixed, now installed or hereafter installed in the police station or police automobiles or other police vehicles of party of the first part; each of ~uch installa- tions shall constitute one (1) unit, and on the first day o f each month during the term of this agreement, party of the f~st part shall pay to party of the second part the sum of Ten ($10.00) Dollars per unit agreement during the preceding month, 1948. for all units covered by the terms of this the first of such payments to be due January 1, Party of the second part hereby represents and agrees that he is the holder of operator's license P-?T-434, Radio-telephone Second Class issued to him by the Federal Communications Commission, and that under said license he ia duly authorized to perform services of the nature required by this contract on equipment licensed by Federal Communications Commission and party of the second part hereby undertakes to keep the radio communications equipment covered hereby up to the requirements of the Federal Communications Commission ; party of the second part further agrees that the services above specified to be performed by him shall include for each unit: (1) Frequency measurement at least once every thirty (30) days. Party of the second part agrees tha.t in case of emergency as to the fixed equipment covered hereunder, or as to the mobile equipment when more than one unit is involved simultaneously, he shall be ~ubJect to call at any hour day or night, mobile equipment when only one unit is involved, he shall be subject during daylight hours. IT IS NUTUALLY UNDERSTOOD AND AGREED: 1. That the dynamotor check herein provided as to the dynamotor as distinguished from the motor generator, wn~h is par~ of standard automobile equipment, and that this agreement does not cover any services to the primary source of supply which includes the automobile battery and motor generator. 2. That service required of party of the second part shall not include instal- lation or £einstallation of any unit, nor shall they requ~e the furnishing of any parts by party of the second part; any parts required by party of the second part for performance of his services hereunder shall be furnished by oarty of the first part in accordance with specifications furnished by party of the second part. 3. Either party shall have the right to terminate this contract at any time upon giving to the other party thirty (30) day's written notice of intent to terminate same. namely: signed by its City Clerk, all as and of the !03 and, as to the to call at any time to mobile equipment applies only 4. As of December 1, 1947, there are three (3) units covered by this agreement, One fixed unit at the police station, and two mobile units in police automobiles.
