The City Commission of the City of Sanford, Florida met in Regular Session at the City Hall in the City of ~anford, Florida at ?:30 o'clock P ~ January 6, 1948. Bradley Chief of Police, R G Williams Absent: Commissioner H.James Gut, Mayor. Meeting called to order by the Chairman. The proposed lease agreement with Central Florida Foods Inc, covering the concrete warehouse building No. 9-A at the Municipal Airport was next submitted for consideration. Thereupon Commissioner Carraway moved its approval and that the Mayor and Clerk be authorized to execute same on behalf of the City upon receipt of deed of conveyance of the property from the War Assets Administration. Seconded by Commissioner Lesher and carried. Said Lease Agreement being in words and figures as follows: LEASE THIS LEASE, Made and entered into in duplicate on the between CITY OF SANFORD, FLORIDA, a municipal corporation, 1st day of January,1948, hereinafter referred to as Lessor , and CENTRAL FLORIDA FOODS, INC. a corporation organized and existing under the laws of the State of Florida, with its prlncips1 office at Sanford, Florida. hereinafter referred to as Lessee, WITNESSETH: That the Lessor, for and in consideration of the rentals agreed to be paid and covenants to Oe performed by the Lessee, has lease and let and by these presents does lease and let unto the Lessee the following described property, situated at what was formerly the Sanford Naval Air Station, in Seminole County, Florida, to-wit: BUILDING No. 9-A ( Concrete ~lock Warehouse Building ) and land lmmealately contiguous thereto necessary to the maintenance and operation thereof. TO HAVE AND TO HOLD the above described property unto the Lessee for a period of two (2) years from the date hereof at and for a rental of TWO PrUNDRED TWENTY FIVE DOLLARS (225.00) per month in advance, subject to renewal at the expiration hereof upon such terms and for such rental as may be agreed to between the Lessor and Lessee. The Lessee has rented the above described property of and from the Lessor at and for the the aforesaid rental of T~O HUNDRED T"~NTY FIVE DOLLARS(S225.00) per month payable in advance, the first month's rental having been paid upon the execution and delivery of this lease, and a like rental to be paid on the first day of each and every calendar month after date hereof for and during said term. The Lessor and the Lessee do further covenant and agree to and with each other as follows: 1. The Lessee has inspected said property and accepts the same in its present condition, and agrees to maintain and keep at its own expense the interior of the aforesaid building in good repair and the grounds surrounding it in good condition and aonearance, and in accordance with the requirements of Lessor and the Civil Aeronautics H-$9796 MINUTES !05 City Commission, Sanford, Florida, Jan 6 ..at 7:30.P N .... 19 .t~8 2 The Lessor shall maintain and keep the exterior of the aforesaid building in good repair, of which the Lessor shall be the judge. 3- In the event the above described premises shall be so damaged by fire or the elements as to be untenantable, Lessor shall in its discretalon determine whether the expense is too great to restore and repair said demised premises, and should Lessor determine not to repair said leaae~premises this lease shall cease and determine, and the rent shall abate from the time said demised premises became untenantable. In the event the demised property shall be so damaged by fire or the elements and Lessor determines to promptly repair the same, the rent shall be abated corresponding with the time and extent to which said property cannot be used by Lessee after damage occurred and before repair. 4. This lease and the Lessee shall be subject to the restrictions, terms and conditions of the Federal Government during the existence of any emergency declared by the President of the United States or the Congress thereof, and also subject to all conditions, covenants and restrictions embodied in Lessor's title to said property. 5. That the Lessee shall promptly pay all bills for utilities service. 6. The Lessor shall have the right to enter the premises at any time during the said lease for the purpose of inspecting the property in order to determine the terms and conditions of said lease are being oOserved and carried out by the term of whether Lessee. 7. The Lessee shall, ations, attach fixtures during the term of said lease, have the right to make alter- and erect partitions and signs in and upon the premises, which fixtures, alterations or signs so placed in or upon or attached to said premises shall be and remain the property of the Lessee and may be removed therefrom upon the termination of the lease, and the Lessee, if reeuired by the Lessor, shall, upon the termination of said lease, restore the said premises to the same conditions as that existing at the time of the Lessee's entering upon the same under said lease, reasonable and ordinary wear and tear and damage by the elements or by circumstances over which the Lessee has no control, excepted, provided, however, that if the Lessor requires such restoration the Lessee shall be given written notice thereof by the Lessor at least thirty (30) days before the termination of this lease. 8. The Lessee shall not assign said lease or sublet any of said property without the written consent of the Lessor. 9. Default for a period of ten (lO) days monthly rentals or default after thirty (30) at its last known address, in the performance by the Lessee of any of the other covenants contained in said lease on its part to be performed shall work an immediate forfeiture of said lease and the Lessor shall have the right to enter upon said property and retake possession thereof without the necessity to resort to process of law therefor. lC. The Lessee shall surrender possession of all of the aforesaid property at the of said term or the earlier termination of s~id lease, unless said lease is renewed, in as good condition as elements excepted. On motion duly carried, theCity Attorney was next authorized to prepare a lease agreement with P.N.Campbell covering the garage building No. 76 at the airport for a term of two years at a rental of $30.00 per month, subject to renewal at terms to 'be agreed upon. The lessee to maintain the building and premises in good condition at his own expense. The City Manager next reported of approximately ?0,000 gallons of aviation gasoline stored in the twelve underground tanks at the airport that were not declared surplus by the Navy, and that both the Navy and War Assets Administration had advised that it would be left in the tanks, which are being conveyed to the City: Also advising of the very dangerous fire hazard existing at the airport because of this gasoline, which is becoming more hazardous with the increased activities on the airport, and that it should be removed and the tanks filled with water in order to eliminate this hazard. Thereupon after considerable discussion, it was felt t~at tae City should take the necessary precautions to safeguard the propert~ and life at the airport by eliminating this existing hazard, and on motion duly carried, the City ~anager was directed to call for bids for the sale and removal of this gasoline from the underground tanks, for consideration of the Commission. The report prepared by Smith & Gillesple, Engineers, of comparative costs of the Eunlcipsl Water Plant operations, using diesel engine drive and purchased power, was next submitted for consideration. Thereupon after a careful study of the comparative costs as shown in the report, as a result of which it was found that the cost comparison for the two methods of operation showed it to be more economical for the Clty to continue using diesel engine drive, based on the operation of the plant as it exists today, and on motion of Commissioner Lasher, seconded by Commissioner Carrawsy and carried, the Commission accepted the findings of the report and ordered the standby service of the Florida Power & Light Company discontinued. Commissioner Lesher next moved that a request be suOmitted to the Florida Power & Light Company for an adjustment of their bill for standby service during the period of time the comparative report was being prepared by Smith & Glllespie. Seconded by Commissioner Carraway and carried. Communication next read from Fred t~ Bender reauesting an additional 3© days extension on his option to purchase lots 48 thru 55 of J.E.Pace's Subdivision MINUTES !07 City Commission, Sanford, Florida, ,Jan d a~ 7: 30 P M .... 19 1~ $3,000.00 Thereupon Commissioner Carraway moved that Mr. Bender be granted until January 30, 194~, to exercise his option to purchase the aforesaid property, with the understanding that no further extension will be granted. Seconded by Commissioner Bishop and carried. Request next received from Jack Manner for a "Loading Space" in front of his Glass Store at 215 Sanford Avenue and same was referred to Chief of Police Williams for recommendations. Request next received from A.Wieboldt for a "15 minute parking space" in front of his studio at 210 Park Ave, and same was referred to Chief of Police Williams. TheCity Manager next reported of alleged claim of Mr. Rlssell for damages in amount of $20.00 bo his automobile that was caused by running into a manhole obstruciing the alley between Myrtle and Elm Avenues and Thirteenth and Fourteenth Streets under date of December 31, 1947; stating that he had investigated the claim ana found that t~e accident was caused by Nr. Rlssell's automoOile oe±ng of the low underslung type with less t~an six inches clearance, and that the actual damages to ~he automobile amount to $20.00, according to eeti,~te of Ratliff & Sons. Thereupon after conslSerable discussion, and on motion of Commissioner Lesher, seconded by Commissioner Bishop and carried, the Commission authorized payment of the aforesaid damages in amount of $20.00. There Delng no further ~usines~ to be transacted by the out-going Board, Commissioner Carraway moved that the meeting adjourn sine die. Seconded by Commiseloner Lesher and carried. At thie time Mr. Biehop expressed his thanks and appreclstion to the members of the Commission and the employees in the various departments of the City for their co- operation during his terms of office as Commissioner. The Commission then re-convened for the purpose of organization, Mr. R~ndall Chase and Mr. John Erider Sr, signing the oath of office and being seated as Commissioners of the City of Sanford, Florid~ , for three year term. Thereupon Commissioner Carraway moved that Commissioner Chase be made ~emporary Chairman, pending the election of a Mayor. Seconded by Commissioner Williams and carried. The firs~ order of business being the electlon of a Mayor for the ensuing year, Commissioner Lesher nominated Commissioner Williams as Mayor of the City of S~nford, Florida, for the year 194g. Seconded by Commissioner C~rraway. There being no further nominations, Commissioner Erider moved that the nominations be closed. Seconded by Commissioner ~esher and carried unanimously. Commissioner Lesher then moved that the Clerk be i~ tructed to cast a unanimous ballot for the e~ection of Commissioner Williame as .~ayor of the City of Sanford for the' unsulng year. Seconded by Commissioner Krider an~ carried unanimously. The resignation of Mred R.Wilson as City Attorney, effective as of January l, 194~, was next submitted for further consideration. Commissioner Chase then moved that ~r. Thereupon Mr Wilson acceptea the request of the Commission by agreeing to serve in the capacity of City Attorney until September 30, 1948. The proposal of Ne~Arts Sign Company of Orlando for constructing a "Sanford Nunioipal Pier" sign on the bandshell at a cost of $465.00 was next s~bmitted for further consideration. Action deferred. Consideration next given to installing a traffic signal light at intersection of Park Avenue and Seminole Boulevard in order %o eliminate the existing traffic hazard at this intersection. Thereupon after considerable discussion, Commissioner Chase moved that the Chief of Police invite the State Safety Division's Engineer to make a survey of this traffic problem with a view to making recommendations as to the type of signal light needed at Shis intersection, and to submit such recommendations to the Commission at the next regular meeting.
