The City Commission of the City of Sanford, Florida met in regular session at the City Hall in the City of Sanford, Florida at 7:30 o'clock ? M January 26, 1948. Bradley Chief of Police R.G.Williams Meeting called to order by the Chalrmsn. Mrs W M Collins next appeared and requested an adjustment of her unpaid taxes against Block 24 of Mellonville, for years 1938 thru 1947. Thereupon after considerable discussion and due to the fact that Mrs Collins had not received an answer to a similar request made at the meeting of November 24, 1947, Mayor Williams appointed a committee consisting of himself and Commissioners Chase & Lesher to inspect Mrs Collins' property at ll:OO o'clock A.M.Tnursday , January 29,1948 , and to make a report at the next regular meeting of the Commission to be held February 9, 1948. Mr.A.B.Stevens next appeared before the Board and requested his vacant lot property described as Lots 9 and l0 Block 14 Tier 3, E.R.Trafford's Map, be rezoned for commercial purposes. Due to the fact that the Commission had previously adopted a policy of not considering the rezoning of any property unless recommended by the Zoning Board, ~r. Stevens referred to the Zoning Board. Report of January analysis of milk from all dairies operating in Senford as prepared by Dr. L.R.Scribner's Laboratories at Orlando, next submitted, such report showing all such milk within the requirements of Grade "A" milk. Thereupon after considerable discussion as to the method of obtaining samples of milk for such report, and as to the sanitary condition of the dairies, Inspector Duncan was instructed to inspect the various dairies and to require the use of hoods over the top of bottles as required by State Law. Report next submitted from the Prison Division of the Department of Agriculture, rela- tive to their recent inspection of the City Jail, such report saowing the Jail to be ina sanitary and satisfactory condition. On motion of Commissioner Chase, seconded by Commissioner Carraway and carried, the Board next authorized the annual payment of $1,100. O0 to the Federal Works Agency, l'or rental purchase on the Chamber of Commerce Building. On motion of Commissioner C~rraway, seconded by Commissioner Krlder and carried, the Board next authorized the purchase of Lots 5 and 4 Block C, First Street Extension, in Fort Mellon Park, from Nra L.A. Wlsenbaker at a price of $1.O00.00. On motion of Commissioner Carraway, seconded by Commissioner Lesher and carried, the Board next authorized the purchase of one Refunding Series "B" Water Bond from Crummer Company, Orlando , at a price of $860.00. On motion of Commissioner Krider, seconded by Commissioner Chase and carried, the Board next authorized the purchase of l0 Refunding Series "A" Bonds at a price of $530.OO each, and necessary to carry out transfer of said property PASSED AND ADOPTE~ by the City Commission of meeting assembled this 26th day of January,1948. Thereupon after considerable discussion, the City Manager was instructed to use available funds in the Sinking Fund and to purchase bonds when they are offered at a Iow price. Communication next received from the Legal Department of the War Assets Administration enclosing the official form of application for acquiring supplemental portion of airport property under Public Law No.289, together with form of resolution to be adopted by the Commission authorizing said application to be executed by the Mayor and the Clerk and also the acceptance of the Property. Thereupon Commissioner Chase introduced Resolution No. ?28 and after being read in full by the Clerk, moved its passage and adoption. Thereupon Commissioner Carraway moved its approval, and that the Mayor and Clerk be authorized to execute same on behalf of the City. Seconded by Commissioner Lesher and carried. That upon acquiring title to the above described property, the party of the first part will execute and deliver to the party of the second part a written lease which shall contain the following provisions: 1. Said lease shall be for a term of one year, from the 1st day of FeOruary,1948 ,at a rental of TWO HUNDRED DOLLARS ($200.00) per month, payable in advance on the first day of each month, subject to renewal at the expiration thereof for an additional one year at the same rental of TWO HUNDRED DOLLARS ($200.00) per month, with option to renew at the expiration of the second year upon such terms and such rentals as may be agreed upon. 2. The Lessee has inspected said property and accepts the same in its present condition and shll maintain and keep at its own expense the aforesaid building and all equipment in good repair and the grounds surrounding it in good condition and appearance, and in accordance with the requirements of the Lessor and the Civil Aeronautics Administration. 3. In the event the above described premises shall be so demaged by fire or the elements as to be untenantable, Lessor shall in its discretion determine whether the expense is too great to restore and repair said demised premises, and should Lessor determine not to repair said leased premises, this lease shall cease and determine, and the rent shall abate from the time said demised premlses became untenantable. In the event the demised property shall be so damaged by fire or the elements and Lessor determines to promptly repair the same, the rent shall be abated corresponding with the time and extent to wnlch said property cannot be used ~y Lessee after damage occurred and before repair. Jan~!'X .26 .at Z.;.3.Q...~...~9 4~ by the Federal Government and Civil Aeronautics Administration concerning said property and also subject to the restrictions, terms and conditions imposed by t~e Federal Government during t~e existence of any emergency declared by the President of the United States or the Congress thereof, and also subject to all conditions, covenants and restrictions embodied in title to said property. 5. The Lessor shall have ingress and egress to the north end of said property for the purpose of maintenance and repair of overhead steamline and underground sanitary sewer line installed thereon. 6. The Lessee s~all promptly p~y ~ll bills for utilities services. 7. The Lessor shall have the right to enter the premises at any time during the term of this lease for the purpose of inspecting the property in order to determine whether the terms and conditions of this lease are being observed and carried out by the Lessee. 8. The Lessee shall , during the term of~this lease, have the right to make alterations attach fixtures and erect partitions and signs in and upon the premises, which fixtures, alterations or signs so placed in or upon or attached to said premises shall be and remain the property of the Lessee and may be removed therefrom upon the termination of this lease, and the Lessee, if required by the Lessor, shall, upon the termination of this lease, restore the said premises to the same condition as that existing at %ne time of the Lessee's entering upon the same under this lease, reasonaOle and ordinary wear and tear and damage by the elements or Oy circumstances over which the Lessee has no control, excepted, provided, however, that if the Lessor requires such restoration the Lessee shall be given written notice thereof by the Lessor at least thirty days before the termination of this lease. 9. The Lessee shall not assign this lease or sublet any of said property without the written consent of the Lessor. lC. Default for a period of ten (lC) days in the payment of any one of the aforesaid mohthly rentals or default after thirty (30) d~ys written notice mailed to the Lessee at its last known address, in the performance by the Lessee of any of the other covenants contained in this lease on its part to be performed shall work an immediate forfeiture of this lease and the Lessor shall have the right to enter upon said property and retake possession thereof without the necessity to resort to process of law therefor. ll. The Lessee shall surrender possession of all of the aforesaid property at the end of said term or the earlier termination of this lease, unless this lease is renewed, in as good condition as the same now is, ordinary wear and tear and damage ~y t~e elements excepted. Thereupon after considerable discussion Commissioner Lesher moved that the Commission would not consider Mr. Harden's application, but would consider dividing the property into farming and grazing areas. Seconded by Commissioner Krider and carried. Commissioner Krider next moved that D.C.Stafford, Master Electrician, J.C.Jobe, Journeyman Electrician and G.L. Duncan, Building Inspector be appointed as the Board of Electrical Examiners for the year 19~8, in accordance with Ordinance No. 2?4 governing electrical construction. Seconded by Commissioner Lesher and carried. Commissioner Lesher next moved that M.G. Hodges, Master Plumber, John Baker, Journeyman Plumber and G.L. Duncan, Plumbing Inspector be aopointed as the Plumbing Board for the year 19~ in accordance with Ordinance No. 287. Seconded by Commissioner Carraway and carried. Supt. of Parks, $.M.RiChard next submitted an estimate of $522.50 for moving and reconstructing the fence at the ~unicipal Ball Park. Thereupon after considerable discussion, and on motion of Commissioner Chase, seconded by Commissioner Lesher and carried, the Board authorized Mr. RiChard to move and repair the aforesaid fence at a cost not to exceed $522.5© On motion duly carried the Board next authorized a "15 minute parking Zone" in front of the Donut Shop at 207 W. First Street, owned by J.F.Harrison. On motion duly carried the Board also authorized a "15 minute parking Zone" on Oak Ave. adjacent to the Launderette located at Second & Oak Ave. Communication next received from Mr H J Lehman, Manager of the ~an~ord State Farmers' Market, requesting the installation of a Flashing Signal Light at the corner of Thirteenth Street and Fench Avenue, and additional street lights along French Avenue. Thereupon after considerable discussion and due to the heavy amount of traffic in the vicinity of Thirteenth Street and French Avenue and also the fact that there is a railroad crossing at the aforesaid intersection, Chief of Police Williams was instructed to make an investigation and to recommend the type of traffic signal to be lnstslled. Also the City ~anager was instructed to have the Wlorida Power & Light Company make a sur- vey and to submit the cost of additional street lights. Communication next read from the Seminole County Sportsman Association relative to closing the lakefront 0oulev~rd, from Sanford Avenue to the ~ayfair Inn on February 25, 1948, for the purpose of a demonstration of fire arms by the Wincehster Arms Company. Thereupon after considerable discussion, Commissioner Lesher moved that the request of the Seminole County Sportsman Association 'be granted. Seconded by Commissioner Carraway and carrie~ City Attorney Wilson next submitted a legal opinion relative to repealing the ordinance esta~lishing a Public Parking Lot. No.239, passed and adopted April 8,1935, dedicating Lots y, 8,9 and 10 Block 4 Tier 1 of Sanford for the public use of oarking vehicles thereof by the general public,subject to the control and government thereof by the City of Sanford, with the right reserved to the City to use so much or such parts of the lands for such purposes as the govern- ing authority may deem necessary, I wish to say that I have been unable to find any decision by the Supreme Court of ~lorida determining this question, but I may say that it is generally the law that if there is a dedication of property to public use, and the dedication is accepted by the public it can not be revoked ( 12 Corpus Juris llS, Sec 148) and this rule applies to a public body making a dedication as well as private individuals, DavenpOrt vs. Burlington, 97 Fed.234, 46 LRA 37Y- Whether or not the public has accepted the dedication of the property for public use would be a question of fact to ~e determined by evidence offered. The burden would be on the public to show that the dedication had been accepted, but as above stated if it has been accepted I do not think the City would have the right to repeal the ordinance. On motion duly adopted, Ordinance No. 430 was next Ordered POSTED et the front door of the City Hall in the City of Sanford, Florida, in accordance with the terms of the Charter, as amended. Consideration was next given to the advisability of the City contracting the Dredging Contractor, who is at present working on the channel in Lake Monroe, for the purpose of filling in some of the proposed terminal property. Supt. Lubinskl was instructed to ascertain the amount of fill that will be required and to communicate with the contractor to determine how much fill he will furnish. The City Manager next reported on the conference he had with Geo. G. Ehrenborg, Dallas, Texas, and of the communication he had received from two other Appraisal Engineers, Cole-Layer-Trumble Co, Dayton Ohio, and J.M.Cleminehaw Co, Cleveland, Ohio , relative to revaluation of all property for taxable purposes. Thereupon after considerable discussion, the City Manager was instructed to have the three companies make a survey and to submit a price for the revaluation of all property for taxable purposes. Commissioner C~rraway next moved that the high cost of living bonus of $10.00 per month belng paid to white employees and $5.00 per month to colored, be continued thru the month of March,1948. Seconded by Commissioner Chase and carried. On motion duly carried, the Commission authorized the salary of R.O. Gnann, fireman be increased to $148.50 per month effective January 15, 1948. Consideration was next given to the unsatisfactory living conditions of the fire station as reported by Commissioner Chase. Thereupon after considerable discussion and on motion duly carried, the City Manager was instructed to ascertain the cost of repairing or purchasing a new refrigerator and stove as well as the Installs%ion of a sink in the kitchen in the fire station.
