Meeting called to order by the Chairman. Mr G W Spencer, Attorney for John A Hall, colored, of 901 W. 13th. St. next appeared before the Commission relative to the City's action of June 14, 194~, instructing tdue Tax Collector not to renew his beer and wines license on October l, 1948. Mr SNencer then presented Naude Collins, 910 7. l~th St. ; Jessie and Nelson Ellerby, 13th.and Clark Streets, Queen Whitson, 1302 Clark; William King, 10th and Holly Ave.; Evans Elton, 1014 Avacado Ave and Eliza and Ethel Edwards who.live behind 901 W. 13th Street; all colored and neighbors of John A Hall who stated that Hall's olace was an orderly place of business and recommended the renewal of his permit to sell beer and wines. Thereupon after considerable discussion Commissioner Chase moved that the action of the Commission of June 14th be rescinded, due to the fact that ~ere is apparently no just c~use why a license should not be issued. Seconded by Commissioner Krider and carried. Mr. George Hennessy of The Lumlno Co. of Orlando next appeared before the Board and presented a letter setting forth the extra hours incmred in connection with the water- proofing of the City Hail building and the sandblasting which they did not contemplate when the bid was submitted. Thereupon after considerable discussion, Acting Mayor Lesher appointed Commissioner Krider to meet with the City Manager and Mr. Hennessy to review the matter and to report back to the Commission. Mr Gilbert A Williams, of 1208 W. 13th St. next appeared before the Board and further requested a transfer of the beer and wine license from Louis Perides to him; ~r. Williams stated that he had purchased the business from Mr. Perides, who had previously purchased it from Bertha Spann, but that Perldes had failed to get the license transferred. Thereupon Commissioner Chase moved that the matter be referred to the City Attorneys. Seconded by Commissioner Krider and carried. Consideration was next given to the J.T.Allen home at 619 l-~urel Avenue , on which the City foreclosed in 1941 due to the nonpayment of ps. vlng assessments and taxes for the years 1928 thru 1940 in amount of $411.96. The City 5~anager advised that the family w~s not financially able to buy the property at that time and that the Commission considered it s charity case, and tn~t the City and County'adopted resolutions exempting the property from taxes as long as it w~s considered a charity case. Mr. Allen's daughter, ~.~rs. Alexander, a?peared Oefore the Bo~rd and stated theft she desired to redeem the property and requested that the Commission ~. In accordance with regulations governing the holding of Primary Elections, and on motion of Commissioner Chase, seconded by Commissioner ~rlder and carried, the ~.~ayor was next authorized to issue sn election proclamation calling a Primary Election to be held on November 2, 1948, for the purpose of selecting two nominees for the position of City Commissioners, one to fill the vacancy created by the expiration of the tern: of office of Co~nissioner Robert A Williams, and the other to fill the Vacancy created b~. the expiration of the term of office of Commissioner Lea R. Assignment or Sublettln~. The LESSEE shall not assign this lease or sublet any of said property without the written consent of the LESSOR. 14 Default of ~ayment. Default for a period of ten days in the payment of any one of the aforesaid monthly rentals or default after thirty days written notice mailed to the LESSEE at its last known address, in the performance by the LESSEE of any of the other Covenants contained in this lease on its part to be performed, shall work an immediate forfeiture of this lease and the LESSOR shall have the right to enter upon seid property and retake possession thereof without the necessity of resort to process of law b~erefor. 15. ~urren~e_ring of POssession of P~o_Re~r_ty' The LESSEE shall surrender possession of all of the aforesaid property at the end of said term or the earlier termination of t~is lease, unless this lease is renewed, in as good condition as the same now is, ordinary wear and tear and damage by the elements excepted. 16. J.Brailey Odham next appeared before the Board relative to the Used Car deslers' license stating that he felt a license of ~00.00 was too high and reauested a reduction. Thereupon Commissioner Chase moved that the City Attorney orepsre sn ordin~nce amending the license ordinance whereby all sutomobile deslers, whether selling new and/or used cars shall pay ~n annual license tax of ~50.00. Seconded by Commissioner Krider end carried. On motion of Com~,issloner Chase, seconded by Commissioner Krider ~nd carried, the Commlss~n next approved the transfer of the beer and wine license from Frenk Thomas to Sylvester Burley at 412 S. Sanford Ave, provided the old license is su~,rendered to the City and canceled. Seconded by Commissioner Krider and carried. Application next received from S.A. Allen for s franchise to operate a bus line of two busses in the City, and requesting a letter of approval to be suomitted to the Railroad Commission. Thereupon Commissioner Chase moved that a let%er of agreemen~ Se addressed to ~r. Allen stating that the City would a~re~e to give ~. Allen a franchise to operate a bus line, subject to his securing the necessary insurance and that routes will be agreed upon prior to the issuance of the franchise. Seconded by Commissioner Krider and carried. Nr. Allen also recommended that the City pass an ordinance requiring that all taxicabs be equipped with governors so that the speed of such cabs will not exceed 38 miles per hour. l~atter taken under advisement. Application next received from Pentland & Gray, Accountants and Auditors for the regular annual audit of the City's books covering the fiscal year ending Seotember 30, 1948; the agreement being thet the total cost of the audit will not exceed ~1,050.O0, and that if any saving in time can be effected, the City will receive the benefit of such saving. Thereupon Commissioner Krider moved that Pentland & Gray be awarded the annual of the City's books forthe fiscsl year ending audit September 30, 1948, in accordance with the terms of their application. Seconded by Commissioner Chase and carried. Damage by Fire or Elements. In the event the aOove descriDed premises shall be so damaged by fire, war, windstorm or any of the other elements as to ~ e untenantable, LESSOR shall in its discretion determine whether the expense is too great to restore and repair said demised premises; and should LESSOR determine not to repair said leased premises this lease shall cease and determine, and the rent shall abate from the time premises became untenantable. In the event the demised said demised/property shall be so damaged by fire or the elements and LESSOR determines to promptly repair the same, the rent shall be abated corresoondlng with the time and extent to which said property cannot be used by LESSEE after damage occurred and before repair. 12. Right to Nake Alterations, attach fixtures, and erect Partitions by Lessee. The LESSEE shall, during the term of thl~ lease, have the right to make alterations, attach fixtures and erect partition~ and si~ns in and upon the premises and the LESSEE, if required by the LESSOR, shall, upon the termination of this lease, restore the said premleses to the same condition as that existing at the ti~ of the LESSEE's entering upon the same under said lease, reasonable and ordinary wear and tear and damage by the elements or by circumstances over which the LESSEE nas no control, except, proviCed, however, that if the LESSOR requires such restoration the LESSEE shall De given written notice thereof by the LESSOR at least thirty (30) days before the termination of this lease. The LESSEE shall have the right at the termination of this lease to remove any machinery and equipment installed by them in said premises provided that they are not in default in the performance of any of their covenants herein contained, and that any damage caused by removing said machinery or equipment shall be promptly and properly repaired. 13. Assigq~nt or Subletting. The LESSEE shall not a~sign this lease or sublet any of said property without the written consent of the LESSOR. 14 Default of .~ayment. Thereupon Commissioner Carraway moved that the City Attorney notify the South Atlantic Gas Co. to service the property between Park and Nagnolia Avenues and Fourteenth and Fifteenth Streets. DuHart to move his second hand lumber yard from 909 Sanford Ave. and locate it in the proper zone. On motion of Commissioner Carraway, seconded by Commissioner Chase and carried, the Commission next appointed H.James Gut, W.C.Hlll, Karlyle Housholder, Frank S. Lamson, Fred R.Wilson, W.A.Leavltt, Geo. ASpeer Jr., A.Edwin Shinholser and E.G. Kllpatrick Jr. as a committee to revise the City Charter for approval at the 1949 Session of Legislature inasmuch as the Charter has not been revised since 1923, with the exception~of a few amendments. Consideration was next given to the hospital and medical bills incurred by Joseph Garvln, colored, who was shot by Patrolman Charles B Sparks in amount of $600.00, less 50~ to Dr. Charles Park;~O. OO, less 50% to Dr. O.L. Barks and $4~4.29 to Fernald-Laughton Nemorial Hospital. Thereupon Commissioner Chase moved that t~e aforesaid bllls be pald before the end of the next fiscal year. Mr. Donovan Dean and W.H.White, Architects, Orlando; Robert Michaels of the firm of A.P.Miohaels, Engineer, Orlando; and Jack Ratigan of the City Recreation Committee next appeared before the Commission to discuss the proposed swimming pool. Mr. Dean submitted plans for an aboveground pool as well as a partially underground pool. He stated that the estimated cost for the above ground pool would be approximately $41,O00.00 including the treatment plant of $15,OO0-O0- Mr Michaels discussed the construction of a steel reinforced concrete block pool as compared with the conventional poured concrete pool, as being adequate to withstand the water and ground pressure and stated that he would endorse the construction of such a pool.
