Bids next submitted for furnishing a new automobile for the Police Departme~ and same was referred to a committee of three consisting of the City Manager the City Attorney and Commissioner Carraway to tabulate and make e recommendation to the Commission st the MINUTES 3! 7 City Commission, Sanford, Floxida, ........... Seconded by Commissioner Chase and carried. On motion of Commissioner Carrawsy, seconded by Commissioner Chase and carried, the Commission next authorized the license tax in amount of ~25.O0 be refunded to the American Title & Insurance Co., which was paid by them in error for Girard Croxton. The Clerk advised that the Company had paid the same llcense for Crumley & ?onteith who is now representing them. On motion of Commissioner Carraway, seco~ed by Commissioner Chase ant carried, the Commission next approved the ~mployment of William M ~esser Jr. as Pollce Patrolman at a salary of $1Y4.56 per month, to fill the vacancy c~ested by the resignation of H.M.Young on December 16, 1948. The City l~ar~ger next reported that the Banlore Liotor & Equipment Company, would not accept delivery on the 1948 Ford Tudor Sedan, for which they nad offered tae City l,45o.oo. that of Thereupon Commissioner Carraway movedth~t.~ the City accept the next the Sanford Buick Compsny in amount of $1,360.00. Seconded by Cormmissioner Krider and carried. highest offer, Bill next submitted from Dr. T.F.McDaniel in amount of $9.00 for medical treatme~ to Randolph Crow, who was hit with a baseball while olsying ball under the summer recreation program. Thereupon after considering the facts of the case, the Clerk was instructed to return the bill to Dr. }~cDaniel, due to the fact that the City was not liable for such damages. Consideration was next given to the request of Clifford Clements of Birmingham, Ala. to lease a tract of land 200 feet by 150 feet in the northwest corner of Fort [.~ellon Park for the purpose'of i~ talling and operating a miniature golf course and miniature train. Thereupon after considerable discussion and due to the fact that the west end of the park is landscaped, tne City Manager was instructed to offer 5~r. Clements a tract of land in the east end of the park for the operation of his miniature train and golf course. Ordinance No. 443 entitled: ORDINANCE No. 443. AN ORDINANCE REPEALING ORDINANCE NO 2~6 OF THE CITY OF SANFORD, FLORIDA, regulating sales of used motor cars,and deflnlng terms, prescribing license taxes and duties, and providing penalties in regard thereto, passed and adopted December 12, 193~: Defining the terms "NEW CAR DEALER" USED CAP DEALER" "USED CAR SALES}lAN" , and "NE~ CAR S~LES~t&N", PRESCRIBING A LICENSE TAX FOR NEW CAR DEALERS AND USED CAR DEALERS, AND FOR SALES~EN OR REPRESENTATIVES OF AGENCIEs OR DEALERS IN NEW ~D USED ~OTOR CARS v~ICH AGENCIES OR DEALERS ARE NOT LICENSED BY THE CITY OF SANFORD, PRESCRIBING BUSINESS LOCATION STAND&RDS FO~ NEW CAR DEALEZS,AND LICENSE REQUIR~fENTS FOB NEW AND USED CAR DEALERS, AND PROVIDING A PENALTY FOR THE vIOLATION OF THIS ORDINANCE. introduced and placed on its first reading at the regular meetln~ of December 13,1948 was next taken under consideration. Thereupon Commissioner Chase moved that Section 8, referring to the State Law be deleted therefrom. Seconded by Commissioner Carraway and carried. Said Section 8 readirg as follows: SECTION 8."No p~rson shall engage in or conduct the business of new car dealer or used car dealer, as hereinabove defined, in the City of Sanford, nor be issued a licen~ MINUTES ~ b r 27 at v:~O P ~9 28 City Commission, Sanford, Florida,_._...~--~-~f~-----e-- ......... ~. ............ , ....................... with the provisions of Section 320.27 Florida Statutes, Laws of Florida, 1947." 1941, as amended by Chapter 23660 Mr John Gore of 101g W.First Street next appeared before the Board relative to the continuous burning at the City Dump, stating that it was an unhealthy situation for the residents in the vicinity, due to the fact that the wind blows the smoke into their homes. Thereupon after considerable discussion, the matter was referred to the Oi~v Kanager and Sanitary Officer to endeavor to locate a more suitable tract of land for the City Dump and to make a recommendation to the Commission. On motion of Commissioner Carraway , seco~ed oy Commissioner Krider and carried, the Co~ission next accepted the resignation of H.N.Sayer as City I~.~ansger. Application next received from Clifford ~cKibben Jr, of Winter Park, for the posi- tion as City ~.~a~ger. Thereupon Commissioner Carraway moved that Clifford ~cKibben Jr. be emoloyed ss City Manager, effective February l, 1949, at an annual salary of $6,500.00, ~d that he be furnished an automobile for his use while on official business. On motion of Commissio~r Csrraway, seconded by Commissioner Chase and carried, H.N.Sayer was requested to accept the position of Acting ks. nag until Feb. lat. Consideration was next given to H.N.S~yer's salary as City Clerk and Tax Assessor. Thereupon Co~nissioner Krider moved that the salary for the position of City Clerk & Tax Assessor be set at ~5,520.O0 per year. Commissioner Carraw~;y next offered Resolution No. ~42, and after being read in full by the Clerk, moved its passage and adoption. WHE~AS, the duties of the offices of the City ~fsnager and City Clerk and Tax Assessor have become so extensive as to require separation of the functions of those offices, and the growth and development of the City of Senford has brou~t about a need in the office of City ~Tanager of s man who has had technical trsinl~ and experience in the administration of engineeri~ problems, and, ~EREAS, the growth of the City of Ssnford at the s~e ti~ imposes a much increased demand for accountl~ and record keeping on the part of the City Clerk and T~ Assessor, and V~ER~AS,H.N.Sayer, by virtue of his 21 years experience with the City of Sani'ord in auditing and handling of City records and tax matters is thorou~ly conversant with those phases of the work required of the City Clerk and Tax Assessor, end %~EREAS, during recent years H.N. Sayer in addition to th~ duties of City Clerk and Tax Assessor, which he has so ably discharged, has also carried on the functions and duties of City ~Tsnsger of the City of Sanford, MINUTES 9 City Commission, S~n~ord, Florida, December 27 at ?:30 P ~1 48 and the people of the City of Sanford, Florida, their recognition and appreciation for the unusual diligence and self-sacrifice with which he has aoplied himself to the discharge of his official duties, and with particular reference to his solendid services in the acquisition and development of the airport properties, his supervision and management of the water works plant which is a substantial asset to the community, and their further recognition that his every effort has been to promote the best interest of this community and of its people, BE IT FURTHER RESOLVED, that this resolution be spread on the minutes of City Commission and that copies thereof be sent to the local newspapers.
