Minutes of the regular annual meeting of January 4, 1949, Current invoices and payrolls for month o f December 1948, vouchered as evidenced by voucher Nos. 2415 thru 2544 submitted, payment authorized. Monthly reports of streets, sanitation, health, water , police, library departments for month o f December 194~ submitted Financial statement and statement of revenues and December 1948, submit~ed and examined. Bank statements in all accounts for month of December 1948, submitted and examined. Florida met in regular session at the o'clock p M. January 10, 1949. next read and approved. properly audited and examined, approved and fire, airport and and examined. expenditures during month of properly reconciled, Mr. S.A. Allen, owner of The Yellow Cab Co. next appeared before the Board and requested that the minimum rate for taxicabs be increased from 15~ to 25~ per person, Mr. Allen stated that he felt a 15~ minimum was too low and that it would be in competition with the rates of his proposed bus line. Also that he did not believe the Railroad Commission would grant him a permit to operate his bus line as long as there is a 15g minimum rate for taxicabs. Mr. Joe Gonzalez, owner of The Silver Mleet Cab. Co. next appeared before the Board and stated that he was charging 25~ per person, except in cases where he picked up four or five persons at the same location, in which case he gave ~nem a family rate. Mr. G.W.Spencer, Attorney, stated that he represented all the taxicab operators, with the exception of Mr. Allen, and that they did not want a minimum rate. Also that he considered the present ordinance setting a minimum rate did not conform to the City Charter. Thereupon after considerable discussion, the matter was taken under advisement. Mr. John Gove of lO18 W. First Street next appeared before the Board with further reference to the City Dump. 2he Mt~yor advised Mr. Gore that the Commission had inspected the present site, and alsO,a~proposed site, and that by moving northwest in the present site, they felt that he would get sufficient relief. Mr. A D Rosier next appeared before the Board relative to the addition he is con- structing on the rear of his building at First St. & French Avenue. Inspector Faville advised that Mr. Rosier had not secured a building permit , and that he estimated the construction to cost approximately ~lO,O00.OO. Communication next received from Edward F.Lane, Secretary of the Zoning Board, relative to lots 9 and l0 Block lg Tier 3, E R Trafford'$ Uap of Sanford, and advised that they had turned down a similar request twice before, but suggested that the Commission hold a Public Hearing. Also that if the Commission should decide to rezone the property from R-2 (Nultiple Fsmily) to C-1 (Commercial Retail) that the entire block between Twelfth and Thirteenth Streets on both sides of Park Ave. be rezoned. Also that at the same time both sides of Park Ave. between Third and Fourth Streets be rezoned from R-2 ( Nultiple Family) to C-1 (Commercial Retail). Thereupon Commissioner Chase moved that a Public Hearing be held at 8:00 o'clock January 27, 19~9, to consider the foregoing change in the Zoning Ordinance relative to the block between Twelfth and Thirteenth Street only, and that legal notice of such hearing be published in the Sanford Herald. Seconded by Commissioner Stemper and carried. Communication next received from Edward F Lane, Secretary of the Zoning Board, relative to Lots 4 thru 6 Block A, Lots i thru 6 Block B, Lots i thru 6 Block C, and lots i thru 3 Block D in Buena Vista, advising that the Board recommended that this property be re-zoned from R-l(one single family) to C-1 (Commercial-Retail) Thereupon Commissioner Chase moved that a Public Hearing be held at 8:00 o'clock P.N.January 27, 1949 to consider the foregoing change in the Zoning Ordinance, and that legal notice of such hearing be published in t~e Sanford Herald. Seconded by Commissioner Krider and carried. Communication next received from Edward F Lane Secretary of the Zoning Board relative to Lots 1,2 and 3 Block i Highland Park and lots 156 and 157 of Sanford Heights, advisirg that the Board had previously recommended that this property be re-zoned from R-1 (One Single Family) to C-1 (Commercial Retail.) Thereupon Commissioner Krlder moved that a Public Hearing be held at 8:00 o'clock P N February l, 1949 to consider the foregoing change in the Zoning Ordinance, and that legal notice of such hearing be published in the Sanford Herald. Communication next received from Edward F.I~.ne, to Lot 7 Block 16 Chapman & Tucker's Addition, advising Nathan Burns, colored to re-zone t~is property from R-1 Retail) so that he could erect a Pressing Club Building, white section. On motion of Commissioner Krider, seconded by Commissioner Dyson and carried, the application of Fannie & Robert Amons, colored, for permit to sell beer and wines at 1400 W. 13th St. was ordered filed. Consideration was next given to the funds to be transferred to the Bond Trusteee. Thereupon Commissioner Chase moved that the Florida State Bank and the Sanford Atlantic National Bank be designated as depositories for the aforesaid funds. Seconded by Commissioner Stemper and carried. Commissioner Krider next offered Ordinance No. 445, entitled: MINUTES ! City ~ommission, Sanford, Floxida,.....j~..lO..~.~...7~..30. P- w ~ .19..49 and same was placed on its flrst reading and read in full by the Clerk. Commissioner Chase next moved that Roy Wall, Master Plumber , John Baker, Journeyman Plumber and Howard Favllle, Plumblng Inspector be appointed as the Plumblr~ Board for the year 1949 in accordance with Ordinance No. 28?. Seconded by Commies loner Krider and carried. Commissioner Chase next moved that E.B.Randall, Master Electrician,Donald ~' Young, Journeyman Electrician and Howard Favllle, Bulldlng Inspector be appointed as the Board of Electrical Examiners for the year 19~9, in accordance with Ordinance No. 2?4 governing electrical construction. Seconded by Commissioner Stemper and carried. Bid next received from Ward Engineering Co, Orlando, Fla. for furnishing traffic signals at the intersections of Park Avenue with Seco~ and Ninth Streets. Thereupon after reviewing the prices as submitted, Commissioner Krlder moved that the City purchase from the Ward Engineering Co. Two 43E t-way 3-section span wire suspension eign&ls at a cost of $1~6.40 each, and two EM15B Controllers with flashing amber feature and radio interference filter at a cost of $224.40 each. Seconded by Commissioner Chase and carried. Commissioner Chase next introduced Ordinance No. 446 entitled: ORDINANCE No.446. AN ORDINANCE OF THE CITY OF SANFORD FLORIDA, MAKING IT UNLAWFUL FOR ANY PERSON TO NEGLIGENTLY OR WILFULLY AND MALICIOUSLY INJURE,DEFACE OR DESTROY ANY PROPERTY OF ANOTHER, EITHER PUBLIC OR PRIVATE,WITHIN THE CITY OF SANFORD, FLORIDA, AND PROVIDING A PENALTY FOR VIOLATION OF THE PROVISIONS HEREOF. and same was read in full by the Clerk. Thereupon Commissioner Chase moved that the rules be waived and said Ordinance No. 446 be placed on its final pass.age and adoption. Communication next received from Nr. Grady Loftin, owner of the Bus Station objecting to the assessed valuation on the aforesaid property. WILSON AS CITY ATTORNEY, AND IN COMMENDATION OF HIS UNTIRING AND GENEROUS EFFORT DEVOTED TO THE INTEREST OF THE CO~UNITY. WHEREAS, the resignation of Fred R.Wilson as City Attorney of the City o f Sanford, Florida, has been tendered by him and accepted with regret by the City Cormmission at the conclusion of his twenty years of service in that capacity for the City of Sanford, and WHEREAS, in the performance of his services as City Attorr~, Mred R.Wllson has through- out hie term in that capacity demonstrated an unswerving loyalty to the City and its best interest, and has constantly shown a conscientious devotion to his duty, and WHEREAS, hie careful counsel, his unfailing industry, his recognition of duty above self, aud his kindly and genial spirit have been an inspiration and an example for all who have been associated with him, and has been of inestimable value both to the City officials and to the people of the City, NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Oanford, Florida, that this means be taken to express to Fred. R. Wilson on 'behalf of the officials and the people of the City of Sanford, Florida, their high regard for him, and their deep appreciation of t~he outstanding and self-sacrificing service which he has rendered in his capacity as City Attorney, BE IT FURTHER RESOLVED that this resolution be spread upon the minutes of the City Commission and that copies thereof be sent to Fred R.Wilson and to the local newspapers. ( S E A L ) On motion of Commissioner Krlder, seconded by Commissioner Chase and carried, the Commission next authroized the payment of $1,050.00 to Pentland & Gray, Auditors, for services rendered in making the annual audit of the City's records. The proposed amended lease with Fellowship Four~ation, covering farm and grazing land at the Municipal Airport, was next submitted for consideration. Said amended Lease being in words and figures as follows: LEASE THIS LEASE, Nade and entered into in duplicate on the 29th da.v of December, 1948, between the CITY OF SANFORD, FLORIDA, a municipal corporation of Seminole County, Florida hereinafter referred to as Lessor and FELLOWSHIP FOUNDATION, a corporation not for profit organized and existing under the laws of the State of Florida, located at Sanford, Seminole County~ Florida, hereinafter referred to ae Lessee, WITNESSETH: THAT the Lessor in consideration of the rentals to be paid and covenants to b e performed by the Lessee, as hereinafter stated, has leased and let and by these presents does lease and let unto the Lessee that portion of the municipal airport property of the Lessor, formerly known as Sanford Naval Air Station property, as outlined on a map of airport said municlpa!/property hereto attached and made a part hereof, said land to be used by the Lessee for farming and grazing purposes, for a term of twenty-five (25) years from January l, 1949, at and for a rental of ONE THOUSAND DOLLARS ($1,000.00) a year payable in advance, with the option to renew t~is lease for an additional period of time and upon terms and rental to be agreed upon. The Lessee has leased and taken the a0ove described property from the Lessor for the aforesaid term of twenty-five (25) years and agrees to pay therefor an annual rental of $1,000 .00 a year in advance , the first year's rental being paid upon the execution and delivery of this lease. The Lessor agrees to furnish unto the Lessee the necessary wire for the purpose and the Lessee agrees to erect a hog wire and three-strand barb wire fence with poets to be furnished by the Lessee spaced not more ~han fifteen feet (15') spans around the outer the property hereby leased and let, except the portion enclosed by a chai~ said fence to be erected within ninety days after delivery of the wire by The Lessor hereby reserves the right of ingress and egress and passage over and upon said property for the purpose of inspection and for any other lawful purpose. The Lessee also agrees to construct the same type fence as that above required to be erected by it around the citrus groves of the Lessor that are located on the property hereby leased and let, the Lessor to furnish the wire and the Lessee to furnish the posts and said fence to be erected within ninety days after delivery of the wire by the Lessor. The Lessee shall also at its own expense construct cattle guards and/or gates across any roadways leading into the grazing area , as the Lessor may require. The Lessee shall maintain all of the aforesaid fences including said chain link fence in good condition at its own expense during the term of this lease, subject to inspection and approval by the Lessor. The Lessee shall maintain all of said property and fences in such condition ae to eliminate fire hazards and conform to present and future official fire regulations appli- cable to said property. All of the fences to be erected by the Lessee as above provided shall be allowed to remain on said property at the end of the term hereof or earlier termination of this lease. The Lessee shall be responsible for any damages that m~ be caused by its cattle MINUTES City Commission, Sanford, Florida, .. .Js_n..lO_ at...7: 30...i~..M.._.19.. 49 Default for a period of thirty days in making any one of the aforesaid payments of rental or default for a period of sixty days after written notice addressed by the Lessor to the Lessee at its last know address in the performance of any of the other covenants in this lease contained shall work an immediate forfeiture of said lease and Lessor shall have the right to re-enter and take possession of the lease premises without the necessity to resort to process of law therefor. This lease is made subject to all of the terms and conditions and restrictions contained in that certain deed of conveyance from the United States of America to the Lessor dated the 24th day of June 1947, and of record in Deed Book 142, Page 25? of the Public Records of Seminole County, Florida. In witness whereof the Lessor has caused these presents to '0e executed in its name by its Mayor and attested and its corporate seal hereunto affixed by its City Clerk, and the Lessee has cuased these presents to be executed in its nsme by its President and Board Member and attested and its corporate seal hereunto affixed by its Secretary and Board Member, all as and of the d ay and year first above written.
