061349-Regular SessionMINUTES The City Commission of the City of SGnford, Florid§, met .in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock-P. M. June 13, 1949. On motion of Commissioner Chase, seconded by Commissioner Dyson and carried, the Commlslon next approved and authorized payment of current invoices and payrolls for the month of May 1949, as evidenced by voucher Nos. 3009 thru 3121. Same having been exsminad and approved by the Finance Committee. Commissioner Chase recommended that all overtime be shown as such on the payrolls, that the freight bills be investigated for the purpose of ascertaining if the amounts charged are correct and that the extension of prices on all bills be checked. Monthly reports of streets'9sanitatl°n'l ~9 health, water, police, fire, airport and library departments for month of May submitted and examined. Financial statement and etatement of revenues and expenditures during month of May 1949 submitted and examined. Bank statements in~all ~ccounts for month of May 1949 properly reconciled, submitted and examined. Minutes of the regular meeting of May 23rd next read and approved. Mr. Robert Bostwick of the Florida Power & Light Company, next appeared before the Board and submitted a long-range street lighting improvement plan, which would reduce the the number of lights now in service, but would increase the power of the lights that would be left in service thus giving the streets more illumination. The cost of such a program would be borne by the City ~nd, the Florida Power & Light Comoany. Matter taken under advisement. Mr. A. B. Peterson, Jr., next appeared before the Board and requested a two-year fran- chise for mouting a three-sided sign on the parkin~ meter posts, for advertising purposes. Mr. Peterson stated that the City would receive 20~ of the gros~ advertising sales re- ceipts, estimated at $2,040.0~, and that the City would also have the option to order all signs removed if less than 50% of the posts are sold. Matter taken under advisement. Mr. Lee Samuels, representing the Boy Scouts of America of Seminole County, next appeared before the Board and requested the City to refund the Cit~Tax on the benefit ball game to be held June 22nd between the Sanford Giants and the Urlando Senators at the Municipal Ball Park. Matter taken under advisement. Mr. J. Brailey Odham next appeared before the Board with Mr. McLaughlin of the firm of Jones & McLaughlin, Truck Brokers, and requested the City to lease Joaes & NcLaughlln the city owned property south of the water plant, for the purpose of establishing a head- quarters for their trucking business. Thereupon Commissioner Dyson moved that the City lease Jones & McLaughlin the aforesaid property at a rental of $40.00 per month, with the City reserving the right to have the property vacated within 60 days after serving notice, and that the Mayor and Clerk be authorized to execute the lease on behalf of the City. Seconded by Commissioner Chase and carried. Said Lease being in words and figures as follows: AGREEMENT FOR LEASE AND LEASE THIS AGREEMENT, made in duplicate, on this 13th day of June, 1949, by and between CITY OF SANFORD, FLORIDA, a municipal corporation, hereinafter referred to as Lessor, and H. T. JONES and LEE H. TO HAVE AND TO HOLD said premises unto the said Lessees from September l, 1949, for a term of three (3) years then next ensuing, said Lessee paying to said Leesor as rental therefor the ~ sum of Forty ($40.00) Dollars per month, payable in advance. Thee Lessor and the Lessees do further covenant and agree to and with each other as follows: 1. Lessees shall have the right to erect temporary structures on the leased premises, provided, however, no such structures shall be erected until proper permit end approval thereof shall have been obtained from Lessor's Building Inspector. 2. Lessees shall pay before the same become delinquent all taxes and assess~rents levied ,.. by any taxing authority against any improvements or property placed on the leased premises by Lessees. 3. This lease shall be subject to cancellation prior to the expiration of the I(3) year term above set forth upon the giving of written notice by either party to the other sl~ (6) months prlor to the effective date of such cancellation of tf~e intent to cancel. Such notice shall be sufficiently given if mailed by registered mail to the last post office address of such party of record with the sender. 4. Lessees shall not assign this lease nor sub-let any of said property without the written consent of the Lessor. 5. Donovan Dean and A. W. White, Architects, next appeared before the Board and submitted plans for a flow-thru type pool and recommended that the City call for bids on both types of pools. Thereupon Commlsslo~r Chase moved that the City call for bids for construction of both types of pools, using both local materials and labor and that the bids be received by the Commission at the regular meeting of July ll, 1949. Seconded by Commissioner Krider and carried. Commissioner Krider next moved that well, which would be necessary for the the City call for bids for the construction of a flow-thru type pool, and that the bids be re- ceived by the Commission at the regular meeting of July ll, 1949. Seconded by Commissioner Chase and carried. Communication next received from the Zoning Board, recommending the establishment of a new district, to be designated as R-1X, which would require a minimum ground floor area of 600 square feet. Also that the area zoned as C-2, between Poplar Avenue and the West City Limits and First Street and Sixth Street, be re-zoned to R-1X. Thereupon Commissioner Chase moved that a Public Hearing be held at ?:30 o'clock P. M. June 30, 1949, to consider the foregoing change in the Zoning Ordinance, and that legal notice of such hearing be published in the Sanford Herald. Seco~ ed by Commissioner Stemper and carried. The City Manager next advised that no written objections had been filed with the City concerning the request of Patrick Fruit Company, for the City to close the alley behind their property at 1215 French Avenue. Thereupon Commissioner Chase moved that the City Attorney be instructed to prepare an ordinance vacating the aforesaid alley with a mtility reservation. Seconded by Commissioner S%emper and carried. Consideration was next given to the reeuest of John Abrahams, Engineer at the Water Plant, for an increase in salary for himself and the members of hie department. Thereupon after considering the responsible nature of the work of the Water Plant operator~ their seven-day weekly schedule and comparative hourly pay rates of other municipal employees, Commissioner Stemper moved that the salary of ~245.00 per month effective June let and that John Abrahams be increased from $2~5.50 to salaries of Ed Williamson and Julian Willlamson be increased from $175.00 to $1S5.0~h~er month effective June lat. 404 MINUTES Florida, June 13, at 8:00 P.M. 19 ~9 City Commission, Sanford, ............................................................................. Thereupon after considerable discussion, Commissioner Dyson moved that the City construct a concrete block building 26' x 38' at s cost of approximately $7,500.00 that $1,000.00 be cut from the appropriation to the Seminole County Chamber of Commerce which could be made up by the Chamber of Commerce by charging the Civic Clubs ten cents per plate as a rental for use of the building for luncheon meetings, and that these recommendations be submitted to the Board of Directors of the Seminole County Chamber of Commerce. Seconded by Commissioner Chase and carried. Commissioner Chase next offered Ordinance No. ~52, entitled: ORDINANCE NO. 652 AN ORDINANCE REQUIRING INSTALL~TION OF FLUSH TOILETS IN THE CITY OF SANFORD~ AND THE CON- NECTION OF SUCH FLUSH TOILETS TO SANFORD SEWERS. and same was placed on its first reading and read in full by the Clerk. On recommendation of the City Manager, Commissioner Chase moved that Mr. Willard Stansel, Supt., at the Airport, be appointed as Deputy Building Inspector for the Airport area, effective June 13th, for the purpose of enforcing the Building Code and Zoning Ordinance, to issue permits and make construction inspections only, and that the City Building Inspector continue to make plumbing and electrical inspections. Seconded by Commissioner Krider and carried. On motion of Commissioner Krlder, seconded by Commissioner Chase and carried~ the Com- mission next ordered a Public Hearing be held at ?:50 o'clock P. ~. June ~0, 19~9, for the purpose of considering the elimination of rent control, due to the fact that there no longer exists such a shortage in rental housing accom:~odatlons within the City. On motion duly carried the City Attorney was instructed to negotiate with a printer in Tallahassee, who does session printing for the Legislature, for the purpose of securing printed copies of the new City Charter. Consideration was next given to the fogging program being carried on in the county by the County Health Unit in cooperation with the U. S. Public Health Service and the need for such fogging in the Goldsboro and Georgetown areas. The City Nanager advised that such a program would cost the City approximately $1,O25.O0. Thereupon after considerable discussion and due to the fact that no funds had been appro- priated for this purpose and on motion duly carried, the Commission denied authorization for such a program. On motion of Commissioner Chase, seconded by Commissioner Dyson and carried, the Commission next revoked the taxi-cab license issued to J. L. Simms, due to the fact that he had not secured the required liability insurance. Communication next received from the Zoning Board, recommendir~ that the North 200 ft of Lot 5 A. V. French's Subdivision be re-zoned from R-1 (One Single Family) to C-2 (Commercial Indus tr lal ) · Thereupon Commissioner Chase moved that a Public Hearing be held at ?:30 o'clock P. June 30, 1949, to consider the foregoing change in the Zoning Ordinance, and that legal notice of such hearing be published in the Sanford Herald. Seconded by Commissioner Stemper and carried. Request next ~eceived from Chas. K. ElLis to purchase the County owned property described as Lot 13 Blk, , Tr l, E. R. Trafford's l~ap of Sanford, adjacent to the Ace Theatre Build- ing at Third Street and Sanford Avenue. The Clerk advised that at the request of the City, the County had dedicated this property for colored rest room purposes and that it would be necessary for the County to rescind said dedication. The Clerk also advised that there were rest rooms in the theater building which were available to the public. Thereupon Commissioner Stemper moved that the City Attorney be instructed to prepare a resolution requesting the County to rescind the dedication of the aforesaid property and place it on the market for sale, provided l~r. Ellis will execute a 25 year agreement ~hereby he will maintain colored restrooms in the theatre building oh Lot l~ adjacent thereto, in accordance with the verbal agreeme~-~t in which the City installed restroom facilities in said theatre Building. Seconded by Commissioner Chase and carried. On motion of Commissioner Dyson, seconded by Commissioner Chase and carried, the Commis~on next agreed to lease the Small Arms Nagazine Building No. 37 at the Airport to Spencer Castle for five years at a rental of $15.00 per month, and that the N~,¥or and Clerk be authorized to execute the lease on behalf of the City. THIS LEASE, Made and entered into in duplicate on the 13th day of June, 1949, between CITY OF SANFORD, FLORIDA, a municipal corporation, hereinafter referred to Lessor, and SPENCER CASTLE, of Sanford, Florida, hereinafter referred to as Lessee, WITNESSETH, That the Lessor, for and in consideration of the rentals agreed to be paid and covenants to be performed does lease and let unto the Les.~ee by the Lessee, has leased and let, and by these presents the following described property, situated at what was formerly the Sanford Naval Air Station, in Seminole County, Florida, to-wit: Building Number 37 (small arms magazine) and land immediately contiguous thereto necessary to the maintenance and operation thereof. TO HAVE AND TO HOLD the above described property unto the Lessee for a term of five (5) years from the date hereof, and for a rental of ~'lfteen ($15.O0) Dollars per month, payable in advance. The Lessor shall have the right to enter the premises at any time during reasonable business hours during the term of said lease for the purpose of inspecting the property in order to determine whether the terms and conditions of said lease are being obser-~ed and carried out by the Lessee. ~ 6. On motion of Commissioner Dyson, seconded by Commissioner Chase and Carried, the Com- mlssion next agreed to give ten tons of nitrate of soda at the airport to tl~e Country Club for the purpose of fertilizing the golf course. Consideration was next given to the need for additional street lights in the City. Thereupon Commissioner Dyson moved that the City install a street light at the intersection of Celery and Summerlin Avenues. Seconded by Commissioner Chase and carried. Thereupon Commissioner Stemper moved that the position of Secretary to the City ~anager be created as of June 1st at a salary of $150.00 per month. Seconded by Commissioner Krider snd carried. On motion of Commissioner Chase, seconded by Commissioner Dyson and carried, the Commission next approved the sale of Lots 3 snd ~ of Block ll and Lots i and 2 of Block 12 Nayfair Sub- division to Harry Tooke at a price of $3,000.00, and tha% the commission to Fred Bender, Realtor, not exceed 10~ of the selling price.
