M. June 30, 1949, for the purpose of a public hearing %o consider changes in the boundaries of certain districts of the Zoning Or- dinance and also to comsider the discontinuance of rent control. Bradley Meeting called to order by the Chairman who directed the Clerk to read the lega~ notice of this hearing that was published in the Sanford Herald on June 15th and 22nd, 19~9, as follows: NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES IN BOUNDARIES OF CERTAIN DISTRICTS OF THE ZONING ORDINANCE OF THE CITY OF SANFORD; FLORIDA. Notice is hereby in the City Hall in sider the following Florida: given that a public hearing will be held at the office of the City Commission the City of Sanford, Florida, at ?~30 o'clock P. M. June 30, 1949, to con- changes and amendments to the zoning ordinance of the City of Sanford, The property bounded on East by Poplar Avenue, south by Sixth Street, west by West Boundary line of City, North by First Street, and zoned in District R-1 (One Single Family District) with minimum requirement of 800 square feet ground floor area for one story dwelling, is proposed to be changed into a new Zoning Dis- trict to be classified as District R-1-X (One Single Family District), with minimum require- ment of 600 square feet ground floor area for one story dwelling, including garage. The propert~ zoned in District R-1 (One Single Family District), described as the North 200 feet of Lot 5 of A. V. French's subdivision, located and abutting on the west side of French Avenue, south and adjacent to the Sanford State Farmers Market 9roperty, is proposed to be changed to C-2 ICommercial Industrial) District. The Chairman stated that the Commission would be glad to hear any protest from parties terested in the changes proposed in. the foregoing notice. in interest and citizens shall have an opportunity to be heard at said hearing. 1949. There being no protest registered, Commissioner Krider moved that the Zoning Ordinance be amended, so as to establish a new district to be known as R-1X (One Single Family), with a minimum requirement of 600 square feet ground floor area for one story dwellings, excluding ~arage, that the property described in the foregoing notice be transfered from District R-1 One Single Family) to District R-1X (One Single Family), that the property described in the _s_ame notice be transfered from District R-1 (One Single Family) to District C-2 (Commercial- Andustrlal) and that the City Attorney be inatrncted to prepare the appropriate ordinances. Seconded by Commissioner Stemper and carried. Consideration was next given to the matter of the discontinuance of r ant Control, proper notice of this hearing having been published in the Sanford Herald. The Chairman stated that the Commies ion would be glad to hear any protest from parties interested in the discontinuance of rent control. Mr. William R. Clark stated that there were very few houses to rent in Sanford and that if rent control was discontinued, he believed rents would increase. Mr. Ed Lane and Fred Bender both urged the Commission to pass a resolution discontinuing rent control, as they felt that there no longer existed a shortage in rental housing accommo- dations, and also that such action would cause additional rental facilities to be created. , The Mayor then took a poll of those present for the purpose of ascertaining the number of !houses and apartments available at the present time. The ~sult of the poll indicated that i there were approximately 20 houses and 37 apartments available for immediate occupancy, as 'represented by those present. 4i0 MINUTES City Commission, Sanford, Florida, June 30, 19149 at. ~J.3.0_..P..._I~. Seconded by Commissioner Dyson and carried. The Commission then adjourned the Public Hearing and reconvened to take up any other matters that may come before it at this time. Commissioner Dyson next introduced Resolution No. ?57 and after being read in full by the Clerk moved its passage and adoption. Seconded by Commissioner Stemper and carried by the following vote of the Commission: Commissioner Carraway Aye " Chase " " Dy son II " Krider " " Stemper " Said Resolution No. 757 being in words and figures as follows: RESOLUTION NO. 757 A RESOLUT ION OF THE CITY COM%~ISSIONERS OF T!~ CITY OF SANF~D, FLORIDA, ABAN- DONING THE PURPOSE OF THE CITY TO IMPROVE LOT 13, OF BLOCK 4, TIER l, OF E. R. TRAFFORD'B NAP OF SANFORD; FLORIDA, BY THE ERECTION THEREON OF A PUBLIC C0~FORT STATION FOR COLORED PEOPLE. WP~EREAS, by Resolution No. 680, passed and adopted on the 9th Day of October 1944, the City Commissioners of the City of Sanford, Florida., recuested the Board of County Commissioners of Seminole County, Florida, to dedicate Lots 13 and 14, of Block 4, Tier l, of E. R. Trafford's ~ap of Sanford, Florida, as a site for a public comfort station for colored people, and in and by said Resolut~n it was determined that the City of Sanford would improve the aforesaid property in accordance w~ the dedication thereof at such time as funds and material were available for that purpose, in which dedication the City Commissioners concurred in and by said Resolution No. 680, and WHEREAS, by Resolution No. 692, passed and adopted by the City, Commission of the City of Sanford, Florida, the determination of said City to improve Lot 14 of the aforesaid prooerty for the aforesaid purpose was abandoned and rescinded as to mid Lot 14, and WHEREAS, in the opinion of the City Commissioners of the City of Sanford, Florida, sufficient provision has been otherwise made for a public comfort station for colored people, and it is expedient and for the best interest of said City to now also abandon'the aforesaid purpose of said City to improve Lot 13 of the aforesaid property as stated in said Resolution No. 680, and the City Commissioners are of the opinion %hat such purpose should be abandoned as to said Lot 13, THEREFORE, BE IT RESOLVED by the City Commisai~ of the City of Sanford, Florida, that the purpose of said City to improve the propert.¥ here inabove described by the erection thereon of a public comfort station for colored people be, and the same is hereby abandoned and rescinded as to Lot 13, of Block 4, Tier l, of E. R. Trafford's Nap of Sanford, Florida. BE IT FURTMEB RESOLVED, that a certified copy of this Resolution be filed with the Clerk of the Board of County Commissioners of Seminole County, Florida. WHEREAS, By Resolution No. 680, adopted October 9, 1944, the City Commissioners of the iCity of Sanford, Florida, requested the Board of 'County Commissioners of Se~lhole County, Florida~ ~to dedicate Lots 13 and 14, of Block 4, Tier 1, of E. R. Trafford's Nap of Sanford, Florida, as a site for public comfort station for colored people, and WHEREAS. it was the purpose of ~he City of Sanford, F%ordia, to erect on said property a public comfort station for colored people, which purpose was abandoned by the City of Sanford, Florida, by its Resolution No. 692 in so far as such purpose related to Lot 14 of said property, and WHEREAS, the Board of County Commissioners of Seminole County by Resolution adopted July 5, 1945, rescinded its dedication of said Lot 14 for the aforesaid purpose, and WHEREAS, the purpose of the City of Sanford, Florida, to erect such public comfort station for colored people has now also been abandoned as the same relates to Lot 13 aforesaid, NOW, THEBEFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that said Resolution No. 680 be, and the same is hereby rescinded as to said Lot 13, of Block 4, Tier l, of E. R. Trafford's Map of Sanford, Plorlda, and BE IT FURTHER RESOLVED that the Board of County Commissioners of Seminole County, Florida, be, and they are hereby requested to revoke their dedication of said Lot 13 for the aforesaid purpose and to offer said lot for sale in the m~nner pr~vlded by law. BE IT FURTHER RESOLVED, that a certified copy of this Resolution be filed with the Clerk of the Board of County Commissi~ners of Seminole County, Florida, and BE IT FURTHER RESC~VED, that this Resolution shall become effective immediately upon iits passage and adoption. N. Sayer, City Clerk. Consideration was next given to the question of whether to pay full or part of s~lary to iEugene Kendall while at camp with the Florida National Guard. The City Attorney quoted from the State Law requiring municipalities to psy employees full isalary while at camp for a period of l? days. The Manager advised that Eugene Kendall had been working part time, but now that school ~was over he was working full time. Thereupon after considerable discussion Commissioner Chase moved that the City pay Eugene Kendall a wage based on his average wages for the past six months, while at camp with the Florida National Guard. Seconded by Commissioner Stemper and carried. Consideration was next given to the proposed swimming pool. Commissioner Dyson suggested that the City call for bids for a poured concrete pool, as he felt that such a pool could be built at approximately the same cost as the block pool. Thereupon after considerable discussion, Commissioner Dyson moved that the Architect, Donovan Dean & Associates, be instructed to prepare an addendum to the plans and specifications to include poured concrete walls with a six inch concrete walk instead of the original eight inch iconcrete walk and that the City call for bids for both types of pools and that the date for ireceiving the bids be postponed for a period not to exceed three weeks from the original ~date of July ll, 1949. Seconded by Commissioner Stemper and carried. There being no further business the meeting then adjourned. ATTEST: GM
