The City Commission of the City of San~"ord, Florida, met in regu.lar session at the City Hall in the City of Sanford, Florlda, at 8:00 O:c~ock P. M. July ll, 19~9. Minutes of the regular meeting of June 2?th and of the adjourned meeting of June 30th., 1949, next read and approved. On Motion of Commissioner Stemper, Seconded by Commissioner Krlder and carried, the Commission next approved end authorized payment of current invokes and payrolls for the month of June 1949, as evidenced by voucher Nos. 3122 thru 3241. Same having been examined and approved by the Finance Committee. Monthly reports of streets, sanitation, heslth, water, police, fire, airport and library departments for month of June 1949 submitted and examined. Financial statement and statement of revenues and expenditures during month of June 1949 submitted and examined. Bank statement in all accounts for month of June 1949 properly reconciled, submitted and examined. Mr. Lee Samuels, representing the Boy Scouts of America of Seminole County, next appeared before the Board and requested the City to refund the City tax on the benefit ball game, held at the Municipal Ball Park on July 2, 1949, between the Sanford Giants and the Orlando Senators, due to the fact that the net proceeds amounted to $241.00 No action taken. Mr. Floyd Palmer of ti~e Prudential Life Insurance Company of America, next appeared before the Board relative to his previous proposal for the City to increase the Group Life Insurance Policy on employees and to include hospital and medical benefits. Matter taken under' advisement pending the preparation of the 1949-1950 budget. Ordinance No. 453, entitled: ORDINANCE NO. 453 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, VACATING, ABANDONING AND CLOSING A PORTION OF THAT CERTAIN ALLEY FOUTEEN FEET IN WIDTH, RUN- NING NORTH AND SOUTH BETWEEN TWELFTH AND THIRTEENTH STREETS THROUGH BLOCK 14, TIER 8, OF THE TOWN OF SANFORD, ACCORDING TO E. R. TRAF=ORD'S MAP THEREOF, IN THE CITY OF SANFORD, FLOMIDA, BUT RESERVING TO SAID CITY CERTAIN RIGHTS IN SAID ALLEY. introduced and placed placed on its final read~g and read in full by the Clerk. Thereupon the roll was called for final passage and adoption of vo~being as follows: on its first reading at the regular meeting of June 27, 1949, was next said Ordinance No. 453, the Commissioner Carraway A~ve " Dyson ,, " Krlder ,, " Stemper , Thereupon the Chairman announced that the City Commission of the City of Sanford, by ~n~nlmous vote had passed and adopted said Ordinance No. 453, entitled: ORDINANCE NO. 453 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, VACATING, ABANDONING AND CLOSING A PORTION OF THAT CERTAIN ALLEY FOURTEEN FEET IN WIDTH, RUN- NING NORTH AND SOUTH BETWEEN TWELFTH AND THIRTEENTH STREETS THROUGH BLOCK 14, TIER 8, OF THE TOWN OF SANFORD, ACCORDING TO E. R. TRAFFORD,S MAP TPEREOF, IN THE CITY OF SANFORD~ FLORIDA, BUT RESERVING TO SAID CITY CERTAIN RIGHTS IN SAID ALLEY. Commissioner Dyson next offered Resolution No. 759, and after ~being read in full by the Clerk, moved its paseage and adoption. Seconded by Commissioner Stemper and carried by the following vote of the Commission. Commissioner Carraway # Said Resolution No. Aye Dyson # Kr tder " Stemper " 759 being in words and figures as follows: RESOLUTION OF THE CITY COM~ISSION OF THE CITY OF SANFORD, FLORIDA, FINDING THAT THERE NO LONGER EXISTS IN THE CITY OF SANFORD, FLORIDA, SUCH SH~TAGE OF RENTAL HOUSING ACCO¥.~ODATIONS AS TO REQUIRE RENT CONTROL IN SUCH CITY UNDER THE FEDERAL HOUSING AND RENT ACT, REQUESTING THE HOUSING EXPEDITER UNDER SAID ACT TO TERMINATE THE PROVISIONS OF SAID ACT IN SAID CITY AND DECONTROL RENTS THEREIN, AND REQUESTING THE GOVERNOR OF THE STATE OF FLORIDA TO ENDORSE HIS APPROVAL ON THIS RESOLUTION. WHEREAS, a puhlio hearing was held by the governing body namely, the City Commission of the City of Sanford, Florida, at the City Hall in said City on July 30, 1949, after ten days public notice, ~e required by law, for the purpose of determining the need for continuance of control in said City of rental housing accommoda~one under the Federal Housing and Rent Act, and WHEREAS, a large number of citizens was present at said meeting, and such citizens were practically unanimous in their expression that there no longer exists in the City of Sanford such shortage of rental housing accommodations as to reouire rent control under the Federal Housing and Re~Act, and it appeared upon a poll taken of said assembly that within its number alone there were available for rental within said City on the date of such hearing a total of thirty-seven (3?) apartments and twenty (20) houses, and it further appeared that much avail- a~le rental property was not represented at said hearing, and WHEREAS, the City Commission of the City of Sanford, Florida, finds as a result of said public hearing that there no longer exists in the City of Sanford, Florida, such shortage of rental housing accommodations as to require rent control under the Federal Housing and Rent Act, and said City Commission in accordance with the premises and the applicable local law has adopted this Resolution as provided by the terms of the Federal Housing and Rent Act so that said City may be exempted from the provisions of said Act. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, tz~t said City Commission finds as a result of public hearing held in said City after ten daye notice that there no longer exists in the City of Sanford, Florida, such shortage of rental housing accommodations as to require rent control under the Federal Housing and Rent Act, and BE IT MURTHER RESOLVED, that the Housing Expediter be, and he is hereby requested to terminate the provisions of the Federal Housing and Rent ~ct in the City of Sanford, Florida, and to decontrol rentals therein, and BE IT FURTHER RESOLVED, that, aa required by law, this Resolution be submitted by the City Clerk to the Honorable Fuller Warren, Governor of the State of Florida, with the request that he endorse his approval thereon, and that upon endorsement of such approval tnie Reso- lution be transmitted to the Housing Expediter. PASSED AND ADOPTED this llth day of July, 1949. Consideration was next given to the request of A. B. Peterson, Jr., for a two year franchise for mounting a three-sided sign on the parking meter posts. The City ~anager advised that he had a survey made of 25 business firms in the downtown area and that 20 of the firms were not in favor of this type of advertising due to the danger of tear- ing clothing, children being hurt from bumping into them and that the erection of the aforesaid signs would not improve the appearance of the downtown area. Thereupon Commissioner Krider moved that the matter be tabled. Seconded by Commissioner Dyson and carried. Request next received from H. James Gut. on behalf of a client, that East Street from Pine Street west for 150 feet, be reduced from a 50 ft. wide dedicated street to a 14 ft. alley. Thereupon after considering the fact that the City owns eome lots which front on ~aet Street but do not run back to Second Street due to the fact that t~ere is an alley on the south side of the City lots, Commissioner Krider moved that the Citb ourchase from the county the nine lots fronting on Second Street, described aa Lots 16 thru 24 o~ Spurling's Plat of Block 15 of Chapman & Tucker's Addition at a cost of $$83.00, and that the aforesaid request be considered after the City has acqu~ed title to the property. Seconded by Commlsslo~r Dyeon and carried. Request next received from the Sanford Miniture Race Car Club for the City to install flood lights at their race track in Ft. Mellon Park as they desire to tune up their cars in the evenings No action taken. MINUTES __~ July 11 at 8:00 P. M. .~ 40 City Commission, Sanford, Fk,,,,.,,~,. ..................................................................... 1~.. ~ On motion of Commissioner Stemper, seconded by Com,~issioner Dyson and carried, the Commission next authorized the Valdez Hotel to erect a sign ? feet long and 21 inches wide at the south east corner of Park Avenue and Seminole Boulevard subject to approval of the County and the City Manager. Request next received from the Florida League of Municipalities for $100.OO additional sub- scription to cover the expenses of the League oPfice in Tallahassee dur~g the coming extra session of the Legislature. Thereupon Commissioner Krider moved that the aforesaid request be denied. Seconded by Commissioner ~,son and carried. The City Nanager next reported that Capt. Roy Tillis and Lt. ~ax Bass had been elected by the Police Department as department representatives on the Police Penslon Fund board. Request next received from Emmett Hunt for a refund of part of his Used Car Dealers license, since he only operated from February 16th through July 5th, 1949, and has now opened a new car agency. Thereupon Commissioner Stemoer moved that the license issued to Emmett Hunt be transferred from a Used Car Dealers llcens~ to a New Car Dealers license. Seconded by Commissioner Dyson and carried. Request next received from Howard Hood, o:~ator of the service station at Park Avenue and Fulton Street, for the City to remove the neon "Truck Route" sign on the traffic light at French Avenue and Seminole Boulevard due to the fact that the aforesaid sign diverts business away from his business. No action taken. On motion of Commissioner Stemper, seconded by Commissioner Krider and carried, the Com- mission next authorized the extension of the water line along west 16th Street, approximately 950 feet, with two inch pipe. Consideration was next given to the possibility of the New York Giants advancing funds necessary for the construction of a stadium at the new athletic field. Thereupon Commissi,m er Stemper moved that if it should be necessary for the City to send a representative to New York to confer with officials of the New York Giants, that Commissioner Krider be sent as the City's representative and that the expenses in connection therewith be borne by the City. Seconded by Commissioner Dyson and carted. Consideration was next given to the condition of the roof on the Repair Shop. Commissioner Dyson recommended that the roof be rebuilt in order to ~op it from leaking. Thereupon Commissioner Krider moved that the City call f or bids to re-roof the Repair Shop, said bids to be receded by the Commission at the regular meeting of July 25, 1949. Seconded by Commissioner Dyson and carried. On motion of Commissioner Stemper, seconded by Commissioner Dyson and carried, the Commission next authorized the first two parking spaces adjacent to the Post Office be changed from parking meter spaces to 5 minute psrking spaces. On motion of Commissioner Dyson, seconded by Commissioner Stemper and carried, the Com- mission next reappointed Mr. H. C. Whelchel as a member of the Civil Service Board for a two year term, in accordance with the provisions of Section 2 and 3 of Ordinance No. 349, creating a Civil Service System for the City of Sanford. On motion of Commissioner Stemper, seconded by Commissioner Dyson and carried, the Commission next approved the purchase of an additional radio receiver for the Police Station at a cost of $220, for %he purpose of establishing communication with the Florida Highway Patrol. Commissioner Stemper next introduced Ordinance No. 454, entitled: ORDINANCE NO. 454 AN ORDINANCE OF THE CITv OF SANFORD, FLORIDA, AMENDING ORDINANCE NU~ER 362 OF T~ CITY OF SANFORD AS AMENDED, SAI~.E BEING THE ZONING ORDI- NANCE OF THE CITv CF SANFORD, BY PROVIDING FOR A TENTH CLAss OM DISTRICT INTO WHICH SAID CITY IS DIVIDED FOR THE PURPOSES OF SAID ORDINANCE, DESIGNATING SAID TENTH CLASS OF DISTMICT AS R-1 X, AND SETTING GUT THE USED, LIMITATIONS AND REQUIRE- MENTS PERTAINING TO SUCH CLASS OF DISTRICT; AND FURTHER k%~ENDING SAID ORDINkNCE NUMBER 362 AS AMENDED BY TRANSFERRING CERTAIN TERRITORY IN DISTRICT R-1 TO DISTRICT R-1 X, AND TRANSFERMING CEBTAIN TERRITORY IN DISTRICT R-1 TO DISTRICT C-2. and same was placed on its first read~g and read in full by the Clerk.
