Minutes of regular meeting of August 22, and adjourned meeting of August 29, 1949, next read and approved. Monthly reports of streets, sanitation, health, water, police, fire, airport and library departments for month of August 1949, submitted and examined. Financial statement and statement of revenues and expenditures during month of August 1949, submitted and examined. Bank statements in all accounts for month of August 1949, properly reconciled, submitted and examined. On motion of Commissioner Krider, secom~d by Commissioner Chase and carried, the Com- mission next approved and authorlz'ed payment of current invoices and payrolls for the month of August , 1949, as evidenced by Voucher Nos. 3354 to 3465, inclusive, and 346? to 34??, inclusive. Same having been approved by the Finance Committee. Petition next presented from residents on Catalina Drive requesting that the author- ization for street lights being installed on Catalina Drive include a light 900 ft. east of Locust Avenue on said street. Thereupon Commissioner Stemper moved that the installation of the aforesaid street light be authorized. Seconded by Commissioner Dyson and carried. Application next received from Robert Howell to lease the soft drink concession at the swimming pool, which is now under construction, and same was ordered filed for future cons iderat ion. Mr S.A.Allen, owner and operator of the Sanford Transit Lines next appeared and requested a reduction in the license tax in amount of $?5.00 for each of his buses, due October l, stating that he was operating the bus lines at a loss and felt that the City should give some consideration to the service he is rendering the community. Matter taken under advisement. Mr A.H.Gaede, President of Home Gas and advised that they had negotiated the Company, DeLand, next appeared before the Board purchase of the local gas plant from South Atlantic Gas Company, subject to the approval of its bondholders, and requested the City's consent of the assignment to Home Gas Company of the existing franchise to maintain and operate the gas system in Banford. Thereupon the City Attorney was directed to prepare the necessary resolution of consent, for approval at the next regular meeting. Said conditional release being in words and figures as follows, which was ordered filed: CONDITIONAL RELEASE I hereby confirm the release by the stockholders and directors of SANFORD-SEMINOLE CONPANY , INC. of the lease dated November l, 1945, given by the City of Sanford, Florida, to said Company on the golf course and Country Club property, and hereby release the City of Sanford and the property covered by said lease from any liability or claim whatsoever, either by reason of said lease or otherwise; provided that this release and confirmation is on the express condition that the sum of Five Thousand ($5,000.00) Dollars shall be paid to the SANMORD-SENINOLE COHPANY, INC. for application in their discretion by the Board of Directors of said corporation, exclusive of myself, to any indebtedness outstanding against me. The receipt by the City of Sanford of this conditional release and confirmation and any action the City may take hereunder shall not constitute a waiver of any r~ht whatsoever existing, or hereafter to exist, by reason of any default under the terms of the aforesaid lease from the City of Sanford to SANFORD-SEMINOLE CONPANY, INC. Thereupon after considerable discussion, Commissioner Dyson moved the approval of lease of the golf course to Nr. Mr. Jack Ratigan, owner of the property at southwest corner of First Street and Pine Avenue , next appeared and requested the City to pave Pine Avenue from First to Second Streets and assess the abutting property owners for the cost. The City Manager then submitted a cost estimate in amount of $3,500.00 for paving said street over 6" lime-rock base, including concrete curbs and gutters, of which Mr. Ratigan'a pro rata share of the cost as an abutting property owner would amount to approx- imately $400.00. Thereupon after considerable discussion, action was deferred, pending further information as to whether or not the other abutting property owners would be agreeable to participating in the cost. Mr. W.C.HIll, owner of Hill Lumber & Supply Yard, next appeared and registered a pro- test against the license tax in amount of $35.00 that is being imposed on Lumber Yards in addition to the retail merchant's license tax based on value of stock of inventory 444 MINUTES .... Chase moved that the license tax ordinance be amended so that lumber yards will only be classified as retail merchants. Seconded by Commissioner Dyson and carried. Mr C.A.Maddy, representative of Fellowship Foundation, next appeared and submitted the following proposal to purchase certain parcels of the airport property now under lease from the City: Offered $30,000.00 pa~able on or before Jan l, 1950 for the purchase of approx- imately 127 acres of land, consisting of the citrus groves and the adjacent land east of the hard surface road, and a small tract of the land abutting on Golden Lake; offered $500,000.00 for the ourchase of all the property included in the 99 year lease agreement dated August 25, 19~9; title to be conveyed and accepted subject to the deed restrictions of the Federal Government. Thereupon after considerable discussion, the City Attorney as to the City's authority action was deferred, pending an opinion from to sell the airport property. The City Eanager next reported that Mr Francis Merlwether would only agree to pay a rental of $100.00 per year for the 233 acres of land at the airport that was improved during the Miracle Soil Conservation Day Program. Thereupon after careful consideration, and in view of the the Fellowship Foundstion to relinquish the 233 acres of land City lease it to Nr Neriwether at a rental of $100.O0 annual reduction of $650.00 in rent from the farm land, be Justified in accepting the proposition. Further consideration next given to application of L.P.Driskell for permit to operate a taxicab, and upon the report of investigation and recommendation of Chief of Police, same was denied. Application next submitted from Charles Pavlick, for transfer of liquor bar license Frank Pavllck, deceased, to the Estate of ~h"ank Pavlick, Charles Pavllck, Administrator, and on motion of Commissioner Krider, seconded by Commissioner Dyson and carried; same was authorized. On recommendation of Chief of Police Williams, and on motion of Commissioner Stemper, seconded by Commissioner Dyson and carried, the Commission next authorized the salary of Willie Sutton, colored police watchman, increased ~rom $29.41 to $35.00 per week. The City Manager next reported of numerous requests for the City to remove sound trees from parkways because of affecting houses and uprooting sidewalks, and recommended an annual planting program that would eventually replace old laurel and water oaks with young trees. Thereupon Commissioner Stemper moved that the City continue to enforce the require- ments for permits to be granted to remove sound trees from parkways, and that each individual request be considered according to merit. Seconded by Commissioner Dyson and carried. The City Manager next reported that the Yacht Club Building, now under repairs, would be available by October 1, should the local civic clubs decide to use it as head- quarters for their meetings and luncheons. Thereupon Commissioner Stemper moved %hat a letter of invitation be extended to all the civic clubs to inspect the Yacht Club building with a view to utilizing it for the aforesaid purposes. Seconded by Commissioner Krider and carried. Commissioner Krider next moved that the City explore the feasibility of a new franchise with Florida Power & Light Company, to include the street lights and the distri- bution system at the airport. Seconded by Commissioner Chase and carried. In response to request of the Commission, the City Attorney next rendered an opinion that the cost of tiling and reconditioning the new baseball field could be paid from the funds appropriated for constructing a new stadium Commissioner Krider then recommended that the City employ someone competent to supervise the installation of tile and reconditioning the baseball field, and offered his services in an advisory capacity in connection therewith, and on motion duly adopted, same was authorized. City Attorney Shinholser next submitted a letter from the firm of Caldwell, Marshall, Trimble & Mitchell, Bond Attorneys, New York City, agreeing to handle all legal pro- ceedings in connection with printing validating and approving the proposed revenue cer- tificates for constructing the dock and terminal facilities, for a fee of $750.00. Thereupon Commissioner Krider moved that the City employ the firm of Caldwell, Marshall, Trlmble & Mitchell to render the aforesaid legal services for toe sum of $750.00. Seconded by Commissioner Dyson and carried. Application next received from Nartin Ceresoll for permit to sell beer and wines to be consumed on premises, at 214 Sanford Avenue, and same was referred to the Chief of Police for investigation. On recommendation of the City Manager and Chief of Police, Commissioner Chase next moved that Oak Avenue be designated as a through street for traffic from Mlrst Street to Thirteenth Street, excepting Ninth Street, and that the City Attorney ordinance for passage and adoption.
