Minutes of meeting of l? and 24 October 1949 having been sent to Commissioners, same were approved as corrected. Correction of minutes of meeting of 24 October moved by Commissioner Stemper, seconded by Commissioner Dysan and carried: that insurance para- graph be amended, "also recommended that the division be reviewed annually. Above division of co~mmlssions having been determined by the number of companies represented the service afforded by the agent, and the supervision necessary by the agent." Mr. T.A. Stiles appeared to inquire as to the zoning of Lot i Block 4*A San Lanta Second Section. When advised the change of zoning had been denied by the Adjustment Board, Mr Stiles requested the lot be sold to him regardless of the zoning. Commissioner Krider moved that Lot l, Block 4-A San Lanta Second Section be sold to T.A. Stilee at the current purchase price. Motion seconded by Commissioner Dyson and carried. County Judge, D.O.Stenstrom next appeared, remarking on literature available to children at most retail stores, especially so called comic books. He cited Coral Gables as having regulatory ordinance prohibiting the publication and sale of books depicting pictorially, crime and sex. He urged adoption by this Commission of such an Ordinance. City Attorney was instructed to investigate several such ordinances in force in other Florida cities. Mr. N.James Gut appeared before the Commission. He mentioned that spot zoning was reason~ for denying Mr. Stiles" re-zoning request. He suggested that the Adjustment Board should have regular meetings, its records and correspondence be kept at City Hall, that copies of requests should be sent to members prior to a Board Meeting for study, and that he would present these suggestions to the Board at its next meeting for action. He further stated that in his opinion all of Celery Avenue from Banford to Mellonvllle Ave. should be reviewed with re- zoning in mind. Mr. Gut explained that the formular which the Adjustment Board had recommend- ed to the City Commission was designed to take care of the request of Welborn Phillips, however he thought that car ports and porches should be limited. He recommended a Joint Commission agreed to invite Board of Adjustment meeting of City Commission and Board of AdJustmen~/to a special meeting to be held at 8 P M on 21 November. Mr. M.C.Ragan, County Surveyor, next aopeared. Ne requested that, in cooperation with the County's efforts to relieve Southwest Road of excess storm water in the ditches, the City install another 30" culvert under Thirteenth Street at Crooms Academy so water could be diverted down Roosevelt Street. He also requested the County be permitted to use manholes at corner of McCracken Road and Persimmon Avenue for purposes of draining McCracken Road to the West. Commission instructed the City Manager to obtain an appraisal on them. Mr Maddy also requested information on the status of CAA approval of the 99 year lease, status of the sale of the property by the City to Fellowship Front and statue of the Trust Agreement. He was advised that approval of the 99 year lease had been re-requested and was pending, that CAA required accurate descriptions of property to be sold prior to approving sale of any Government deeded property, and he had not furnished such descriptions. He was advised that the Trust Agreement only required final checking by the Atlantic National Bank of Jacksonville, but had not been submitted to them because of question as to whether it might be needed. Mr. ~.addy requested that the farm land lease for 25 years, be amended to include that land south of the patrol road and west to the Dusty Boots area. Commission agreed to this extension and instructed City Manager to have use of the dumping ground near the Dusty Boots area discontinued, and material to be disposed of hereafter to be hauled to the new City dump on the north end of the alrbaee. Commissioner Dyeon moved that the use of the City-owned lot at corner of Palmetto and Second Street for a gasoline station by Thrift Oil Company be approved, permitting com- pletion of sale to Jesse Jarrell. Motion seconded by Commissioner Chase and carried. Action on request of R.W. Ware for payment for services rendered as City Judge in 1947 was deferred pending return of City Clerk H.N, Sayer. Action deferred on paving of Second Street between Mangoustine and Avocado Avenues, and paving of Lilly Court, pending complete advice from property owners as to their wishes. Moved by Commissioner Krider that the following lease amendment from the City of Florida Fashions be authorized executed. Notion seconded by Commissioner Chase and carried. AMENDMENT OF LEASE THIS AGREEMENT, made in duplicate this 15th day of November, 1949, between the City of Sanford, Florida, a municipal corporation, hereinafter referred to as Lessor, and FLORIDA FASHIONS, INC. a corporation of Sanford, Mlorida, hereinafter referred to ae Lessee, WITNESSETH, That in consideration of reduction of rentals as hereafter set out andasBump- tion of maintenance as hereafter set out, the parties do hereby modify as follows the lease made between them October l, 1947, covering premises situate at what wae formerly the Sanford Naval Air Station in Seminole County, Florida, to-wit: Building No 5 ( A & R Building) and land immediately contiguous thereto necessary to the main- tenance and operation thereof. 1. The consideration recited in the TO HAVE AND TO HOLD paragraph of said lease is here- by amended to read that the Lessee ehall pay a monthly rental of Two Hundred Fifty ($250.00) dollars per month for the balance of the five (5) year term of said lease, payable monthly in advance beginning October l, 1949, and continuing ~hrough September 30, 1952. 2. Items numbered i and 2 of said lease are hereby revised and amended to read as follows: "Lessee agrees at its own expense to maintain and keep the premises in good repair and condition, of which the Lessee shall be the judge, but in all events, except as hereafter provided, in as good repair as ~en delivered to lessee, provided, however, this shall not require Lessee to rebuild or repair such substantial damage by fire or the elements as shall render the building untenantable." 3. In all other respects said lease shall remain unchanged. Fifth Street be removed due to same location being assessed under name of Edna Evans Store. at 906 Myrtle Ave, mortgage Mr. Meriwether paying a consideration of $200.00 for same. On motion by Commissioner Krider, seconded by Commissioner Chase, application of Mary Singleton, colored for a permit to sell beer and wine on premises was denied, after denial same was recommended by Chief of Police Williams. Commissioner Chase moved that delegates be authorized to attend the Fort Myers convention of the Florida League of Municipalities, and that former City Attorney Fred Wilson be invited to attend. Motion seconded by Commissioner Dyson and carried. Request of Mr & Mrs John A Harriett, 1318 Mellonville Ave. for disability exemptlom on 1949 taxes, since application for same was overlooked, was granted upon motion of Commissioner Stemper, seconded by Commissioner Chase. On motion by Commissioner Stemper, seconded by Commissioner Krider, Thirteenth Street, from Lake Avenue to Southwest Road was designated for a maximum speed of 15 miles per hour. Action on insuring the diesel engines at the w~ter pumping plant was deferred pending further study. Actiom on determining Whether City should use aviation gasoline at Air Base or sell same, was deferred pending bids of oil companies. On motion of Commie sioner Stemper, seconded by Commissioner Chase, Quit Claim Deed from City to State Agricultural Marketing Board for Lot 4 of A.V.French Subdivision was author- ized executed. INTRODUCED AND PLACED ON FIRST READING AT THE REGULAR MEETING OF 24, October 1949, was placed on its final reading and read in full. Thereupon ~he roll was called for final passage and adoption of said Ordinance No. 463, the vote being as follows: Commlss loner Carraway Aye ,, Chase Aye " Dyson~ Aye " Krider Aye , Stemper Aye Thereupon the Mayor announced that the City Commission of the City of 8anford, Florida by unanimous vote had passed and adopted said Ordinance No. 463, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, VACATING AND ABANDONING A CERTAIN RESER- VATION FOR UTILITIES IN BLOCK lO OF ~AYFAIR LAKE FRONT ADDITION IN THE CITY OF SANFORD, FLORIDA, AS SHOWN BY PLAT THEREOF IN PLAT BOOK 5 PAGE ~1 SEMINOLE COUNTY RECORDS. On motion by Commissioner Krider, seconded by Commissioner Stemper, employment of an extra policeman for several weeks wae authorized, to assist in combatting burglaries. Commissioner Krider reported H.L. Duhart had spoken to him in regard to order by the City Manager to discontinue the use of his property on Sanford Avenue as a used lumber yard. Commissioner Krider stated that Duhart had been at that location for many years and sug- gested he be instructed to put the premises and parkway in order and to keep them in order. Commission authorized Commissioner Krider to so instruct Duhar~ . Upon receipt of a petition~ signed by eleven residents, requesting action to open Bell Avenue south of Sixteenth Street, City Manager was instructed to investigate possibilities of opening same.
