The City Co~nission of the City of ~anford, Florida met in regular session at ifae City Hall in %he City of Sanford, Florida at 8:00 o'clock P.~.NovemOer 28, 1949. Present: Commissioner Andrew Carrawsy Mayor. " Randall Chase " F.A. Dyson " John Krider " W.H. Stemper City Manager Clifford McKibbin Jr. City Clerk H.N.Ssyer Chief of Police R.G. Williams Absent: City Attorney A.Edwin Shinholser. Meeting called to order by the Chairman. Application next received from A.R. Lormann for permit to sell beer and wines at his restaurant at 2750 S. Park Ave., and on recommendation of the Chief of Police, same was approved. Attorney Karlyle Housholder, representing Mr. Joe Moss, owner of property located at southeast corner of Pine Ave and First Street next appeared and registered a protest against the City's proposal to pave Pine Avenue and First Street to the south line of East Street and assess the abutting property owners on an equal basis for the cost. He stated that Mr. Moss did not feel that his property would accrue any benefits from paving only a small portion of said street and also felt that it could not be a public improve- ment for the benefit of the general public. Nr Housholder further stated that Seminole County Hotors, owners of the property at southwest corner of Pine and First Street, would be the only ones to receive any benefits from caving a portion of said street, and that the cost therefor should be assessed according to the specific benefits to the abutting property owners. Also, thst the City should not use public funds to pave a portion of this street for the direct benefit of one property owner. Action deferred. A group of tennis enthusiasts, with Mrs P M Glngles and Mrs. T.E.Tucker as spokesmen next appeared and submitted a request for the City to contruct two additional concrete tennis courts in Fort Mellon Park. They also submitted a cost estimate in amount of $2,200.00 for constructing the two concrete courts, as estimated by a local contractor. Matter taken under advisement. Elmer and Felton Brookens, colored, next appeared with reference to the application of Elmer to operate a taxicab. Elmer having purchased t~e taxicab business of Willie Wallace in 1947 and operated under his permit until April of 1949, at which time the permit was revoked by the City because of cancellation of public liability and property damages insurance on the taxicab. Thereupon after considerable discussion, and ~pon reviewing the traffic violation convictions of Felton Brookens in the Municipal Court, Commissioner Chase moved that a permit be granted Elmer Brookens to operate a taxicab, conditioned that Felton Brookens be restricted from driving it. Seconded by Commissioner Krider and carried. Seconded by Commissioner Stemper and carried. The proposed lease agreement with Gilbert A Williams covering the cold storage plant and small arms magazine building at the airport was next submitted for consideration. Thereupon Commissioner Chase moved the approval oft~e lease agreement and that the ~ayor and Clerk be authorized to execute same on behalf of the City. Seconded by Commissioner Krider and carried, Commissioner Stemper not voting. Commissioner Chase next reported on further negotiations of the Street Lighting Committee relative to securing a reduction in rates under a new contract, advising that the Florida Power & Light Company had not offered any rates other than those now in effect under the existing contract, which expires on November 29, in accordance with the City's notice of termination of October 29. Commissioner Chase then moved that the Clerk be authorized and directed to withdraw the written notice served on the ?lorida Power & Light Company on October 29,1949, terminating the existing street lighting contract on November 29, 1949. Seconded by Commissioner Dyson and carried. On motion of Commissioner Stemper, seconded by Commissioner Chase and carried, with Commissioner Krider not voting, the Commission next authorized the payment of 450.00 to Attorney R.W. Ware for services rendered while County Judge, in presiding over the Nunlclpal Court on July 28, and August l, 4 and 8, 1947, during the absence of the Nunicipal Judge. Payment for such services having been deferred because of it not having been customary to compensate tf~e County Judge for t~is service. The City ~anager next reported that the Florida Power & Light Company had offered to furnish the current without cost for lighting the colored street lights during the holiday season from November 28 thru Jan 1. Request next received from the colored American Legion Post for a contribution toward their C~ristmas program for underprivileged children. Thereupon Commlssioner Krider moved that ~25.OO be contributed Zor this purpose. Seconded by Commissioner Stemper and carried. Co~nunication next read from the Civil Service Board recommending the salary o f N.OoGarner, assistant secretary and examiner, be increased from ~.00 to $75.OO per month. Thereupon after considerable discussion as to the duties of Nr. Garner, Commissioner Stemper moved that his salary be increased to $75.00 per month. Seconded by Commissioner Krider and carried. Commissioner Chase not voting. Request next received from Rev. Levy Allen of Assembly of God Church for permit to place a banner across Park Avenue near First Street to advertise a revival. Thereupon Commissioner Chase moved that such permits be ~onfined to general interest. Seconded by Commissioner Stemper and carried. The City Nanager was next authorized to call for bids for purchasing a new tractor sicklebar mower for the airport, with trade-in allowance on the old machine. On motion duly adopted, the Commission next authorized the Florida Power & Light Company to place in operation the whiteway street light on north side of Second Street in ~INUTE$ CITY CO~ISSION, SANFORD, FLORIDA, November 28 at 8:00 P. M., 1949 485 that same be denied. Seconded by Commissioner Dyson and carried. Consideration next given to the plans and estimates prepared by Engineer Fred H. Williams for installing ssnitary sewers in the area between Celery Avenue and Twentieth Street, and Locust Avenue and Mellonville Ave., of which the estimated contract cost amounts to $27,101.00. Thereupon ~ter considerable tise for bids for furnishing and discussion the City Manager was authorized to adver- installing the aforesaid sanitary sewers. On recommendation of the City Manager, and on motion of Commissioner Stemper, seconded by Con~issioner Dyson and carried, ~he Commission next authorized the following wage scale for laborers, based on qualifications and length of service: Hourly wage of .55; .58; .60; .63; .65; .68 and .70. Request next received from C. A. Maddy, Supt. of Fellowship Foundation, to purchase and remove from the airport 1OO of the beds and sever~.l pieces of office equipment now under 99 year lease from the City. Thereupon the Commission felt that the office equipment should remain on the airport, but agreed to sell 100 of the beds at a price of $2.50 each. The Commission also declined the request of Mr. Maddy to purchase the two s.uxiliary generator power unites at the airport. On motion of Commissioner Krider, seconded by Commissioner Chase and carried, the Commission next authorized the Florida Power & Light Company to install an overhead street light on East Twentieth Street in front of Jack Hall's residence. On motion of Commissioner Stemper, seconded by Commissior~r Chase and carried, the Commission next epproved the conveyance without cost of Lot 65, Magnolia Heights, to Robert E. Bedenbaugh, Veteran of World War II, to construct a dwelling thereon within six months from date of conveyance, under authority of Special Act of 1945 Legislature. On motion of Commissioner Dyson, e econded by Commissioner Chase and carrlea, the minutes of adjourned regular meeting of October 29, special meeting of November 9, and regular meeting of November 14, 1949, were next approved.
