051346-Regular Session MINUTES CiTY COMMISSION, SANFORD, 293 The City Commission of the City of Sanford, Florida met in regular session at the City Hall in the City of B~nford, Florida, at ?:30 o'clock P N Nay 13, 1946. Present: Commissioner H.James Gut, Mayor. " Geo. D.Blshop " W C Hill " Robert A Williams City Attorney Fred R.Wilson City Manager & Clerk H N Bayer Absent: Commissioner Lea R.Lesher Nesting called to order by the Chairman. Current invoices and payrolls for month of April 1946, properly audited and vouchered as evidenced by Voucher No 8940 thru 904?, submitted, examined, approved and payment authorized. Monthly reports of Streets, Sanitatation, Health, Water, Police, Fire and Library Departments for the month of April 1946, submitted end examined. Financial statement and statement of revenues and expenditures during month of April 1946 submitted and examined. Bank statements in all accounts for month of April 1946, properly reconciled, submitted and examined. Consideration next given to submitting a proposal to the Atlantic Coast Line R~llroad Comapny to trade them the City owned property bounded on south by Commercial Btreet, east by Holly Avenue, north by Fulton Street, extended, and west by their railroad, for their property lying north of Fulton Street between Park and Myrtle Avenue , for the purpose of acquiring right-of-way for relocating the State Highway away from the lake- front between Park and Nangoustine Avenue. Thereupon the Mayor was authorized to submit such proposal to the Atlantic Coast Line Railroad Company for consideration. The Mayor next advised that Naval Officials representing the Commandant of Seventh Naval District had requested a conference with City officials at the Sanford Naval Air Station on May 15, for the purpose of designating the personal property the City desirem to be left on the station and used under the revocable permit. Thereupon the Mayor, City Manager, Supt. of Public Works and Mr. Edward Higglns, Man- ager of the Seminole County Chamber of Commerce were appointed as a Committee to meet with said Naval Officials and select the furniture and fixtures, equipment and other various personal property that should be left on the station in order that the buildings can be utilized as a hospital, vocational training school and other purposes proposed by the City. Mr. A D Rosier, master plumber and owner of the Rosier Plumbing Company , next aopeared and registered a protest against the City Plumbing Board in connection with Journeyman plumber's examination given to G.H. Thigpen on May ?, 1946, in which he failed to make a satisfactory grade to entitle him to certificate of competency to eng~e in the business as a Journeyman Plumber. Thereupon the Commission advised Mr. Rosier that an investigation would be made of his complaint. Co~nissioner Bishop next introduced Ordinance No. 394, entitled: ORDINANCE NO. 394. AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,A~ENDING ORDINanCE NO 362 OF SAiD CITY, PASSED AND ADOPTED ON THE 26TH DAY OF DECE~BE/q 1944, SAID ORDINANCE BEING AN ORDINANCE ESTABLISHING A ZONING PLAN WITHIN THE CITY OF SANFOMD,SAID A~END~ENT ~MANSFERRING TERRITORY IN DISTRICT R-1-A TO DISTRICT R-1 IN SAID CITY. and same was read in full by the Clerk. Thereupon Commissioner Bishop moved that the rules be waived and said ordinance No. 394 be placed on its final passage and adoption. Seconded by Commissioner ~;illiams. Thereupon the question recurred upon the wsivure of the rules. Commissioner Bishop next introduced Resolution No. 705, and after being read in full by the Clerk , moved its passage and adoption. On recommendation of Chief of Police Williams, and on motion of Commissioner Hill, Seconded by Commissioner Williams and carried the salary of Eatelle Jenninge , police desk sergeant, was next authorized increased from $105.00 to $120.00 per month, effective as of May 1,1946. Chief of Police Williams next reported that he was having considerable trouble maintaining policement because of the salary scale for policemen is much lower than ia being paid for other skilled services. Matter taken under consideration. On motion duly adopted, the Police Chief was next authorized to accompany Sheriff Hand on trip to Texas to identify and bring back an escaped prisoner. The agreement for lease with Roy H.Brovming covering the maintenance and operation of the Municipal Airport, was next presented for consideration. Thereupon Commissioner Bishop moved that said agreement for lease be approved and that the Mayor and Clerk be authorized to execute same on behalf of the City. Seconded by Commissioner Williams and carried. Said lease agreement being in words and figures AGREEMENT as follows: THIS AGREEMENT, Made and entered into in duplicate on th~s20 day of May,1946, Detween CITY OF SANFORD,FLORIDA, a municipal corporation, as party of the first part and ROY H.BRO~ING of DeLeon Springs, Florida, as party of the ~econd part WITNESSETH THAT: WHEREAS, the party of the first part contemplates obtaining a revocable permit from the Navy Department for the airport at the Sanford Naval Air Station, consisting of runways, taxi strips, warming aprons, hangars and other buildings and equipment necessary to operate an airport, and subsequently to obtain t~tle to said property, and the party of the first part desires to have said airport operated after it obtains said revocable permit and title to said property, and the party of the second part desires to operate said airport and to obtain a lease therefor from the party of the first part: MINUTES £97 CITY COMMISSION, SANFORD, FLORIDA,~]~?~jL~__19~_~ Department, it will lease said property to the party of the second part for a term of five (5) years from the date of said lease, said lease to contain the following covenants to be performed by the party of the second cart- to-wit= I To furnish experienced and competent personnel for management and operation of said airport under the rules and regulations and in accordance with the requirements of the Civil Aeronautics Administration and the City of Sanford. 2. To maintain said airport and all buildings that he uses in proper condition,at his own expenses, in accordance with the requirements of the Civil Aeronatucs Adminis- tration and the City of Sanford, and in accordance wi~h any requirements that m~y be stip- ulated in said revocable permit from the Navy Department. 3. To promptly pay for all utility services at said alrport and used in the operation thereof. 4. To indemnify the party of the first part against all claims that may arise from the operation of said airport by the party of the second part. 5. To pay to the party of the first part monthly , all profits from the sale of gasoline to private and transit planes and all monies accruing from rental of hangar space at said airport to private and visiting planes. If, at the end of each of the first two years of said lease, said monies do not amount to the sum of $1,000.OO, the party of the second part will pay to the party of the first part the balance of said sum of $1,000.00. The foregoing provision for payment of said amounts to the party of the first part shall continue for only a period of two (2) years, at the end of which time the amount and manner of payments to the party of the first part shall be renegotiated between the parties hereto. 6. Said lease shall not be assigned by the party of the second part without the written consent of the party of the first part. The party of the first part, for a consideration to be agreed upon, hereby gives to the party of the second part the right to construct ~nd operate a seaplane base in Lake Nonroe and within the corporate limits of the ~arty of the first part and, if application is made to the party of the first part by anyone else for the right bo construct and oper- ate said seaplane base, the party of the first part agrees to notify the party of the second part of such application and, if the party of the second part does not construct and begin operation of said seaplane base within twelve months from the date of such notification, said right to construct and operate said seaplane base shall become null and void and of no effect. Request next received from R.T.Cows~n to be allowed to Durchase five additional lots in Nagnolia Heights at a price of $20.00 each, by wsiving the provisions of his purchase option requiring him to install a sanlatry sewer for serving this property before the City will convey but twenty of said lots to him, advising that the~e five additional lots are needed at this time to continue his building program until such time the sanitary sewer can be constructed. Thereupon after careful consideration, Commissioner Williams moved that the purchase option agreement with ~r. Coy,an be amended so as to gr~nt him the privilege of purchasing 25 lots in Nagnolia Heights and San Lanta Second Section at a price of $20.00 each before requiring him %o install the necessary sanitary Seconded by Commissioner Bishop and carried.
