The City Commission of the City of Sanford, Florida met in regular session at the
City Hall in the City of Sanford, Florida at ?:30 o'clock P M August 12,19~6.

Meeting called to order by the Chairman.
Current invoices and payrolls for month of July 1946, properly audited and vouchered
as evidenced by Voucher Nos. 9249 thru 9350, submitted, examined, approved and payment
authorized.
Monthly reports of Streets Sanitation, Health, Water, Police, Fire and Library Depart,
monte for month of July 1946, submitted and examined.
Financial statement and statement of revenues and expenditures during month of July
19~6, submitted and examined.
Bank statements in all accounts for month of July 1946, properly reconciled, submittedl
and examined.
The following bids next submitted for furnishing one Refuse Collector Body equipped with
loading and pacing device, to be used by the Street Department for collecting garbage:

Thereupon after careful comparison of the prices submitted and study of the
specifications and design of the unite bid upon, and also taking into consideration the
delivery dates, Commissioner Williams moved that the bid be awarded to Gaynon Iron
Works for furnishing for immediate delivery of one Gar Wood Load Packer at a price of

Thereupon Commissioner Williams moved the acceptance of bid of Strickland?Morrison
for furnishing one Ford Truck at price of $2,O03.96.
Seconded by Commissioner Lesher and carried.
T.E. Smlth, City employee, next appeared before the Board and filed a protest against
as assistant water plant
as prepared
by L.R.Scribners Laboratories at Orlando, next presented, such report showing all such
milk within the requirements of "Grade A Milk."
On motion of Commissioner Lesher,seconded by Commissioner Williams and carried the
Clerk was next authorized to transmit to %he Central Hanover Bank & Trust Company, New York,
N.Y. funds in amount sufficient %o pay interest coupons due Sept l, 19~6, on all outstanding
Series A and B. Refunding Bonds dated March 1,1937, and Series C.D and E Refunding Bonds
dated March l, 1941.
On recommendation of Fire Chief Cleveland, and on motion duly carried, the Commission
next authorized the salary of f~reman C.F.Godwin increased from $1~8.50 to $154.00 per month,
effective as of August l, 19~6.
Communication next read from the Bureau of Cou~unity Facilities, Federal Works Agency,
Atlanta, advising that the City's application for advance of funds in amount of $13,670.00
for cost of engineering and architectural services in preparing plans and specifications for
the sewerage improvements and extensions, consisting of interceptor, outfall line and
repairs to existing lines, had been approved and enclosing agreement to be entered into
by the City covering this advance.
Thereupon on motion of Commissioner Williams, seconded by Commissioner Lesher and
carried, the Mayor and Clerk were authorized to execute the said a~reement on behalf of
the City as follows:

Smith & Gtllespie, Engineers, next submitted a revised contract covering the engineering
services for preparing the plans and specifications for the aforesaid sewerage facilities.
Thereupon Commissioner Lesher moved that the contract be approved and the ~ayor and
Clerk be authorized to execute same on behalf of the City.
Seconded by Commissioner Williams and carried.
Said contract being in words and figures as follows:
ENGINEERING CONTRACT.
THIS CONTRACT AND AGREE~T, made and entered into, t~ls 12th day of August A.D.
19~6, between the City of Sanford, Florida, party of the first part,
hereinafter called the "OWNER" and Smith and Glllespie, a partnership consisting of W.Austin
Smith and Wylie W. Gillespie, of the City of Jacksonville, State of Florida, party of the second
part, hereinafter called the "ENGINEER".
WITNESSETH. That for and in consideration o f the mutusl covenants and agreements here-
inafter contained, the parties hereto for themselves, their successors and assigns,
have mutually agreed and do agree with each other as follows:
ARTICLE 1. That this Agreement applies to certain public w~rks which the "OWNER" desires
to p~an and construct described as follows and hereinafter referred to as the Project:

ARTICLE II. That the "OWNER" employs the "ENGINEERS" as its Consulting Engineer
to render services as hereinafter described for the Project:
ARTICLE III. That the "ENGINEER" shall furnish the necessary engineering equipment,
materials and set?ices during the development of the project and until completion of plans
and specifications and perform the services which shall embrace:
(a) Preliminary investigations, studies, and a report in three copies, including
general estimates of cost. Th is report shsll be~ch as to provide a clear understanding of
the engineering features of the project, and shall be adequate information necessary to ena-
ble the "OWNER, to make decisions as to the portion or portions of the work included in the
report, on which the "ENGINEER# is to render further services herein enumerated. The report
shall provide the engineering information required by such Governmental Agency or other
financial interests to whom the "OWNER" may make spplication for financial assistance in

Upon written notice from the "O~ed, prepare construction drawinm~ ,n& I

specifications in adequate detail to serve as a basis for receiving competitive bids
insure the construction being carried out as intended, covering %he work that is to be
built as determined by the "OWNER" from the report prepared under Paragraph (a) above.
Furnish the #OWNER" with eight copies of the Plans and Specifications.
ARTICLE IV. That the "OWNER" will pay the "ENGINEER" for services designated under
ARTICLE III Of this contract, the following fees:
(a) for the services enumerated under ARTICLE III Paragraph (a)
the sum of No Dollars ($o.oo) payable upon presentation of the preliminary report, receipt
of which payment is hereby acknowledged.
(b) For the services designated under Paragraph (b) of ARTICLE III a lumpsum fixed fee
of Thirteen Thousand , Six Hundred Seventy & No /100 Dollars ($13,670.00) to be paid
by the "OWNER" to the "ENGINEER" as follows:
(1) Six Thousand Eight Hundred Thirty-five & no/lOC Dollars ($6,835.00) thirty (30)
days after written order by the "OWNER" to proceed with work covered in Paragraph (b) of
ARTICLE III.
(2) Six Thousand Eight HunSred Thirty-Five & No/lOC Dollars ($6,835.00) when plans
and specifications are completed and delivered to the "OWNER.,
ARTICLE V That the "OWNER, will assist the "ENGINEER" throughout the work by placing at
his disposal in suitable form all available pertinent information that the "OWNER" may have in
its possession or to which it may have access.
That where test pits, borings and pilings, stream,nd flow measurements, become necessary
the same shall be done a% the "OWNER' "'' expense but no such expense shall be incurred by the
ENGINEER" without first receiving the approval of the "OWNER".
That any legal services required during the progress of the work shall be provided
by the "OWNER".
That should the "OWNER" decide to terminate or abandon any portion of the work covered
by this contract prior to its completion, the "ENGINEER, shall be fully paid for all ser-
vices satisfactorily rendered on the work so terminated or abandoned.
That all plans and specifications prepared by the "ENGINEER" for the work being
instruments of service, shall be considered the property of the "ENGINEER" until all pay-
ments agreed to hereunder have been fully paid.
ARTICLE Vi. That this agreement is made and entered into by authority of a resolution
of the City Commission passed in regular session on August 12,19~6, authorizing the Mayor
and City Clerk to execute same in behalf of the "OWNER".
IN TESTIMONY WHEREOF, the parties hereto have caused this agreement to be executed
in duplicate, the day and year first above written.

LOTS IN BUENA VISTA ESTATES, PLAT BOOK 3 PAGES i AND 2, SEMINOLE COUNTY RECORDS,
TO PUBLIC USE AND PURPOSES.
WHEREAS, the County Commissioners of Seminole County, Florida, have dedicated those
certain lots, pieces or parcels of land situate in the City o f Sanford, Seminole County
Florida, and owned by Seminole County, Florida, and described as follows:

Mr W A Patrick and Mr. J D Wright representatives of the Patrick Fruit Company
next appeared with further reference to the easement authorized to be granted the Atlantic
Coast Line Railroad Company to conetruQt a spur railroad tract across Thirteenth Street
at intersection of Elm Ave., Laurel Ave, between Twelfth and Thirteenth Streets; and the
two alleys between Twelfth and Thirteenth Streets and Elm and French Avenues; advising that
the Atlantic Coast Line Railroad Company claims that they have no authority to enter into
an easement agreement for these crossings because the track will be constructed and owned
by the Patrick Fruit Company; and requested that the easement be made to them instead of the
Railroad Company.
Thereupon Commissioner Williams moved that Patrick Fruit Company be granted an easement
to construct a spur track across the aforesaid streets and alleys under the same terms and
conditions authorized for the Atlantic Coast Line Railroad Company.
Seconded by Commissioner Lesher and carried.
Mr. Patrick and Mr. Wright next requested that the City close the alley in back of
their citrus packim~ plant in order that they may construct a loading platform across it.
Matter taken under advisement.
The City Manager next reported that Mr. C.A.Maddy, Supt. of the West Virginia Training
School, Inc. had made a survey of the Sanford Naval Air Station property and selected the
buildings they desire to use in connection with the vocational training school they pro-
pose to establish and operate, on said property, and requested the Commission to prepare
a tentative lease agreement descrlblD~ the buildings and land area, and terms and conditions
under which the City proposes to lease this property to them, so that he maY submit it to
his School Board for consideration.
Thereupon after considerable d~scuesion, and careful consideration of the terms, con-
ditions and stipulations of the proposed lease agreement, the Mayor, City Manager and City
Attorney were authorized to prepare a tentative lease agreement embodying said terms and
conditions agreed upon by the Commies ion, and submit to the West Virginia Training School,
Inc.
