SUPP~TAL AGR~T To ~SE NOY (R) - ]90]0 THIS SUPP~TAL AGRE~NT, entered into as of %his ~0~ day of Ju~ 19~6. MINUTES CiTY COMMISSION, SANFORD, FloRiDa,September 2~ al; 7:30 P M 19, 46 357 WITNESSETH: WHEREAS, on the 14th day of May, 1945, the parties hereto entered into Lease No. NOY (R)-39030, providing for the leasing to the Government of certain property situate in the City of Sanford, Florida, for the period from 14 May 1945, to and including 30 June 19N6; and WHEREAS, paragraph 13 of said lease provides that the Government shall have the option at the termination or expiration of the lease to convey all improvements to Lessor and the Lessor would agree to waive all restoration of the property and all rent payable under the lease or the Government shall pay the Lessor rent at the rate of $1,500.00 per annum; and WHEREAS, the Lessor agrees to the cancellation of said lease as of 30 June 19~6, and to accept the two (2) concrete block head facilities buildings, each 16' x 58', and con- tainlng ten (10) heads and one washroom, one wooden caretaker building 8' x 12', water, sewer and electric lines, concrete walks and cinder drive, and the concrete block founda- tions of twenty (20) auto trailers placed upon the de~ised property by the Government, and to permit the Government to leave in place five (5) trailers for quarters for personnel attached to the Naval Air Station, Sanford ( now in caretaker status), and to permit of such personnel and thir families to use on, said head facilities, free of rent, as long as required by the Navy Department for that purpose in lieu of requiring the Government to pay rent on demised premises during said period of occupancy and all restoration and any other claims arising out of the Government's use of said property; and WHEREAS, the Government is willing and has been determined to be in the best in%crest of the Government to accept Lessor's offer set forth in the last above paragraph. NOW, THF~REFORE, in consideration of the premises, the parties hereto do mutually agree as follows. i Said lease NOy(R) 39030 shall be and is hereby cancelled and terminated effective as of midnight, 30 June 19N6. 2. The Goverr~ment does hereby release, convey and quit-claim unto the Lessor, as of the date first above written, two (2) concrete block head facilities buildings, each 16' x 52' and containing ten heads and one washroom, one wooden caretaker building 8' x 12', water, sewer and electric lines, concrete walks and cinder drive, and the concrete block foundations to twenty (20) auto trailers placed upon the demised premises by the Govern- ment. 3. The Lessor hereby agrees to accept said last above mentioned installation and to permit five (5) auto trailers to remain in place on demised premises to be used as quarters for Navy personnel attached to the Naval Air Station, Sanford and the use of one head facility Dy such personnel, which is to be rent free in lieu of requiring the Government to pay rent on demised premises during does hereby remise, release and forever discharge employees, of and from all and any manner actions, the period of its occupancy and the Government, its officers, agents and liaOility, or claims against the Government, its officers, agents and employees, arising out of the Government's obligation to restore said premises or by reason of any other matter,cause or thing whatsoever, particularly arising out of said lease and the occupation by the Government of the demised premises. 4. Dudley By direction of the Chief of the Bureau of Yards and Docks, acting under the direction of the Secretary of the Navy. ~r Harry Crossen who is operating a trailer park under lease ~greement with the City on the S.W. 1/4 of the trailer park property, next appeared and made application for a new lease agreement to include the trailer park facilities conveyed to the City by the Navy. Thereupon after considerable discussion, the Commission agreed to enter into a new lease agreement with mr. Crossen on the entire trailer park for a term of five years at a rental of $600.00 per year, and the City Attorney was directed to prepare the lease agreement for approval of the Commission. On motion duly carried, the Commission next approved the purchase from Lee Brothers Plumbing Company of two oil burner spaee"heaters for the Library at a price of $104.O0 each. On motion duly carried, the Commission next authorized the purchase of one Power Pack Lawn Mower from Hill Hardware Company at a price of $150.50, for use in the Parks Department. Application next received from H.M.Youn~, white, for permit to operate a taxi-cab, and on recommendation of Chief of Police, same was approved, provided he operates from estacllshed place of business on private property. On motion of Commissioner Bishop, seconded by Commissioner Hill and carried, the Clerk was next authorized to transfer $1,000.00 from the Division of Insurance, to the Insurance Fund Account, this amount to supplement funds already on deposit in this account and carried as a reserve to pay claims for which the City may be liable as a Self Insurer under the Workmen's Compensation Act. WHEREAS, the City Commission of the City of Sanford, deems it necessary, expedient and for the best interest of said City that any unexpended cash surplus as of September 30, 1946, of the operating revenues of said City for the fiscal year 1945-1946 be ap~opriated for the ordinary purposes and operating expenses Of said City in the Budget for the fiscal year 1946-1947. NOW, THEREFOBE BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that any unexpended cash surplus as of September 30,19~6, of the operating revenues of said City for the fiscal year 1945-19~6 be and the same is hereby appropriated to the Departmemt of General Government of s aid City for the ordinary purposes and operating expenses of said City for the fiscal year 1946-19~?, and said cash surplus shall be incorporated in the budget of revenues and expenditures of said City for said fiscal year 19~6-1947 for the ordinary purposes and operating expenses of said City. The Lessee shall not remove any of the aforesaid personal property from said Sanford Naval Air Station or from the buildings without the consent of the Lessor, but if the Lessee desires to substitute any of said personal property with personal property of its own, it may do so upon storing at its own expense the personal property to be replaced, at such place as may be designate~ by the Lessor. 4. The Lessee shall not assign this lease without the written consent of the Lessor. l0 Default for a period of thirty days in the payment of any one of the afore- said installments of rental or default after thirty days' notice , in the perform- ance by the Lessee of any of the covenants hereinbefore set forth, on its part to be performed, shall work an immediate forefeiture of this lease, and the Lessor shall have the right to enter upon said property and retake possession thereof with- out the necessity to resort to process of law therefor. ll. The Lessee agrees that if and when the Lessor receives prices from the War Assets Corporation for the purchase of the personal property to be purchased by the Lessor, for the Lessee's account, it will purchase of and from the Lessor said per- sonal property by paying to the Lessor, in cash, the full amount the Lessor is re- quired to pay to the War Assets Corporation. 12. The Lessee will surrender possession of all of the aforesaid property, ex- cept such as may be purchased by the Lessee, at the end of the term hereof, or its earlier termination, to the Lessor, its successors or assigns.
