112546-Regular Session MINUTES CITY COMMISSION, SANFORD, FLORIDA, ~ove-m-her 25 399 The City Commission of the City of Senford, Florida , met in regular session at the City Hall in the City of Sanford, Florida, at 7:30 o'clock P.M. November 25,1946. Present: Commissioner H.James Gut, Mayor. " W. C. Hill " Lea R. Lasher " Robert A.Willlams Deputy City Clerk Gordon L. Bradley Chief of Police R.G. Willlams Absent: Commissioner Geo D.Bishop City Manager & Clerk H.N.S~yer. Meeting called to order by the Chairman. On motion duly carried, the Commission next approved the appointment by City Clerk H.N.Sayer of Gordon L.Bradley as Deputy City Clerk to exercise the powers and perform the duties of City Clerk during mis absence or inability to act in such Capacity. Report of November analysis of milk from all dairies operating in Sanford, as prepared by Dr. L.R. Scribner's Lsboratories at Orlando, next presented, such report showing all such milk within the requirements of Grage "A" milk. On recommendation o~ Fire Chief Cleveland, and on motion of Commissioner Williams, seconded by Commissioner Hill and carried, the Commission next authorized the salaries of firemen Vernol E. Carrol and Claude k~ Whitten increased from $148.50 to $154.OO per month, effective as of November 16, 1946. Request next received from Howard Long's Plumbing Shop for the City to reserve a loading zone in front of his place of business, and on motion duly carried, ssme was authorized and the Chief of Police directed to make the necessary arrangements. Commissioner ',~iIllams next introduced Ordinance No. 406, entitled: ORDINANCE NO. 406. AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AS!ENDING SECTION 310 OF THE REVISED ORDINANCES OF~E CITY OF S.&NFORD, of 1914, AS A~.~ENDED BY ORDINANCE NO. 398 PASSED A~1D ADOPTED ON THE 9th DAY OF SEPTHZ~BER,1946, SAID SECTION RELATING TO BUTCHER PENS, SLAUGHTER HOUSES AND SLAUGHTERING OF ANIMALS LN SAID CITY. and seme wes placed on its first reading and read in full. Thereupon Commissioner Hill move~ that tJae rules be waived and said Ordinance No. 406 be placed on its final passage and adoption. Seconed by Commissioner Williams and carried. Thereupon the question recurred upon the waivure of the rules. On motion duly adopted Ordinance No. 406 was next ordered POSTED at the front door of the City Hall in the City of Sanford, Florida, in accordance with the terms of the Charter, as amended. Application next received from Central Florida Quick Freeze and Cold Storage Company Inc,for license to operate food processing plant and abattoir at 401-O9 West Thirteenth St Thereupon Commissioner Williams moved that the aforesaid application be denied unless the word "ABATTOIR" is deleted therefrom. Seconded by Commissioner Hill and carried. Thereupon the Chairman appointed a committee consisting of himself, Commissior~er Lesher, the City Nanager and Fire Chief Cleveland to tabulate the foregoing bids and submit to the Commission for further consideration. On motion of Commissioner Lesher, seconded by Commissioner Williams and carried, the purchase of 12 Fire Extinguishers from War Assets Corpor- to be placed in the various City owned b~ildings for fire Commissioner Lesher ~xt introduced Resolution No. 714, and after being read in full by the Clerk, moved its passage and adoption. A RESOLUTION OFSHE CITY CO}3, MISSION OF THE CITY OW SANFORD, FLOMIDA, CONDEt~NING AND OMDERING TO BE DE~OLISHED kND ~E~'~OVED THAT CERTAIN WAREHOUSE AND DOCK IN SAID CITv LOCATED OVER LAKE }~ONROE AND NEAR THE NOMTH END OF PAL~ETTO AVENUE IN SAID CITY . WHEREAS, the Building Inspector of the City of Ssnford, Florida., has reported to the City Commission of said city that that certain warehouse and dock located in said city and over Lake ~.onroe and near the north end of Palmetto Avenue in said City is a dilapidated,unsanitary and un~afe building, and incapable of being put in a state of sound repair, and should be demolished and removed. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that that certain warehouse and dock in said City locatec over Lake Monroe and near the north end of Palmetto Avenue be demolished and removed unless Just cause be shown at the next regular meetirg of the City Commission of the City of Sanford, to be held at ~:~0 P.M. on the 9th day of December, 1946, in theCity Commission room in the City Hall of the City of Sanford, Florida, why the same should not be demolished and removed. ( Seal ) Consideration next given to the m~tter of restricting the merchants from displaying merchandise, racks and stands on the sidewalks in front of their places of business. Thereupon after considerable discussion as a result of which it was felt that such displays are unsightly,unsafe and a hazard to the public, and the City Attorney was direct- ed to prepare an ordinance prohibiting the display of merchandise,racks,stands or any obstructions on the sidewalks, for consideration of the Con, mission at the next regular meeting. Reouest next received from the local world war veterans post for contribution toward their annual Christmas program for sunplylng gifts for underprivileged children and old people. Thereupon Commissioner Bishop moved that the City donate $25.00 to the colored World War Veterans Post for this purpose. Seconded by Commissioner Hill and carried. Communication next read from Central Florida Quick Freeze & Cold Storage Company, Inc advislng that they desire to exercise their option to lease the old municipal airport property, which was granted them at the meeting of SeptemOer 9, 1946. The lease agreement to be entered into with Sanford-$eminole Company Inc. for main- taining and operationg the Municipal Golf Course, in accord~nce with the agreement for lease executed on the 22nd day of October 1945, next submitted and re~d in full by the Clerk. Thereupon after careful conslder~tion, Commissioner Hill moved that the Mayor and Clerk be authorized to execute same on behalf of the City. Seconded by Commissioner Lesher and c~rried. (c) That the Lessee shall keep the buildings now or hereafter erected upon the above described property insured to their full insurable value against all risk of damage or destruction by fire in a good and resoonsible insurance comoany or comoanles, with loss payable to the Lessor, any proceeds arising from said insurance to be used for the restoration of the property under the supervision of the Lessor. (e) That this lease shall not be assigned without the written consent of the Lessor, its successors or assigns. This lease is ~de subject to that certain oil, gas and mineral lease from the Lessor to Union Oil Co~pany of California, dated November 14, 1944, and of record in Deed Book 117, Page 441, of the public records of Seminole County,Florida, but the Lessor hereby reserves to itself, its successors or assigns, all rentals due and to become due thereunder, but if any royalties become payable to the Lessor thereunder, fifty Dercent thereof shall be payable to the Lessee. The Lessee shall have the right at any time after ali of the improvements reou~ed to be made on the above described oroperty under that certain a~;reement entered into in triplicate on the 22nd day of October, 1945, between the Lessor, as party of the first part, and Ed Levy-Whitner, as party of the second Dart, and the Lessee, as party of the third part, to purchase the above described proDerty of and from the Lessor at and for the sum of ~10,0OO.O0 cash, and should s aldoptlon to Durchase be exercised by the Lessee, any deed of conveyance made by the Lessor to the Lessee shall contain a condition and a restriction requiring the Lessee to maintain said property at all times as a golf course aggregating 6,000 yards in length, with fairways of standard width, and country club, and that upon its failure so to do titl~ to said property shall revert to the Lessor, its successors or assigns. Commissioner Hill next introduced Ordinance No. 408, entitled: AN ORDINANCE OF THE CITY OF SANFORD FLORIDA, PROHIBITING THE USE ON THE PUBLIC STREETS AND PUBLIC PLACES IN SAID CITY OF CERTAIN WALKING CANES, EXCEPT BY PEDESTRIANS WHOLLY OR PARTIALLY BLIND, PROVIDING PROTECTION AG-~INST TRAFWIC ACCIDENTS TO SUCH PERSONS, AND PMOVIDING PENALTIES FOR THE VIOLATION MINUTES CITY COMMISSION, SANFORD, FLORIDA, November 2_R at 7:50 P I~{ 19 provided the City will furnish the paint. Thereupon after careful consideration, it was felt that it would be hazardous for the members of the Junior Chamber of Commerce to attempt to paint these buildings and cages because of the dangerous animals housed therein, and the Board expressed its appreciation to Ur.
