The first order of business was a Public Hearing to consider rezoning certain district .of the Zoning ordinance in accordance with the follo~ang legal notice published in the Ssnford Herald on May 8 and 15, 1953: NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES ~ND AME~DMENTS IN CERTAIN DISTRICT OF THE ZONING ORDI?~ANCE OF THE CITY OF SANFORD,FLORIDA. Not~ce is h~reby given that a Public Hearing will be held at the office of the City Commission in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P.M. May 25, 1953, to consider the following change and amendment to the Zoning Ordinance of the City of Bsnford, Florida: The property Zoned in District R-l-AA (One Single Family), bounded on North by Lake Monroe, East by Mellonville Avenue, South by Second Street, and West by the East property line of the Subdivision of First Street E×ten~lon, is proposed to be changed to R-2 (Multiple Family) District. All parties in interest and citizens shall h~ve an opportunity to be heard at said hearing. By order of the City day of April, 1953, Commission of tb~ City of Sanford, Florida., this 20th., S/ H. N. Bayer As City Clerk of the City of Sanford, Florida. The Chairman then announced ~at the Commission would be glad to hear from anyone in favor of, or against, the proposed rezonlng of the property described in th~foregolng notice. A delegation of owners of property abutting on east e~de of Mellonvllle Avenue between Second Street and Lake Monroe, with Attorney W. C. Hutchison, Jr., as spokesman, then pro- tested the proposal to rezone the property north of First Street to R-2, and also requested the Commission to defer action on rezonlng the property south of First Street, (the proposed hospital site) until such time the hospital actually has become a certainty. Mr. Hutchlson stated that it was not the desire of the property owners to h~nder the proposed hospital in ~ny way but several of them had already constructed dwelllnFs of s~stantial size and value and did not wish to have their property values decreased by the lowering of zoning restrictions across the street. Mervyn Ozier and W. L. Kirk, owners of property in said area, also voiced objections against rezonlng any of the property except the hospital site. Mayor Chase then pointed out that certain preliminaries had to be accomplished in con- nection with constructing the hospital, one of wl~ch was rezonlng the site since it could not be constructed in a R-l-AA District, and that the Planning Board had recommended that the property north of the hospital site be rezoned to R-2 at the same time. He also advised that the rezonlng would not become ~fective unless the hospital is constructed. Robert S. Brown, Chairman of the Plannln~ Board, next explained the reason for recommend- lng that the property north of First Street be rezoned from R-l-AA to R-Z, advising that after the Hospital is constructed the area would not be desirable for large one-family dwellings, =~M t~ It ~mnln ~ ~ h1~qV re~trlcted area the property owners would suffer a loss in value. 54 MINUTES City Commission, Sanford, Florida, Mall. 2~ at Lot 2, Lots 3, After considerable discussion in which it was reconmended that a buffer zone be left along the west side of Mellonville Avenue between First Street and Lake Monroe for the pro- tection of the property on east side of the Street, Commissioner Stemoer moved that all of Block 2, and Lots 1, 2, ~ and 5 of Block 1, of San Carlos Subdivision, be rezoned from R-l-AA to R-2, subject to the condition that the rezonlng shall not become effective until such time the hosoital ~s ready to be constructed. Seconded by Commissioner Ka~er and carried. Pursuant to notice oubllshed in the local ne~spapers, the follo,^~ng City o~,med pro~erty was next offered for sale by public auction for the highest and best cash bid, but all bids were rejected by the Commission as being below the current market Block ?, Marvania Second Section - Robert A. On motion of Commissioner Kadet, seconded by Commissioner Stamper and carried, the Com- mission then set a Orlce of ~l,50a.00 on Lot 2 Block 7; $~,000.00 on Lots 3, a and 20 Block 7; $t,000.00 on Lots ~ and ~ Block 9; and ~1,000.00 on Lots 5 sad 6 Block 9; and aut~orized the actual bidders oartlcipatlng at the auction to be given until the next regular meeting, June 8, to ourchase the lots at the aforesaid prices; and if not sold by then the orlce be increased 10~ and listed for sale with all local realtors; the City to convey whatever title it has to the property. Financial statement and statement of revenues and expenditures for month of April 1953, submitted and examined. Current l~volces and mayrolls for month of Anrll 195], as evigenced by Vouchers Nos. 9~91 thru 9522, submitted, and on motion of Commissioner Stamper, seconded by Commlss~oner Kadet and cart!ed, same were an~roved and payroll authorized. Frank L. Miller and C. H. Levister, of 2~16 Palmetto Avenue, next a~eared with reference to damages substained to Mr. Levlster's automobile from running into a manhole in alley in back of Mr. Miller's residence, and requested the City to reimburse him for cost of repairs in amount of ~1~0.00. Mr. Miller stated that since the alley is a public thoroughfare and has been used as such for a number of years, he felt that the City was liable for the damages. The City Manager pointed out that the al~ ey is an unlmoroved road and people use it at their own risk, also, that tbs investl~atlon showed that the manhole was only fm~r inches above grade of the ruts in the alley, which was evidence that Mr. Levister was travelling st a high rate of speed. However, Mr. Levlster claimed he was not exceeding 15 miles per hour. After discussion Commissioner Kader moved that the City pay Mr. Levlster for the damages, but same died for lack of a second. The Mayor then referred the matter to the City Attorney and City Manager for further investigation and disoositlon. Porter Lansing ne~t aoner, red and registered comolaint against the low water oressure from the 5" main serving his residence at 2582 Ssnford Avenue, and same was rtferred to the City Manager. Mr. Lansing next submitted recuest on behalf of Seminole County Sportsmen's Association for City to furnish its dragline and two dump trucks to assist in digging and hauling approxi- mately 100 loads of sand to construct a road to a park they are developing on Wekiva River, which will be open to the ~bllc, and same was taken under advisement. Second Street, and after careful considerstlon Commissioner Kadet moved that it be ~snted with the understanding that it be used strictly for loading and unloading purposes. Seconded by Commissioner Cordel! and carried. Letter next submitted from A. B. Paterson tendering his resignatlon as a member of Dhe Sa nford Industrial Board, and Commissioner Kadet moved that it be accepted and action be deferred on appointment to fill the vacancy until next regular meeting. Seconded by Com- missioner Stamper and carried. After further discussion Commissioner Kadet moved that the bill be redrawm with referen- dum on the annexation of subdivisions of Marvania Second Section and Fort Mellon Second Section, and that the bill for annexin~ balance of Wynnewood and the airport property be presented as authorized and prepared. Seconded by Commissioner Stamper and carried. Letter next read fN)m Richard Healy suggesting that the City print on its water bills the slogan "Save Lives - Obey Traffic Laws", and on motion of Commissioner Kadet, seconded by Commissioner Cordell and carried, the Commission authorized such slogan to be printed on the next water bills the City has printed. The City ManaEer next reported of several unclaimed bicycles and other articles held by the Police Deo~rtment that they wish to dispose of thru public sale, and on motion of Commissioner Cordell, Seconded by CommissiOner Kadet, same was aothorlzed.
