City Commission of the City of Sanford, Florida, met in regular session at the City September 14, 1953. Mayor W. H. Wieboldt who operates a business at 210 Park Avenue, appeared and requested the Commission to restrict the time limit on parking in the 200 block on Park Avenue ac as to elimi- nate the all day parkers that are utilizing all the spaces, and after discussion same was re- ferred to the City Manager and Chief of Police f or survey and recommendation. On recommendation of the City Manager, and c~ motion of Commissioner Ivey, seconded by Commissioner Cordell and carried, the Commission next accepted offer of Robert Bennett to purchase the old clubhouse at the old baseball park at price of $150.00 for salvage purposes, with understanding that he will indemnify the City from any and all damages by surety bond, re- move the building within a reasonable time and clean up the premises. Mr. Bennett advised that he would have the building removed within sixt~ days if weather permits. Mr. Thomas, Commercial Agent for Atlantic Coast Line Railroad Company, next appeared with further reference to the proposed revocable easement to the City for widening and extending Railroad Avenue and explained that the reason they could not convey the property to the City for a street right of way was because it was a stock company and could not dispose of any of its fis- cal property. He also advised that they would probably never have any reason for revoking the easement and pointed out the number of years that Railroad Avenue has already been used as a public street, which is railroad property. Action deferred. A group from the Little Theater Guild with William Herschel as spokesman, next appeared and submitted request to use the City auditorium for producing and showing four plays during period October thru May, which would include using it six nights for each production, adv~ing that they would give the City at least six weeks advance notice for request for each play. After discussion the request was referred to the City Manager to work out a satisfactory schedule on use of the auditorium in order that they may be able to reserve it for at least one production at a time. Commissioner Ivey next introduced Ordinance No. 525, entitled: AN ORDINANCE OF THE CITY OF SANFORD~ FLORIDA, PRESCRIBING RATES TO BE CHARGED FOR WATER FURNISHED BY THE CITY OF SANFORD, FLORIDA, AND THE TIM~ THAT SAID RATES SHALL BE PAID, AND REPEALING ORDINANCE NO. AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. and same was placed on its first reading and read in full. Consideration next given to charging a higher rate for water furnished to consumers outside the city limits, and after discussion Commissioner Cordell moved that the rate for all services outside the city limits be increased to 30~ above the regular rate, effective as of October l, 1953. Seconded by Commissioner Stemper and carried. Commissioner Stemper next introduced Resolution No. ~21, and after being read in full, moved its passage and adoption. Said Resolution No. 821 bein~ in words and figures as follows: A RESOLUTION OF THE CITY CCMMISSION OF THE CITY OF SANFORD~ FLORIDA~, APPROPRIATING ANY UNEXPENDED CASH SURPLUS ON HAND AT THE END OF THE FISCAL YEAR 1952-1953 TO THE DEPARTMENT OF THE GENERAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR 1953-1954 FOR USE FOR THE ORDINARY PURPOSES AND OPERATING EXPENSES OF SAID CITY. WHEREAS, the City Commission Of the City of Sanford, Florida, deems it necessary, ex- pedient, and for the best interest of said City that any unexpended cash surplus as of September 30, 1953, of the operating revenues of said City for the fiscal year 1952-1953 be appropriated for the ordinary purposes and operating expenses of said City in the budget for the fiscal year 1953-1954. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that any unexpended cash eurplus as cf September 3©, 1953, of the operating revenues of eaid City for the fiscal year 1952-53 be, and the same is hereby, appropriated to the Department of General Government of said City for the ordinary purposes and operating expenses of said City for the fiscal year 1953-1954, and sai~ cash surplus shall be incorporated in the budget of revenues and expenditures of said City for said fiscal year 1953-1954 for the ordinary purposes and operating expenses of eaid City. City Clerk Request next submitted from the Navy Department for City to Quit-Claim deed that portion of Nellonville Avenue extending thru the Sanford Naval Air Station, and on advice of the City Attorney the Commission declined the request until the entire airport property is conveyed back to them. On motion of Commissioner Stemper, seconded by Commissioner Cordell and carried, the Commiesion next approved the following Escrow Agreement with the Seminole County Chapter of and the Mayor and Clerk was authorized to execute same on behalf of Disabled American Veterans, the City: ESCROW AGREEMENT TO FLORIDA STATE BANK DATE - August 10, 1953 Banf ord, Florida. Williams submitting further request for City to rezone their three lots at southeast corner of French Avenue and 15th Bt., for CommerCial use, together with letter from Volie A. Williams, Attorney, advising that it would not affect the condemnation suit to proceed with the proposed rezoning cf all the property on French Avenue north of 18th Street since satisfactory settlement was being made f or all parcels of property for rights of way in that area. Thereupon Commissioner Kadet moved that a public hearing be held at 8:00 o'clock P.M. October 12, 1953, to consider rezonlng all the property on French Avenue north of 18th St., in accordance with the recommendations ~ the Planning Board. Seconded by aommlssloner Ivey and carried. The matter of adopting an ordinance regulating installation of television antenas was next discussed and approved, and the City Manager directed to confer with the local relevision distributors with reference to preparing the appropriate ordinance for consideration. Commissioner Kadet next moved thst the Commissioners meet in the Commission Room at ?:30~. M. on regular meeting nights for discussion of city government which will be broadcast over the local radio station. Seconded by Commissioner Btemper and carried over the dissenting vote of Commissioner Ivey. Municipal Judge Williams next appeared am~ made the following recommendations f or traffic regulations: That the speed limit on Park Avenue from 14th Street south, and on French Avenue 104 MINUTES City Commission, Sanford, Florida, ....~..?..,p.,tf...~.?.?..~.r.....1..~....~....~..:...~.: ............. t9.....~..~. missioner Ivey moved that the speed limit be increased to 35 miles per hour from 15th Street south on Park Avenue, and from 20th Street south on French Avenue. Seconded by Ccmmissioner Cordell and carried. The other recommendation was referred to the Traffic Committee for consideration. Judge Williams also recommended that the City amen ite gambling ordinance so as to enact the state's gambling law, which was referred to the City Attorney. The City Nanager next reported that the County Commissioners would not accept the City's proposal to convey all its rights to the County in the property described as Lots 6 thru 9 of Block ll Tier 8, E. R, Traffords Nap, provided the County assume all obligation in acquiring the rights of way for widening French Avenue, and that he had s~ggested a counter proposition from them. Commissioner Kader then suggested that a resolution be sent to the Board of County Commissioners to the effect that ~hey are holding up the development of Sanford and Seminole County through their actions, but no action was taken on the matter. The City Nanager next brought up the matter of appointing a Recreation Board with counsels relative to renovating the City Hall auditorium and establishing a recreation center in connection with the committee now attempting to raise funds for a building for such purpose, and after discussion he was authorized to confer with the committee on such a proposition. The City Manager next reported on no record of City having an easement for the open drainage ditch along the city limit line east of Buena Vista Subdivision, which runs across the east end of T. A. Burner's property, and that he is protesting against the City maintaining the ditch. No action taken. The Commission then proceeded to a further study of budget of revenues and expenditures for fiscal year 1953, and after authorizing several changes, directed that the revisions b e made and re-submitted for further consideration. Commissioner Stemper moved that the tax levy for operating expenses be placed at 6.5 mills for 1953 instead of the proposed 7 mill, levy. to carry by the following vote of the Commission: Seconded by Commissioner Kader but failed Commissioner Chase Naye " Cordell Nays " Ivey Naye " Kadet Aye " Stemper Aye There being no further business the meeting then adjourned until 8:00 o'clock P.N.
